🌳 The Four-Year Gap: Questioning the Integrity of Forest Governance in Uttar Pradesh 📝

The prolonged practice of allowing a Deputy Ranger to hold the charge of a Forest Ranger for over four years, particularly in a “super sensitive” area like the Baki Range under the Gorakhpur Division, raises serious alarms about adherence to administrative rules, public accountability, and environmental integrity within the Uttar Pradesh Forest Department.

This issue, highlighted by an RTI application (Registration Number: DPTFW/R/2025/60026) filed by Yogi M P Singh, is not merely a procedural lapse. It points towards a systemic failure of oversight, potentially contributing to the very environmental violations—such as the reported unauthorized felling of green trees in areas like Kodwari forest in Mirzapur—that forest administration is meant to prevent.

📜 The Rules vs. The Reality: A Case of Prolonged ‘Alternative Arrangement’

The official justification provided by the Divisional Forest Officer (DFO), Gorakhpur, for the continued charge-holding by Deputy Ranger Shri Jagdamba Pathak, is the classic administrative bypass: “alternative arrangement” due to the Ranger position not being filled at the government level. While the U.P. Subordinate Forest Service Rules, 1951, do allow for such ad-hoc promotions based on fitness and qualifications, they are fundamentally intended as temporary measures, not indefinite appointments that bypass the regular promotion and posting mechanisms.

Why is the Prolonged Charge Concerning?

  • Erosion of Authority: A Deputy Ranger, even with the charge of a Ranger, possesses a different mandate and is often less empowered in terms of seniority and decision-making than a formally appointed Ranger. This can weaken the range’s administrative backbone.
  • Bypassing Accountability: Indefinite charge-holding can obscure responsibility. When an officer is in an acting capacity for years, it creates a gray area regarding who is ultimately accountable for long-term policy failures and environmental damage.
  • Ignoring Public Will: Repeated objections from the local community—the primary stakeholders in forest conservation—signal a severe breakdown in trust. Public accountability demands that administrative appointments, especially in sensitive areas, adhere to transparent and timely procedures.

🚨 Allegations and Environmental Integrity

The administrative loophole is compounded by the shadow of serious allegations against the concerned officer, including misconduct and the unauthorized felling of green trees. The broader context of illegal tree felling—such as the large-scale incidents reported in the Kodwari forest area of Mirzapur—suggests that this is not an isolated local failure but potentially part of a larger pattern of environmental crime that flourishes where governance is weak or compromised.

The Failure of Oversight:

The inaction or “silence” of higher authorities in the face of these public complaints constitutes a grave failure of oversight. The system appears to be shielding the officer, effectively enabling further misuse of power and eroding public trust. This negligence sends a clear message that environmental violations, when committed under the protection of administrative ambiguity, may go unpunished.

The Baki Range’s proximity to the Nepal border further escalates the risk. Border areas are inherently susceptible to timber smuggling and other cross-border illegal activities, requiring the strongest possible leadership and highest level of integrity from the appointed Ranger. To leave such a critical post under a prolonged ad-hoc arrangement, especially with serious allegations pending, is an administrative and ecological hazard.

🔍 The Core Questions Demanded by the RTI

The RTI request, by demanding specific information, seeks to unmask the systemic issues that permit this prolonged irregularity. The following points represent the imperative administrative and legal queries that the Public Information Officer (PIO) must address:

  1. Staffing and Vacancies: By asking for the total number of Rangers/posts and details of Rangers who are currently unassigned to a range, the applicant attempts to determine if a qualified Ranger was actually unavailable, or if the government level is simply mismanaging its available personnel.
  2. The Right to Reason: This is the most crucial question. Under Section 4(1)(d) of the RTI Act, 2005, public authorities have an “obligatory duty” to provide reasons for their administrative decisions. The PIO must justify why a Deputy Ranger was chosen to hold the charge for four years, and why this arrangement continues despite public objections and allegations of misconduct.
  3. Supervisory Accountability: Naming the public personnel who supervise Ranger postings at the government level will identify the officers ultimately accountable for the four-year vacancy and the failure to make a permanent appointment.
  4. Demand Letters for Vacancy: Requesting any local office demand letters to fill the Baki Range vacancy will reveal if the delay is due to the local administration’s inaction or a lack of response/priority from the higher government level.
  5. Overlooking Transfer Policy: If Shri Jagdamba Pathak has been repeatedly retained in a “plum posting” in a sensitive area, the PIO must justify how this aligns with the government’s standard transfer policy, which is designed to prevent long-term stagnation and the entrenchment of vested interests.

🛣️ The Path Forward: Restoring Trust and Integrity

To genuinely address the concerns raised and to restore public confidence in the forest administration, the Forest Department and the district administration must take immediate and decisive action.

  1. Legality and Time-Bound Appointment: The prolonged charge must be reviewed for its legality under the 1951 Rules and applicable service laws. A time-bound plan must be instituted to fill the Baki Range Ranger position through regular promotion or direct appointment, ending the “alternative arrangement” immediately.
  2. Impartial Investigation: The allegations of illegal tree felling and misconduct must be subjected to an impartial, high-level investigation. The findings should be made public, and appropriate action taken against any official, regardless of rank, found to be involved.
  3. Transparency and Community Engagement: All future appointments and transfers in sensitive areas must be made with maximum transparency. Crucially, the administration must engage with local communities, whose knowledge and grievances are invaluable for effective forest protection, to rebuild the trust that has clearly been fractured.

The health of the forest and the strength of its governance are intrinsically linked. An environment where administrative rules are indefinitely suspended and officers are allegedly shielded from serious accusations is one where the forests themselves are vulnerable. The response to this RTI is a critical opportunity for the Uttar Pradesh Forest Department to demonstrate its commitment to environmental protection and institutional integrity.

  1. Hero this question arises that whether the concerned public staff will provide the information concerning the postings of the rangers and number of vacancies and posting of the rangers against such post.

Whether this optional arrangement is made for 4 years and still continued. This is not an optional arrangement but a corruption.

How can a deputy Ranger be provided the charge of ranger for 4 years even after repeated objections by the people of the area and there are certain allegations against this incharge Ranger by the local people like felling down of the green trees without permission and formalities and many other charges leveled against him.

  4. If the government is really honest then it must promote The Right to Information act 2005 in departments of the government but where is transparency if the application submitted under Right to Information act 2005 are not entertained by the Public Information Officer of the public authorities.
