Received a Refurbished UPS from Flipkart? Your Consumer Rights are at Stake!

The Grievance about Refurbished UPS: A Fight for a Functioning Product and Fair Service

Imagine ordering a brand-new electronic device. You expect a UPS (Uninterruptible Power Supply) vital for protecting your electronics. Instead, you get what appears to be a refurbished, old item, which highlights the common issues with purchasing refurbished UPS products. That’s the situation faced by Complainant Yogi M. P. Singh Mahesh Pratap Singh about his buy of an APC Back-UPS 600 from Flipkart.com (Order ID: OD332617717429323100, Date of Purchase: 2024-10-19).

The core of the grievance, filed on 2024-12-06, is a classic e-commerce nightmare: Replacement/Refund not provided – As per policy. The customer paid INR 3095 for what they believed would be a reliable and high-quality product. However, they received a faulty or old unit, reflecting a refurbished UPS purchase gone wrong, which not only failed to meet their expectations but also disrupted their plans that relied on the functionality of the device. Despite the assurance provided at the time of purchase, the disappointment has been significant, leading to frustration over the lack of responsiveness from customer service regarding their situation. The customer now firmly believes that they deserve better treatment and expects the platform to honour its commitment to quality and post-sales support, ensuring that customers like them can shop with confidence in the future.

The E-Commerce Evasion: Passing the Buck to the Brand

When the customer raised the issue, Flipkart’s response was not a solution. It was a redirection, which often leaves customers feeling unheard and dissatisfied. This is an increasingly common tactic that frustrates online shoppers who seek direct resolutions to their problems. Instead of addressing the specific concern raised, the response from Flipkart essentially stated that they were unable to assist and suggested contacting another department or external source for support. Such an approach not only amplifies the customer’s frustration but also erodes trust in the platform as a reliable service provider. In a competitive online marketplace, this reactive strategy poses a significant risk, as customers may choose to take their business elsewhere due to inadequate support and unresolved issues.

We would request you to reach out to the brand for post sales support related issues… Hence, closing the complaint from our end.

Flipkart provided the details for Schneider Electric India (APC’s parent company) and promptly closed the customer’s complaint. As for the refurbished UPS issue, the customer highlights the futility of this step. They state that “No significant reply made by the service providing company. It is referred to as the brand by the online shopping company.”

Violation of Consumer Rights: Where Does Responsibility Lie?

This case raises serious questions about the responsibilities of e-commerce platforms like Flipkart under Indian consumer protection laws. Purchasing a refurbished UPS without transparency is a crucial concern, as consumers are often unaware of the potential risks involved in such transactions. The lack of clear information regarding the condition, warranty, and performance of refurbished products can lead to dissatisfaction and financial loss for buyers. Furthermore, it highlights the urgent need for stricter regulations and guidelines to ensure that e-commerce platforms prioritize consumer rights and maintain ethical practices in their operations. By providing detailed disclosures and safeguarding customer interests, e-commerce giants can build trust and enhance the overall shopping experience for their users.

1. The Right to a Quality Product is no more safe if Flipkart is giving refurbished UPS

The customer explicitly claims that a “refurbished old item has been provided.” When a seller advertises a product as new but delivers a used item, it signifies misrepresentation. This issue with the refurbished UPS also indicates a violation of the Right to Information. Consumers have the right to receive the product they described and paid for.

2. The Failure of Post-Sales Service

The most egregious issue arises from closing the grievance. The company refuses to help with the warranty or replacement process. The customer highlights the gravity: “warranty services have not been, ensured but grievance has been, closed in advance.” Flipkart argues that the manufacturer holds the warranty. Nonetheless, the platform must fulfill its obligation as the seller and facilitator of the deal. It must ensure the customer receives the promised warranty service, especially when handling a refurbished UPS that is faulty or old.

Actionable Steps for the Complainant and All Affected Consumers

For Complainant Yogi M. P. Singh and others facing similar issues of being stuck between a seller and a brand, here are the necessary next steps:

  1. Formal Communication with the Brand (Manufacturer): The complainant should send a formal communication. This is necessary despite the lack of an initial substantial reply. This communication should be registered and sent via email or letter. It should be addressed to Schneider Electric India/APC. It must clearly outline the issue and reference the product’s serial number and the Flipkart Order ID. Keep copies of all correspondence.
  2. Escalate the Grievance on Flipkart: If possible, reopen the complaint or file a new one. Explicitly state that the prior closure was premature. Indicate that the brand redirection did not yield results.
  3. File a Consumer Complaint: The most powerful recourse is to file a formal complaint with the appropriate government body. This is currently listed as ‘In Process’ (Grievance Number: 6574733). Whether you received a refurbished UPS or not, submit all evidence. Be sure to include order details, Flipkart’s dismissal, communication with the brand, and product photos or videos.
  4. Use Social Media (If Necessary): Highlight the grievance on public platforms like X (formerly Twitter). Tagging both Flipkart and the brand can accelerate a response from their customer service teams.

How can rights be safe if there may be rampant corruption in the public system. There is no transparency and accountability in the working of the public authority in the Government of India.

  2. It is quite obvious that Flipkart is not providing any platform for online shopping but it has setup a platform to cheat the innocent and gullible people even educated by raping the benefits of the rampant corruption in the government machinery. Think about the lawlessness that no action was taken by the concerned in the matter.
