Adjudication is currently pending before the competent court of law regarding the impugned land. Moreover court trial is on. However, despite this legal pendency, the opposition party is attempting to forcibly grab the land through muscle power. Alarmingly, the local police are turning a blind eye to these unlawful activities, citing the matter as sub judice.

This raises a fundamental question: What is the meaning and purpose of a court trial if, in practice, rights are being determined not by judicial order but by brute force? In effect, the awaited decision of the court is being rendered meaningless, as the opposition seeks to supersede the authority of the judiciary through coercion and illegal possession.

Moreover, such inaction by the police not only undermines the rule of law but also emboldens lawbreakers to act with impunity. If this trend continues, it will erode public faith in the justice system and set a dangerous precedent where might prevails over right.

Therefore, it is imperative that the police uphold their constitutional duty to maintain status quo and prevent unlawful encroachments until the court delivers its verdict. Only then can the sanctity of judicial proceedings be preserved and justice be meaningfully served.

Respected Sir,

I, Kamlesh Singh, resident of Village Kothra Kantit, Balua, Post Shree Nivas Dham, District Mirzapur, hereby submit this first appeal under Section 19(1) of the Right to Information Act, 2005, against the disposal of my RTI application dated 14/07/2025.

Although the PIO has claimed to have dispatched the remaining information to my postal address due to upload limitations, the reply provided online is vague, misleading, and fails to address the specific queries raised. Therefore, I seek your intervention to ensure transparency and accountability in the matter.

Grounds for Appeal:

  1. Regarding Query 1:
    The Station House Officer, Jigna, had earlier assured that wire fencing would not be permitted on the disputed land. However, the opposite party proceeded with fencing.
    Transition: In light of this contradiction,
    the SHO must clarify the reasons for allowing wire fencing despite prior assurances. The PIO’s response does not address this critical lapse in enforcement.
  2. Regarding Query 2:
    Stamp cases D202316530000370 and D2023165000370 were registered against the offenders for evading heavy stamp duty during land registry.
    Transition: Despite this,
    Jigna police facilitated illegal possession of the land, resulting in substantial loss to the public exchequer.
    Therefore,
    the status of recovery must be disclosed, as the police’s complicity in enabling possession raises serious concerns.
  3. Regarding Query 3:
    The police had assured that status quo would be maintained, yet no FIR was registered against the offenders for land grabbing.
    Consequently,
    the reason for non-registration of FIR must be provided, especially when the assurance was documented in official communication.

Objections to PIO’s Reply:

  • The summary report provided is arbitrary and lacks substantive information.
  • It has been routinely used by Jigna police to mislead senior officers and aggrieved parties.
  • The report fails to address any of the specific points raised in the RTI application.
  • The Assistant Public Information Officer (APIO), Lalganj, has misled the appellant by forwarding this vague report.
  • In conclusion,
    the reply amounts to a willful denial of information and violates the spirit of the RTI Act.

Prayer:

  1. Kindly direct the PIO to furnish complete and point-wise information as sought in the original RTI application.
  2. Please initiate disciplinary proceedings against the APIO, Lalganj, for providing misleading and arbitrary information, which undermines the transparency obligations of the police department.

  1. Think about the gravity of situation muscle power overtook the justice and the adjudication is pending before the court and trial is running but muscle power decided the possession of the offenders.

  2. In that largest democracy in the world muscle power always wins which shows that there is no rule of law in this country. Think about the misleading information provided by the circle officer Lalganj in the matter. It seems that they have never entertained RTI applications.

  3. Now the Government of India must stop the court and not to recruit the police personnel because muscle power will decide the disputes between the parties. It is obvious that rule of law has been kept aside and everything is decided by arbitrariness and the corruption in the government.

  4. Whether we are living in a country where rule of law has been replaced by rule of anarchy? Here this question arises that why is jigna police covering the guilt of the offenders? Police should not conceal the crime of the offenders because such activities will only promote the criminal activities in the society and situation will be created in which police will not be able to control the situation.
