It is quite obvious that more than one month 20 days passed since the date, public information officer Rajesh Shukla received the R.T.I. Application submitted by the appellant online. Under subsection 1 of section 7 of the Right to Information Act 2005, public information officer Rajesh Shukla had to provide sought information within stipulated 30 days. This implies that public information officer Rajesh Shukla violated the subsection 1 of section 7 of the Right to Information Act 2005. It is an obligatory duty of the first appellate authority to punish the public information officer Rajesh Shukla for taking under teeth the provisions of the Right to Information Act 2005.According to subsection 1 of section 7 of the Right to Information Act 2005.Subject to the proviso to sub-section (2) of section 5 or the proviso to sub-section (3) of section 6, the Central Public Information Officer or State Public Information Officer, as the case may be, on receipt of a request under section 6 shall, as expeditiously as possible, and in any case within thirty days of the receipt of the request, either provide the information on payment of such fee as may be prescribed or reject the request for any of the reasons specified in sections 8 and 9: Provided that where the information sought for concerns the life or liberty of a person, the same shall be provided within forty-eight hours of the receipt of the request. Which means 30 days is the deadline that must not be crossed by the public information officer Rajesh Shukla but he crossed it. THE RIGHT TO INFORMATION ACT, 2005 ACT No. 22 OF 2005 An Act to provide for setting out the practical regime of right to information for citizens to secure access to information under the control of public authorities, in order to promote transparency and accountability in the working of every public authority.

Here it is quite obvious that PIO violated subsection 1 of section 7 of the Right to Information Act 2005. You denied the sought information after the first appeal so I could not submit the first appeal against your corrupt denial of sought information in order to shield the corruption of the Lucknow Development Authority. You denied the information in the name of setting up a committee to look into the corrupt activities carried out by the concerned staff of the Lucknow Development Authority. You are again requested to provide the following information so that the corrupt staff of the Lucknow Development Authority may be exposed in the public domain and how L.D.A. is shielding its corrupt staff ipso facto?
1-L.D.A. may provide the details of title suit filed by multi-named lady Anuradha Singh in the record of L.D.A. Guddi Singh including the designation, name of the public staff who executed it with posting detail.
2-L.D.A. may provide the copy of the order passed by the competent court deciding the title suit of the Anuradha Singh in the compliance of the High court order in the Writ Petition Number 135 HC Year 2006.
3-L.D.A. may provide the detail of the posting of the staff executing the registry of plots to allottees with designation and name so that accountability may be fixed.
4-Detail of the committee setup to check the irregularities including name, designation and posting details of its members which may include date of joining the department.
5-PIO may provide the details of government functionaries nominated the members of the committee including posting details and stipulated time given to the committee to complete the enquiry.

ReplyDeleteIt is quite obvious that the matter concerns the deep rooted corruption and Lucknow development authority is procrastinating on the issue more than 3 years which is not only embarrassing situation but showing the corruptness of the concerned staff of the Lucknow development authority.
