Seeking Answers and Accountability: A Citizen’s RTI Challenge to the Police

Unpacking the RTI: A Mirror to Police Functioning and Public Grievances

The Right to Information (RTI) Act, 2005, remains a powerful tool. It allows Indian citizens to demand transparency and accountability from public authorities. A recent RTI application was filed by Mahima Maurya with the Superintendent of Police Office, Mirzapur. This application represents a significant RTI challenge regarding police practices. It provides a stark look into the challenges citizens face in navigating the justice system. These challenges particularly concern police action, procedure, and officer conduct.

This RTI is not just about a specific case. It delves into several critical questions about police integrity. She also examines the application of new criminal laws. It looks into the handling of citizen grievances. The RTI emphasises the challenge to police operations in these areas. It showcases the broader concerns raised by the citizen’s challenge.

The Case in Question: A Dispute, Cross-NCs, and Preventive Action

On September 14, 2024, two cross-Non-Cognizable Reports (NCs) were registered. This occurred at Vindhyachal Police Station. The registration was due to a dispute at the core of the matter.

The police inquiry report states that they initiated preventive measures instead of arresting the accused. This was done under the new laws (Sections 170/126/135 of BNSS). The police advised the applicant to seek relief from the court. They accused her of submitting repeated, often ‘concocted’ applications. These applications illustrated the RTI challenge to police discretion in these matters. This occurred despite a medical report allegedly indicating no fracture injury related to the incident.

Seven Critical Questions Challenging Police Action

The applicant’s RTI application (Registration No. SPMZR/R/2024/60224) demands seven specific points of information, each meticulously crafted to address significant facets of public concern that have arisen in recent times.
These points serve not only to illuminate the specific areas of inquiry but also to reinforce the broader challenge related to the police procedure and transparency that lies at the heart of this RTI demand.
By unpacking these critical issues, the applicant seeks to ensure that the mechanisms of accountability are upheld, fostering a sense of trust between law enforcement agencies and the communities they serve.
Furthermore, this request underscores the importance of accessible information as a fundamental right for citizens, ultimately promoting a more informed and engaged public discourse surrounding law enforcement practices.

1. Action on the NCR: Why No Further Steps?

The applicant specifically asks for the action taken in her filed NCR (NCR No. 104/2024), which serves as a formal notification to the authorities regarding a reported incident. The unique nature of NCR requires court permission for any further investigation, often complicating the process for the complainants.
Citizens frequently struggle to understand the exact status of their complaints and the procedural intricacies involved. They also face challenges in navigating the next steps that are to be taken by the police, particularly in the context of legal requirements and documentation that must be fulfilled.
This encapsulates a personal RTI challenge in seeking clarity, as the lack of transparency can lead to frustration and confusion for individuals attempting to engage with the justice system effectively. By obtaining detailed information on her NCR, the applicant aims to foster a greater understanding of the ongoing proceedings and to ensure that her rights are being upheld throughout this complex process.

2. The Officer’s Conduct Under Scrutiny

Points 2, 3, and 4 examine the service history of Sub Inspector Vinod Kumar Yadav, the officer in focus. These points detail his various postings and his extensive span of service in Mirzapur, highlighting details regarding his first assignment, which shaped his foundational experiences.
Understanding the trajectory of his career is critical, as it not only sheds light on his professional growth but also on the challenges he encountered along the way. This common tactic in RTIs helps to establish an officer’s background when others question their actions, providing context that can be essential in comprehending the motivations behind certain decisions and behaviors.
This aspect introduces a nuanced layer to the RTI challenge faced by police, suggesting that the scrutiny of an officer’s past can influence perceptions of their present conduct. Such detailed examinations can ultimately contribute to greater accountability and transparency within the police force, fostering public trust while also recognizing the complex nature of law enforcement work.

3. Allegations of Threat and Retaliation

Point 5 raises the most serious allegation, which cannot be taken lightly given its implications. The applicant claims that Sub Inspector Vinod Kumar Yadav threatened to implicate her in a fake case, a situation that not only undermines the integrity of the law enforcement system but also instills fear in the minds of the public.
The RTI seeks information on whether Vindhyachal Police Station has registered any case against her, addressing the necessity for transparency and accountability in police actions.
This request is crucial, as it highlights a direct concern about the misuse of power, adding significant weight to the RTI challenge based on specific incidents that have arisen in the past.
The potential threat of being wrongfully accused can have severe consequences on an individual’s life, reputation, and mental well-being, and thus, it is imperative that such allegations are thoroughly investigated.
By pursuing this route through the RTI, the applicant also aims to shed light on a broader issue of potential abuse within the police force, advocating for justice and the protection of citizens’ rights in the face of such troubling circumstances.

4. Demand for Complete Records

Point 6 asks for a copy of the opposing party’s NCR (No. 105/2024) and the corresponding medical examination report—a crucial demand for transparency to ensure fair recording of facts from both sides.
Such demands underscore the essence of an informative RTI challenge to police record handling, which not only reflects the necessity for accountability within the law enforcement system but also highlights the importance of ensuring that every piece of information is meticulously documented and available for scrutiny.
By requesting these documents, the involved parties are advocating for a systematic approach to justice, where claims and counterclaims can be evaluated based on concrete evidence.
This principle of transparency fosters trust among all stakeholders, ensuring that the procedures followed are not only lawful but also just and equitable.
Ultimately, it serves to protect the rights of individuals and uphold the integrity of the legal processes in place.

5. Legal Clarity on New Criminal Codes

The final and perhaps most profound question addresses how the newly enacted criminal laws apply. The applicant seeks clarity on the provision of law. Which law allows for a conversion of sections from BNS (Bharatiya Nyaya Sanhita) into BNSS (Bharatiya Nagarik Suraksha Sanhita). This question strikes at the heart of the confusion. The new codes require an official legal explanation from the PIO. These inquiries intensify the RTI challenge as they explore legislative interpretation.

The Significance: A Call for Transparency

This RTI inquiry serves as a compelling example of a citizen demanding accountability on multiple fronts. They demand accountability for the investigation of their complaint. She questioned the conduct of an individual officer. They also scrutinize the correct application of legal procedures. They focus especially on the new criminal justice framework. This emphasizes an RTI challenge to police accountability.

The Public Information Officer (PIO) has a statutory duty to give this information within the stipulated 30 days. The outcome of this inquiry will give specific answers to the applicant. It will also set a public record on the police’s handling of the new laws. Additionally, it will document their response to serious allegations of misconduct. These allegations were raised by the challenge that the RTI posed to police authority.

Yogi police is not registering the first information report of Mahima Maurya showing the truth of the Yogi government who claims to provide good governance in the state of Uttar Pradesh.

  2. It is most surprising that the police is not registering the first information report in the matter in which victim was mercilessly beaten by the offenders, her bone was fractured and several injuries found on her body many of them were serious and bleeding out from the injuries which was sufficient to register the first information report in the matter but police did not do so because of the corruption in the police and biased approach was adopted ly by the police.
