Accountability Under Fire: The Case of Indradev Yadav and the Prayagraj Municipal Corporation

In a democratic society, the right to question public authorities is not just a legal provision—it is a fundamental duty. However, a recent incident involving Indradev Yadav and the Municipal Corporation of Prayagraj highlights a disturbing trend: the use of intimidation to silence citizens who demand transparency.

What began as a simple inquiry into a 2007-08 recruitment drive has escalated into a case of alleged harassment, threatening calls, and a direct challenge to the “Rule of Law.”

The Core Conflict: Inquiry vs. Intimidation

On March 18, 2025, Indradev Yadav filed a grievance (Registration No: GOVUP/E/2025/0026208) regarding the transparency of recruitment drives conducted by the Municipal Corporation of Prayagraj. His request was grounded in Article 51A of the Constitution of India, which encourages a “spirit of inquiry and reform.

Instead of a formal response from the department, the applicant received a series of calls from an individual identified by Truecaller as Kamal Kushwaha, claiming to be staff from the Municipal Corporation.

The Staff’s Stance: “Why have you sent this grievance? Are you an officer? You are impeding government work.”

The conversation reportedly turned into a warning of “dire consequences” if the applicant continued his inquiry. This raises a critical question: Does seeking transparency constitute “impeding” work, or is it the department’s silence that truly hinders progress?

Key Evidence and Timeline

The grievance documentation provides a meticulous log of the interactions, painting a clear picture of persistent contact:

DateTimeInteraction TypeDuration/Status
Dec 23, 202410:49 AMIncoming Call1m 44s
Dec 27, 20244:54 PMIncoming Call4m 13s
Mar 23, 202511:52 AMIncoming Call3m 56s
Mar 23, 202512:09 PMIdentifiedKamal Kushwaha (Jio)

This timeline suggests that the contact was not a one-off misunderstanding but a sustained effort to engage—and allegedly threaten—the complainant over several months.

Constitutional Duty: The “Spirit of Inquiry”

The applicant’s defense rests on Article 51A(h) of the Indian Constitution. This article mandates that every citizen should develop a “scientific temper, humanism, and the spirit of inquiry and reform.”

When a citizen asks about recruitment processes from 2007, they are exercising their right to ensure that public institutions remain accountable to the “vulnerable sections” whose rights are often sidelined by systemic corruption. To label this duty as an “interference” is to misinterpret the very fabric of Indian democracy.

The Lack of Transparency in Public Offices

The core of Indradev Yadav’s latest grievance (GOVUP/E/2025/0028334) is a demand for basic identification. If an individual is calling on behalf of a government body to discuss an official grievance:

  1. Why is the call coming from a private mobile number?
  2. Why is the caller refusing to disclose their post and designation?
  3. Why is the tone confrontational rather than administrative?

The refusal of the Municipal Corporation to disclose the identity of “Kamal Kushwaha” suggests a lack of internal accountability. Under the All-India Services (Conduct) Rules and similar state-level guidelines, public servants are required to maintain high standards of integrity and courtesy. Threatening a complainant is a direct violation of these service conducts.

Legal Pathways for Redressal

For citizens facing similar threats, the law provides several avenues:

  • UP Jansunwai Portal (IGRS): The primary channel for escalating grievances against state departments.
  • CM Helpline (1076): A dedicated line for reporting administrative negligence or harassment in Uttar Pradesh.
  • Bharatiya Nyaya Sanhita (BNS): Section 351 (Criminal Intimidation) can be invoked if a person is threatened with injury to their reputation or person to stop them from performing a legal act.
  • Whistleblower Protections: While the 2014 Act faces implementation hurdles, the courts have consistently protected individuals who expose potential corruption in public offices.

Conclusion: The Road Ahead

The case of Indradev Yadav is a litmus test for the Prayagraj Municipal Corporation. Will they protect an alleged “staff member” who uses intimidation, or will they uphold the Rule of Law by disclosing the caller’s identity and addressing the recruitment inquiry with transparency?

As the grievance has now been forwarded to Shri Arvind Mohan (Joint Secretary) at the Chief Minister’s Secretariat, all eyes are on the state government to see if they will stand by the citizen’s right to inquire or allow the “culture of threats” to persist.

Whether there is need of permission of them to make enquiry under article 51A of the constitution of India. Why are there running away from providing information concerning the recruitment made by the public authority municipal corporation district Prayagraj?

  2. Shri Krishna Tripathi avatar

It seems that there is something wrong in the recruitment process initiated by the public authority municipal corporation Prayagraj which is the root cause they are searching easy tricks to manage the affair. Everyone knows that recruitment is the lucrative source of income through back door if the public authority has power for selecting candidates for different post.

Such techniques to suppress the voice of the people can never be justified in this largest democracy in the world. It is a fundamental duty of every citizen off dis country to make enquiry regarding the working of the public offices in the Government of India and not to perform this duty implies the reluctant approach of an individual to perform obligated duties to the nation.

Whether in this way they are not running away from accountability. There is something wrong in recruiting the staff by the public authority itself. It seems that no advertisement was made in selecting the candidates which is against the last and to deprive the entitled candidates through proper selection method.

There is something wrong in the recruitment process which was initiated by the public authority municipal corporation after getting the permission from the Government of Uttar Pradesh to select the candidates at its own level. Those poor sanitation staff whose legs were washed the our prime minister is not getting any promotion or assistance from the government but those having money in the pockets are managing everything.

  6. Vidya Devi avatar

If there is transparency and accountability in the working of the public authority and working is performed onestally by its staff then they should not run away from the enquiry made by the citizens of this country. Because of their cryptic working style which is full of corruption they are frightened with the enquiry made by the public spirited person.
