This is the reality for Shri Yogi M P Singh of Mirzapur, Uttar Pradesh. The appellant asserts he has only one bank account and has never taken any loans. This points to a blatant and massive case of financial fraud and cyber crime.

The issue has now escalated far beyond a police investigation, drawing significant attention from various authorities and the public alike.
The case reached the Uttar Pradesh Information Commission in Lucknow, where officials are now meticulously examining the implications and ramifications of this alarming situation.
It underscores not only the severity of loan fraud involving a PAN card but also raises awareness about the vulnerabilities in the financial system that can be exploited by unscrupulous individuals.
This incident serves as a wake-up call for regulatory bodies to tighten oversight and implement stricter measures to protect citizens from such fraudulent activities while ensuring accountability among financial institutions.


Why the Information Commission Got Involved

When starting efforts to get action, which initially seemed to be stalling and lacking momentum, the concerned citizen invoked the Right to Information (RTI) Act, 2005 in a bid to seek clarity and transparency regarding the issues at hand.
This powerful legislation, aimed at empowering citizens by providing them the right to access information held by public authorities, served as a crucial tool for the citizen to press for accountability and ensure that their voice was heard in the pursuit of justice.

On October 17, 2023, an RTI application was, filed with the Director General of Police Office. The applicant sought key details regarding the police’s handling of his complaint, specifically asking for:

  • The name and designation of the staff processing his serious cyber crime email.
  • The minutes of the proceedings and official notings made by the police officers.
  • A detailed report on the actual action taken concerning the ₹16 crore fraud.

The response received was seemingly inadequate. It neglected to offer the sought-after transparency. As a result, the case moved into a Second Appeal (S-01/0061/A/2024). This was before the State Chief Information Commissioner, Dr. Rajkumar Vishwakarma. The complaint emphasized loan fraud on a PAN card.


The Commissioner’s Stinging Summons to the SP

During the hearing on October 7, 2024, the Commission took an exceptionally serious view of the matter, understanding the extensive ramifications the financial fraud had on the community and the trust that had been shattered.
Recognizing the sheer scale of the financial fraud, which involved countless victims and millions of dollars lost, the bench issued a stern and unambiguous order to the police brass: they were to launch a thorough investigation immediately, ensuring that all responsible parties were held accountable and that steps were taken to prevent such malfeasance from occurring in the future.
The Commission emphasized the need for transparency and due diligence, urging law enforcement to prioritize this case and report back with regular updates on their progress.

  1. Mandatory Action: The Superintendent of Police, Cyber Crime, Uttar Pradesh, Lucknow, must take immediate cognizance of the case. He must make sure that appropriate action is, taken to resolve the fraud.
  2. Personal Appearance Required: The SP Cyber Crime must appear before the Commission in person. This should occur on the next date of hearing. They must give a report on the actions taken.
  3. No Lower Officer Allowed: Critically, the order explicitly states that the SP must attend in person. They must not send any lower or subordinate officer to represent the police. Their personal attendance is mandatory.

This directive elevates the matter from a mere RTI query to an accountability measure. It forces the highest relevant police authority to answer directly to the Commission. This is due to a serious lapse in public duty about the loan fraud using a PAN card.

    It is most unfortunate that police could not trace the bank accounts in which PAN of the applicant was updated is the failure of the police concerned. Whether the such police can safeguard the people in the state and their properties. No law and order can be maintained if the police is so incompetent.
