Prayer- Public information officer did not entertain RTI application within time 30 days as prescribed under subsection 1 of section 7 of the right to information act 2005 and still they have not provided any information. First appellate authority is dealing the same treatment with the appeal submitted by the appellant.

Short submissions of the appellant are as follows.

1-From the following status of the RTI application it is quite obvious that RTI application was submitted by the appellant on 7th April 2024 which was forwarded to the concerned public information officer on 6th May 2024 which is a mockery of the provisions of right to information act 2005 and action must be taken against the nodal officer of the department.

3-I think that the nodal officer of the department is an incompetent and careless person who is taking the submitted online RTI applications negligently. This must be considered by the concerned responsible officers of the department. Most respected Sir when the registered email and CUG mobile numbers of the public information officer and the first appellate authority are not given on the RTI portal, then negligence can be guessed from these facts.

4-According to subsection 3 of section 6 of the right to information act 2005, RTI application is transferred to the other public authority within one week from the date of receipt of the RTI application but here more than one month was taken by the nodal officer to transfer the RTI application to the concerned public information officer.

Moreover, the entire process was online and nodal officer had to transfer the RTI application to the concerned public information officer at the earliest and this dereliction to the duty is only reflecting the mismanagement in the working of the nodal officer.

5- Most respected Sir, nodal officer must provide the reason for not providing the email and official mobile number on the RTI portal of the public information officer as well as first affiliate authority and the name also which is essential as well as mandatory in accordance with the guidelines passed by the Apex Court of India also in compliance with the guidelines of the Department of administrative reform.

6-Here it is quite obvious that the name, email and mobile number of the public information officer has not been provided in the status of the RTI application which is a mockery of the guidelines issued by the Department of administrative reform government of Uttar Pradesh.

7-Right to information act 2005 was introduced by the government of India during the regime of Congress to promote transparency and accountability in the working of the public authorities so that growing corruption in the working of public authorities might be controlled but it seems that growing corruption in the working of public authorities has overshadowed the provisions of right to information act which is matter of concern.

Everyone knows that corruption always benefits a small outfit so transparency and accountability must be promoted in the government machinery but it seems that the right to information act 2005 has been put into the dustbin by the responsible officers in the state through conspiracy and cryptic working style.

8- The appellant sought following information from the public information officer.

1- Please provide the name of the medical practitioner appointed for the purpose by the state government or person authorised in this behalf by the state government.

2- Please provide the designation and office details of the medical practitioner so that the applicant can make contact to the staff of the government in order to avail a medical certificate in order to facilitate a new driving licence to the applicant.

3- The medical certificate provided by the medical practitioner will be uploaded by the applicant as the second upload on the Sarthi Portal of the government of India to get the renewal of the driving licence.

Please provide the name of the public authority in which the medical practitioner works.

This is a humble request of your applicant to you Hon'ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness, and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your appellant shall ever pray for you, Hon’ble Sir.
