Subject: First Appeal under Section 19(1) of the RTI Act, 2005 regarding non-disclosure of information within the stipulated time frame.

Respected Sir/Madam,

I, Shivam Verma, hereby submit this appeal under Section 19(1) of the Right to Information Act, 2005, in reference to my RTI application bearing Registration Number DPBED/R/2025/60991, filed on 12/07/2025. The application was duly received by the concerned Public Information Officer (PIO), Mr. Pradeep Kumar Singh, Section Officer, as reflected in the online status: RTI REQUEST RECEIVED as on 12/07/2025.

Despite the lapse of more than 30 days, no information has been furnished to me, thereby constituting a clear violation of Section 7(1) of the RTI Act, 2005, which mandates timely response within thirty days from the date of receipt of the application.

🔍 Details of Information Sought:

  1. Action Taken Report by the Principal Secretary (Basic Education) on grievance DOSEL/E/2025/0003990, as referenced in the Ministry of Education’s Order dated June 2025 (Appeal No. DOSEL/C1N2510000616).
  2. Names and Designations of staff in the Department of Basic Education currently processing the above grievance.
  3. Details of Inquiry Officers investigating complaints against The Lions School, Bhujwa ki Chowki and Laldiggi, Mirzapur City, regarding coercion to purchase non-NCERT books.
  4. Action Taken Report by the Basic Shiksha Adhikari, Mirzapur, against institutions promoting private publishers through indirect means.
  5. Copies of Office Memos, Government Orders, Circulars, Guidelines, and Advisories issued by the Government of Uttar Pradesh concerning the mandatory use of NCERT books in public schools, nurseries, and kindergartens.

📌 Submissions of the Appellant:

  • The RTI application was filed and received on 12th July 2025.
  • As of today, 14th August 2025, the statutory period of 30 days has expired.
  • Consequently, the PIO has failed to comply with the provisions of Section 7(1) of the RTI Act, 2005.

🙏 Prayer:

  1. Kindly direct the concerned Public Information Officer to furnish the requested information without any further delay.
  2. Please initiate disciplinary proceedings against the PIO for non-compliance with the RTI Act, specifically for violating Section 7(1).

I trust that the First Appellate Authority will uphold the spirit of transparency and accountability enshrined in the RTI Act and take appropriate action to ensure timely disclosure.

  1. Think about the gravity of situation, competent officer of the central government forwarded the grievance concerning the coercing of private management to the guardians and students to purchase the private writers books so that they may get huge commission from the bookseller.

The statutory period of 30 days expired but the concerned public informtion officer did not provide information concerning the working of the principal secretary basic education department government of Uttar Pradesh. Why are government functionaries are allowing teaching of private writers books?

It seems that principal secretary department of basic education government of Uttar Pradesh did not take any action on the communication made by the Officer of Central Government which is the root cause, public information Officer in the office of the principal secretary is running away from providing information under Right to information act 2005.

  4. The right to information act 2005 was introduced by the government of India during the regime of Congress to promote transparency and accountability in the working after public authorities in this country. Since the principal secretary did not act on the communication provided by the central department which is the root cause, public formation officer is running away from providing information.
