🚨 RTI Appeal: Alleged Denial of Information by Circle Officer Soraon, Prayagraj

In summary, this post reviews the appeal regarding denied information under the Right to Information (RTI) Act, 2005. The case involves Mauaima Police Station in Prayagraj, where the main issue is that the Circle Officer (PIO) failed to answer seven requested points.

📝 The Information Requested

To begin with, the original RTI request was filed on September 30, 2021 (Reg. No. SSPPY/R/2021/60093). It specifically asked the Public Information Officer (PIO), ACP Soraon (formerly Circle Officer Soraon), for details on Mauaima Police Station:

  1. Crime Statistics (Current Financial Year):
  2. Fuel Expenses (2019-20 and 2020-21):
    • Total costs (figures only) for diesel and petrol.
  3. Station House Officer (SHO) Details:
    • Posting details for the current SHO.
    • Date the SHO joined Prayagraj district.
  4. Sub-Inspector (SI) Details:
    • Names and posting details for all SIs.
    • Joining dates in Prayagraj district for each SI.
  5. Police Constable (PC) Details:
    • Names and posting details for all Constables.
    • Joining dates in Prayagraj district for each Constable.
  6. Building Maintenance Funds:
    • Specifically, the amount of money spent on painting and whitewashing over the last five years.
  7. Electricity Bill Funds(2019-20 and 2020-21):
    • Specifically, the total public funds used for electricity bills.

🏛️ Grounds for Appeal and Alleged Non-Compliance

Subsequently, the requester, Yogi M P Singh, filed an appeal on November 23, 2021 (Reg. No. SSPPY/A/2021/60053), stating that:

  • Total Denial of Information: First, the Circle Officer Soraon did not answer any point of the seven-point request, as the PIO completely refused the request.
  • Flawed Communication: Furthermore, the Station Officer Mauaima sent a vague denial by post; however, this letter lacked a cover letter from the Circle Officer Soraon (PIO), which demonstrates a breakdown in process and oversight.
  • Misuse of the Law: In addition, the requester states that the PIO’s actions undermine the RTI Act 2005. Because of this, he seeks disciplinary action against the Circle Officer Soraon.
  • Duty to Share Staff Lists (Section 4(1)(b)(ix)): Finally, the PIO withheld staff details (Points 3, 4, 5), even though under Section 4(1)(b)(ix) of the RTI Act, public authorities must publish a directory of their staff on their own.

🛑 Official Status and Rebuttal (Police Station Mauaima Information)

In contrast, official records indicate that both the request and the appeal are DISPOSED OF:

  • RTI Request Status: REQUEST DISPOSED OF on 23/01/2025.
    • PIO Reply (Hindi): “आप द्वारा प्रेषित जनसूचना प्रार्थना पत्र के सम्बन्ध में आपको सूचना प्रेषित की जा चुकी है।”
    • (Information has been sent to you concerning the public information application submitted by you.)
  • Appeal Status: APPEAL DISPOSED OF on 29/07/2025.
    • (The info requested by Yogi M.P. Singh under the Right to Information Act 2005 was given on 23.01.25. The appeal is closed as it is not valid.)

Although official replies state that officers sent the information on January 23, 2025, the requester claims they never got it or received incomplete data. Nevertheless, the First Appellate Authority (FAA) closed the appeal under the assumption that the data was sent.

For this reason, the requester bases their claim on key parts of the RTI Act, 2005:

  • Public Publishing (Section 4(1)(b)(ix)): Public offices must publish a staff directory proactively. Denying staff details (Points 3, 4, 5) breaks this rule.
  • PIO Duties (Chapter V): The PIO must supply the data. Failing to do so without good cause can lead to fines and action under Chapter V (Sections 20(1) and 20(2)).

➡️ Next Steps for the Appellant

Although officials closed the case, the requester maintains they never received the data. Therefore, the next logical step in the RTI process is a Second Appeal, or alternatively, a Complaint filed with the State Information Commission (SIC) of Uttar Pradesh.

In particular, to move forward successfully, the requester needs proof to show that they received no data or that the response was incomplete and missed the seven requested points.

Indeed, filing a Second Appeal or Complaint with the Uttar Pradesh State Information Commission (UPSIC) is the right move.

Accordingly, outlined below are key instructions for contacting the UPSIC and filing an appeal:

It is always that circle official/assistant commissioner of police made the mockery of the provisions of The Right to Information act by not providing information to the information seeker.

  3. It is obvious that they have provided incomplete information because there is 7 point of information and they have provided only few points consigning the cases only. Where are the posting details of the police personnel?

  4. It is obvious that initially they denied the information but later they provided part of information obvious from the provided information.
