A Citizen’s Plea: Tracking Grievances Against Police Inaction in Mirzapur

Mr. Ashok Kumar Maurya of Vihasara Khurd village in Mirzapur, Uttar Pradesh, has filed multiple grievances, highlighting various concerns regarding the local governance and enforcement of legal mandates.
Alongside these grievances, he submitted a Right to Information (RTI) application, which serves as a vital tool for accountability and transparency in public administration.
Both the grievances and the RTI application center around the alleged failure of the local police to enforce a civil court order, a situation that raises serious implications for justice and rule of law in the region.
The core of the issue is the continued construction on a piece of land despite a court-issued injunction, which has been a source of frustration for Mr. Maurya and other residents who believe that their rights are being compromised.
This defiance not only undermines the effectiveness of the legal system but also poses risks to the community, as the ongoing construction could lead to further legal complications and exacerbate existing conflicts among local landowners.

The Central Issue: A Court Order Ignored

The dispute revolves around Plot No. 105 (acreage 0.04200) in Village Vihasda Khurd, Tehsil Sadar, Mirzapur, which has become a matter of significant contention among local stakeholders.
This small but strategically important piece of land has been subject to different claims from various parties, each arguing their right to its possession and use.
As local farmers, developers, and government officials weigh in on the issue, the implications of the dispute extend beyond mere land ownership, affecting the livelihoods of the residents and the economic development of the region.

On September 22, 2023, the Civil Judge (Jr. Div.), Mirzapur, issued a provisional injunction. The order explicitly forbids the respondent from interfering with the property, which is in the possession of the plaintiffs. Yet, Mr. Maurya alleges that the opposing party has continued construction, including digging a foundation, in direct violation of this court order.

Timeline of Grievances and Current Status

Mr. Maurya has escalated his complaint through various official channels, including contacting relevant agencies and submitting detailed reports outlining his concerns; thus, he is seeking intervention from local, state, and national authorities to address the issues he faces.
He believes that their involvement will bring about a more effective resolution to the problems he has encountered, which have been persisting for an extended period and significantly impacting his daily life.

1. Starting Complaint to Uttar Pradesh Government against police inaction

  • Registration Number: GOVUP/E/2023/0034257
  • Date of Receipt: May 27, 2023
  • Grievance: Obviously, Mr. Maurya states that he gave the Station House Officer (SHO) of Jigna Police Station a copy of the stay order. Yet, he alleges that despite this, no action was taken by the police or relevant authorities. As a result, the ongoing construction was not stopped, leading to further escalation of the situation. This, in turn, led to a contempt of the court’s order, which undermines the rule of law and raises concerns about the enforcement of judicial decisions within the jurisdiction.

2. Follow-up Grievance to Uttar Pradesh Government

  • Registration Number: GOVUP/E/2024/0096233
  • Date of Receipt: December 28, 2024
  • Grievance: This complaint highlights a serious issue. Moreover, despite repeated assurances from the SHO Jigna, anti-social elements continued their work. Consequently, offenders started digging a foundation on the disputed land. This act made a mockery of the court’s order and the officer’s promises.

3. Escalation to the Prime Minister’s Office about police inaction

  • Registration Number: PMOPG/E/2024/0186864
  • Date of Receipt: December 30, 2024
  • Grievance: This grievance escalates the matter. As a result, it points to the “insensitivity” of the SHO Jigna and the Superintendent of Police, Mirzapur. Furthermore, it warns that without timely police intervention, the situation may spiral out of control. This could ultimately deny justice to the applicant.

Current Status: Under Process

Seeking Accountability via RTI

To get concrete information on the lack of action regarding his concerns, Mr. Maurya, thus, filed a Right to Information (RTI) application with the Superintendent of Police Office, Mirzapur, in hopes of shedding light on the procedures being followed by the authorities and the reasons behind their inaction.
He believed that by formally requesting this information, he could uncover the details surrounding the ongoing situation and understand better the obstacles that might be hindering effective resolution.

  • RTI Registration Number: SPMZR/R/2024/60242
  • Date of Filing: December 30, 2024
  • Status: RTI Request Received

It is a bitter truth that our public staff behave like elephant teeth as like elephant teeth its dealing is something but show off is totally different from it. Whether it is not showing that our public system is incredible and it cannot safeguard us. In the name of governance there is only out show because the factual position is terrific. Our public staff search various tricks to loot the innocent and gullible people which are the root cause people are crying but our political masters have shut their eyes and years.

Undoubtedly it reflects the insensitivity of the public staff. They are no more interested in the public services and only search various tricks to increase the back door income. It is quite obvious that the applicant has knocked entire doors available to him but no one came forward to help him only because of rampant corruption in the public departments. It is ridiculous when our prime minister and Chief minister talk of honesty.

  3. It is obvious that Police are overlooking the matter even after repeated requests being made by the applicants. It is reflecting the lackadaisical approach of the police to the grievances of the common people and it is deliberate due to corruption. As the termite hollows the big tree like wise corruption made our country weak. Corruption is destroying everything in this country.
