📝 Blog Focus and Summary: RTI Appeal Against NHM, U.P.

Understanding SPMU’s Role in RTI Appeals: how NHM UP’s State Programme Management Unit failed to release the 17,000+ candidate waiting list under RTI. This situation highlights the need for systematic reforms within the organization, ensuring that future RTI requests are met with prompt and complete responses to uphold democratic principles and promote fairness in public employment practices. Without these changes, similar issues may continue to arise, further eroding confidence among job seekers.

🎯 Understanding SPMU’s Role in RTI Appeals: Focus of the Blog Post

Understanding SPMU’s Role in RTI Appeals starts with this central focus of the blog post: the failure of transparency and accountability within the National Health Mission (NHM), Uttar Pradesh, specifically concerning the recruitment waiting list and the violation of mandatory timelines under the Right to Information (RTI) Act, 2005.

In particular, it highlights the systemic issue where public officers evade providing crucial information, even when mandated by both the RTI Act and a High Court directive.

📑 Brief Summary

Specifically, this blog post will detail the RTI First Appeal filed by Yogi M P Singh (Registration No. DIRMH/A/2024/61125) against the Medical and Health Directorate/NHM, Uttar Pradesh. (Understanding SPMU’s Role in RTI Appeals)

In fact, the appeal’s core is the non-receipt of information regarding the waiting list of candidates for a recruitment process. As a result of the delay, the appellant filed the original RTI application on November 10, 2024, and 50 days have now passed without a reply. Consequently, this breaches the 30-day statutory limit set by Section 7(1) of the RTI Act.

Notably, the appellant argues that the Public Information Officer (PIO) (post of Upmahaprabandhak NDC) is deliberately attempting to conceal irregularities. Furthermore, the appellant says this shows contempt for the law, since a High Court order ties the matter to consideration of candidates’ representations.

Finally, the summary concludes with the appellant’s demand for the immediate release of the information. In addition, it calls for disciplinary proceedings against the defaulting PIO for violating the core principles of the Right to Information Act.

Understanding SPMU’s Role in RTI Appeals

Understanding SPMU’s Role in RTI Appeals means understanding who actually holds the waiting list. The State Programme Management Unit (SPMU), NHM, U.P. — not the PIO alone — controls release of the recruitment waiting list through its General Manager, HR. Consequently, any RTI appeal on this subject inevitably runs through the SPMU’s chain of command, which is why this appeal names both the PIO and the SPMU as parties who must account for the delay.

An Applicant’s Fight for Information Under the RTI Act 2005

The Core Grievance: Violation of RTI Timelines

  • Appeal Date: December 29, 2024 (Registration No. DIRMH/A/2024/61125).
  • Duration Elapsed: One month and 20 days without a response.
  • Legal Mandate: The RTI Act, Section 7(1), requires the PIO to provide information within 30 days.
  • Ground for Appeal: “No Response Within the Time Limit.”

Information Sought: The Waiting List Controversy

Accountability Crisis and Relief Sought

  • Identified PIO Post: Upmahaprabandhak NDC (Name unknown to the appellant/not listed on the portal). (Understanding SPMU’s Role in RTI Appeals)
  • Appellant’s Allegation: Indeed, the lack of response is an attempt to “conceal wrongdoings” and is against the spirit of transparency and accountability.
  • Specific Prayer in Appeal:
    1. Direct the Public Information Officer (PIO) to provide the information at the earliest.
    2. Start disciplinary proceedings against the PIO for violating Section 7(1) of the RTI Act 2005.

1. Violation of the Right to Information Act (RTI Act), 2005

First, the most direct legal ground for the appeal is the violation of Section 7(1) of the RTI Act.

