RTI Appeal Filed Against UP Medical and Health Directorate Over Delayed Response due to PIO NHM U.P

Mirzapur, UP – An RTI applicant, Yogi M. P. Singh, has filed a first appeal against the Medical and Health Directorate of Uttar Pradesh, citing a failure to receive a response to his information request within the legally mandated timeframe, which is crucial for upholding transparency in public administration.
The appeal highlights a violation of the Right to Information (RTI) Act, 2005, a significant legislation intended to empower citizens by ensuring their right to seek information from public authorities and promote accountability.
In this case, Singh specifically points to the PIO from NHM U.P., who is central to this PIO NHM U.P. issue of being unresponsive, thereby undermining the spirit of the Act and raising concerns about the efficient functioning of the health department in the region.
The lack of timely responses not only affects Singh’s right to information but also reflects on the larger systemic issues within the department that need urgent attention to restore public trust.

The original RTI application was submitted on November 9, 2024. With no information provided by December 17, 2024, the applicant has escalated the matter to the First Appellate Authority in efforts to gain insight into the handling of his request.

Case Summary at a Glance

Here are the key details of the original RTI request and the subsequent appeal regarding the matter with the PIO at NHM U.P., emphasizing the involved PIO NHM U.P. in regards to the delay.
This situation has sparked significant concern among the applicants, as many have been waiting patiently for an update on their applications. The prolonged waiting period has resulted in confusion and frustration, raising questions about the efficiency and transparency of the process.

Grounds for Appeal

The primary ground for this appeal is “No Response Within the Time Limit.”
The applicant has pointed out that the PIO NHM U.P. failed to meet the timeline expected under the regulations set forth in the Right to Information Act.
This delay not only undermines the effectiveness of the transparency framework intended by the Act but also significantly impacts the applicant’s ability to obtain necessary information for their case.
The lack of timely response raises concerns about compliance and accountability, further emphasizing the need for stringent adherence to deadlines by public authorities.
As such, the applicant believes that this failure should be addressed promptly to uphold the principles of transparency and to encourage better practices within the NHM.

The applicant, Mr. Singh, states that his RTI request was filed online on November 9, 2024. As per Section 7(1) of the RTI Act, 2005, the Public Information Officer (PIO) is required to provide the requested information within 30 days of receiving the application.

By December 17, 2024, more than a month and a week had passed without any communication or information from the responsible PIO NHM U.P. The applicant contends that this inaction is a clear violation of the RTI Act and a “mockery of the provisions.

Prayer and Relief Sought from FAA against PIO NHM U.P

In his appeal, Mr. Singh has made the following requests to the First Appellate Authority: he seeks detailed information pertaining to the decisions made in his case, including all relevant documents, correspondence, and any related evidence that may support his appeal.
Furthermore, Mr. Singh requests a thorough review of the grounds on which his initial application was denied, as well as an explanation for any discrepancies that may exist in the information provided to him.
He emphasizes the importance of transparency and due process in this matter, asserting his right to understand the rationale behind the Authority’s decisions and urging prompt action to address and rectify any issues he has encountered during this process.

  1. Immediate Provision of Information: To direct the concerned PIO to provide the complete information sought in the original RTI application at the earliest.
  2. Disciplinary Action: To initiate disciplinary proceedings against the PIO for failing to adhere to the statutory deadline stipulated in Section 7(1) of the RTI Act, 2005.

Mr. Singh further commented that the purpose of the RTI Act—to promote transparency and accountability to curb corruption—is being diluted by such non-compliance from public officials. He expressed concern that this is a widespread issue that needs to be addressed seriously by higher authorities, especially involving steps taken by PIO NHM U.P.
