The High Court Order for Vacancies in the NHM UP Recruitment is a subject of wide public discussion, highlighting significant concerns regarding the enforcement of judicial decisions. It underscores how public staff are disregarding the High Court’s ruling in the state, raising alarming questions about accountability and the rule of law in UP. This situation reflects not only a lack of adherence to legal directives but also suggests a deeper systemic issue within the public administration. Furthermore, the apparent indifference towards the court’s mandate can erode public trust in governmental institutions, leading to cynicism among citizens. Ensuring compliance with such judicial orders is crucial for restoring faith in the legal system and for promoting ethical standards within public service, as the rule of law is a fundamental pillar of democracy that must be upheld for the benefit of all.

High Court Order for Vacancies? The Crisis of Transparency in NHM UP’s 17,000+ Recruitment Drive

In a significant challenge to the administrative integrity of the National Health Mission (NHM), Uttar Pradesh, a series of grievances and legal petitions have highlighted what many call a “mockery of good governance” — despite a clear High Court Order for Vacancies to be filled. In fact, at the heart of the matter is the recruitment of over 17,291 contractual healthcare professionals, a process that has now spiraled into allegations of corruption, judicial defiance, and bureaucratic negligence.

1. The Core Discrepancy: Missing Lab Technicians

The recruitment notification (Ref. No: 642/SPMU/NHM/2022-23/6200) explicitly advertised 1,305 posts for Lab Technicians under the 15th Finance Commission. However, budget allocations reveal a startling gap:

  • Advertised Vacancies: 1,305
  • Current Honorarium Allocation: Only 770 (620 for Block Public Health Units and 150 for District Level Quality Labs).
  • Unfilled Gap: 535 posts remain vacant despite a valid waiting list of qualified candidates.

Indeed, the complainant, Yogi M. P. Singh, argues that although the state has allocated funds amounting to ₹20.32 Crore, it has failed to explain why nearly 40% of the approved positions remain unfilled.

2. The High Court Order for Vacancies and Allegations of Defiance

Notably, this High Court Order for Vacancies (Writ-A No. 14572 of 2024) previously directed the NHM to consider the representations of waiting-list candidates. Despite this:

  • Arbitrary Closure: On January 17, 2025, the Mission Director issued a notification terminating the recruitment drive, effectively barring waiting-list candidates from the seats they are legally entitled to fill.
  • The “Multiple Post” Issue: Furthermore, data suggests recruiters selected several candidates for 4 or more different posts simultaneously. Since one person can only occupy one position, the remaining vacancies should have automatically shifted to the waiting list. Instead, officials seemingly suppressed these seats.

3. The Bureaucratic “Ping-Pong” Effect

The grievance status of PMOPG/E/2025/0005524 reveals a frustrating loop in the redressal mechanism:

  • Subsequently, the complainant filed the grievance with the Prime Minister’s Office (PMO), which then forwarded it to the UP Chief Minister’s Office.
  • Officials “closed” the case on January 28, 2025, with a remark stating they had attached the report from the Chief Medical Officer (CMO) Mirzapur.
  • The Problem: The CMO Mirzapur stated that the matter is a “state-level decision,” meaning authorities asked a district-level officer to resolve a policy-level recruitment issue they had no authority over. Ultimately, this “disposal” without resolution is a classic example of administrative evasion.

4. Systemic Concerns: Corruption and Accountability

Meanwhile, the complainant has raised sharp questions regarding the “Pseudo honesty” of the system. If unauthorized departments ignore the High Court’s orders and close grievances, the “Right to Reason” (an essential part of sound judicial and administrative systems) is effectively dead.

Consequently, the demand for enforcing the High Court Order for Vacancies remains clear:

Overall, this development marks a critical turning point in the NHM UP recruitment saga. Consequently, the arbitrary closure of the process by Mission Director Dr. Pinky Jowel, I.A.S., despite an active High Court mandate, has sparked widespread outrage among candidates and transparency advocates.

Accordingly, the following structure highlights this escalation, focusing on the alleged violation of judicial orders.

Administrative Defiance: Mission Director Closes NHM UP Recruitment Despite High Court Mandate

The National Health Mission (NHM), Uttar Pradesh, has, in short, transitioned from a recruitment crisis to a constitutional one. However, while thousands of candidates were awaiting the resolution of their grievances as directed by the Allahabad High Court, the Mission Director, Dr. Pinky Jowel, reportedly issued an order to shut down the recruitment process entirely, in direct defiance of the High Court Order for Vacancies.

1. The Arbitrary Closure (Ref. No. 6871)

On January 17, 2025, the Mission Director issued a notification (Ref. No. 642/SPMU/NHM/HR/Appt./2024-25/6871) stating that the recruitment drive for over 17,000+ positions—including Lab Technicians, ANMs, and Staff Nurses—stands closed, effectively overriding the still-active High Court Order for Vacancies.

  • The Conflict: Notably, this closure occurred while several representations from waiting-list candidates were still pending, directly contradicting the High Court’s instructions to “consider” these cases.
  • The Impact: As a result, by closing the portal and the process, the NHM has effectively blocked the legal path for 535+ Lab Technician candidates (and thousands of others) who were next in line to fill vacant seats.

2. Contempt of Court Allegations

The High Court of Judicature at Allahabad, in various petitions (including Writ-A No. 14572 of 2024), had emphasized the “Right to Reason.” Specifically, this High Court Order for Vacancies intended officials to fill vacancies caused by non-joining or multiple-post selections from the merit-based waiting list.

  • Violation of Procedure: Moreover, legal experts argue that an administrative head cannot “abolish” a waiting list via notification when a judicial directive to process that list is active.
  • Lack of Accountability: Critics view the closure not just as an administrative end, but as a strategic move to avoid answering for the 17,000+ vacancies and the discrepancies in budget versus actual appointments.

3. The “State-Level” Evasion

Officials closed the grievance PMOPG/E/2025/0005524 with a remark stating they had “resolved” it at the level of the Chief Medical Officer (CMO) Mirzapur. Critics have described this as a “cruel joke” on the applicants: (High Court Order for Vacancies)

4. Demand for Immediate Intervention

Therefore, the complainant, Yogi M. P. Singh, has called for:

  • Revocation of the Closure Notice: The January 17 notification must be withdrawn to comply with judicial oversight.
  • Vigilance Inquiry: A specialized team should investigate why the 15th Finance Commission budget was allocated for 1,305 posts while only 770 were filled.
  • Accountability for the Mission Director: Authorities must clarify whether the Mission Director acted beyond her legal jurisdiction by undermining the High Court’s authority.

Finally, to assist you with your formal follow-up regarding the arbitrary closure of the recruitment process and to ensure your grievance reaches the correct authorities, here are the official contact details, application IDs, and tracking links based on current records.

4. How to Escalate (High Court Order for Vacancies)

  • File an Appeal on CPGRAMS: First, go to pgportal.gov.in, log in with your registration PMOPG/E/2025/0005524, and select “File Appeal.” State clearly that the “Resolution” provided by CMO Mirzapur is invalid as he is not the Appointing Authority.
  • Send a Speed Post: Next, send a physical copy of your complaint to the Chief Minister’s Secretariat, Room No. 321, UP Secretariat, Lucknow, addressed to Shri Arvind Mohan.
  • Judicial Notice: Finally, provide these details to your legal counsel to initiate Contempt of Court proceedings against the Mission Director for issuing a closure notice while the High Court mandate was active.
