Grievance Description

Short submissions of the applicant are as follows.

1- A Memorandum of Understanding/Agreement has been made and entered into at NAIGAON, on 28th February 2022 BEWTEEN MR, RUPESH BIJAY SHANKAR DUBEY, Adult/s, Indian. Inhabitant/s, having address at SHIV KRUPA APT NEAR SHANTI GOVIND SCHOOL, CHANDRAPADA NAIGAON EAST Tal and Dist PALGHAR-401207, hereinafter referred to as the Party of the First Part(Which expression shall mean and include is heirs, partners, executors, administrators, assigns, etc.) AND MRS.AARTI PRAKASH KADAM, Adult, Indian Inhabitant, having address at KHAR, DANDA PADA,234 CHAWKUTE, CHAWL 20TH ROAD NEAR SIDDHIVINAYAK MANDIR KHAR WEST MUME 400052. (Which expression shall mean and include is heirs, partners, executors, administrators, assigns, etc.) hereinafter referred to as the Party of the Second Part.

2- The applicant paid Rs.510000 to the first party of the agreement. The mode of payment was Rs.10000 as cash and rest of amount through three cheques of the State Bank of India two of them was of Rs.2 Lakhs each and rest one was 1 lakh rupees amount.

3-Meanwhile both the parties reached on mutual understanding to cancel the contract made between the parties.

4- it is quite obvious from the attached document to the Grievance, two cheques were issued by the first party, one on the 25th April 2022 and second on 30th April 2022 but both the cheques were bounced when applicant made effort to redeem the cheques.

5- Two blanks cheques were provided by the first party to the applicant but those blank cheques which have to be redeemed in the year 2023 could not reap any benefits for the applicant.

6-Section 138. Dishonour of cheque for insufficiency, etc., of funds in the account.1Where any cheque drawn by a person on an account maintained by him with a banker for payment of any amount of money to another person from out of that account for the discharge, in whole or in part, of any debt or other liability, is returned by the bank unpaid, either because of the amount of money standing to the credit of that account is insufficient to honour the cheque or that it exceeds the amount arranged to be paid from that account by an agreement made with that bank, such person shall be deemed to have committed an offence and shall, without prejudice to any other provision of this Act, be punished with imprisonment for 2a term which may be extended to two years, or with fine which may extend to twice the amount of the cheque, or with both:

7- The applicant submitted the representation before the senior inspector having jurisdiction to the matter concerned and concerned commissioner of police and those representations are attached to the grievance as pages of attached PDF document. The applicant wants to know the action taken by the concerned police and those representations of the applicant.

This is a humble request of the applicant to take action against the real state Mafia cheating the innocent and gullible people under appropriate sections of Indian penal code. Please be instrumental in the repayment of the deposited money of the applicant.

  1. Whether justice is not available to the vulnerable section of the society in this largest democracy in the world. Think about the gravity of situation our entire earnings have been cheated by real state Mafia and government functionaries are mute spectators.