  • The Mandate: Specifically, Section 7(1) requires the Public Information Officer (PIO) to furnish the information as expeditiously as possible, and within thirty days of receiving the request.
  • The Breach: In fact, the appellant filed the original RTI on November 10, 2024, and the appeal on December 29, 2024 — a gap of one month and 20 days (50 days). As a result, the PIO failed to act within the statutory time limit.
  • The Penalty (Section 20(1)): Notably, the appellant explicitly requests disciplinary proceedings. Therefore, under Section 20(1), the State Information Commission (SIC) can fine the PIO up to ₹250 per day, capped at ₹25,000, once it hears the appeal and finds no reasonable cause for the delay.
  • Benefit to Applicant (Section 7(6)): Additionally, the law states that if the PIO fails to comply with the time limit, it must provide the information to the applicant free of charge.

2. Disregard for High Court/Judicial Direction (Understanding SPMU’s Role in RTI Appeals)

Indeed, the appeal gains additional weight from the reference to the Allahabad High Court:

The high court of judicature at Allahabad ordered the concerned public authority to consider the aspirants’ representation. This pertains to the issue of the waiting list of candidates.

  • Context: While the appeal does not give the exact case number, it argues that the recruitment waiting list carries a judicial mandate, not just an administrative one. Therefore, the High Court’s direction to “consider the aspirants’ representation” places a heightened administrative duty on NHM/Medical Health Directorate.
  • The PIO’s Action: Moreover, by withholding the information, which may show whether officials considered the representations, the PIO is not only violating the RTI Act. This, in turn, breaches the principle of transparency underlying the judicial process. Indeed, the appellant uses strong language (“Jungle rule,” “corrupt people”) to reflect the perceived contempt for both the RTI Act and the judicial process.

The blog post should emphasize that the appeal is not just about a missing document, but about a breakdown of accountability at the intersection of a High Court order and the RTI law.

Importantly, this section only gives information drawn directly from the source record, or found through public search. However, the source record does not list specific contact details — email or phone number — for the General Manager, HR, State Programme Management Unit (SPMU), National Health Mission, U.P. That private contact information is therefore not included here.

However, a public document (NHM UP list of officials) available via search identifies the post and the official’s name as:

  • Designation: General Manager, HR
  • Name: Ms. Sudha Yadav

While the document publicly lists this name, authorities generally keep the direct mobile number or personal email private. Instead, the search results confirmed only a general contact for the SPMU.

General NHM U.P. Contact (SPMU)

Finally, for official communication to the State Programme Management Unit (SPMU) of NHM, U.P., which employs the General Manager, HR:

  • General Phone (SPMU): 0522-2237595, 2237383
  • General Email (NHM U.P.): mdupnrhm@gmail.com

Therefore, the appellant must rely on the email ID provided in the appeal for the designated PIO: jansuchnaadhikariupnhm@gmail.com.

Ultimately, understanding SPMU’s role in RTI appeals like this one shows why clear accountability between the PIO and the SPMU matters for every applicant still waiting on Uttar Pradesh’s health recruitment list.ne shows why clear accountability between the PIO and the SPMU matters for every applicant still waiting on Uttar Pradesh’s health recruitment list.

Everyone knows that every recruiting agency in this largest democracy in the world used to prepare a waiting list and when the vacancies are not filled then candidates are selected from this waiting list. It is quite obvious that entire seats are not filled in this recruitment process but recruiters are avoiding to select candidates from the waiting list because of the corruption in the working of the public authority. The high court of judicature at Allahabad has ordered the recruiters to consider the representation of the candidates but they overlooked the order of the High court.

  17. Right to reason is the indispensable part of the sound administrative system so it is an obligatory duty after director of the National health mission to provide the reason of not issuing the waiting list of the candidates for the appointment even when there are vacancies which could not be filled up.

  18. Public information Officer in Nagar Nigam prayagraj not provided information after the first appeal exhausted and second appeal hearing. Undoubtedly it was not fair dealing in recruiting the personnel in the public authority Nagar Nigam prayagraj quite obvious from the Procrastination in providing information by the Public information Officer.

  19. Think about the deteriorating condition of the National health mission Uttar Pradesh, that its director Pinky jewel has made the mockery of the law of land that it did not issue the waiting list of the candidates even when there is numerous vacancy could not be filled up showing in inscrutable face of sphinx. It seems that there is no rule of law in the state of Uttar Pradesh because they are breaking the age old traditions of doing selection from the waiting list.
