An appeal under subsection 3 of section 19 of the Right to Information Act 2005 as information denied by the public information officer and first appellate authority not entertaining the first appeal submitted online before him.

Prayer-Because of the cryptic dealings of the C.R.O. Mirzapur and violation of subsection 3 of section 6 of the Right to Information Act 2005 by the concerned PIO, the appellant is still deprived of the sought information. Please sort out rampant irregularities prevailed in providing information because of incompetence of the C.R.O. Mirzapur. 
Chief Revenue Officer is the nodal officer nominated by the district magistrate Mirzapur for effective coordination of applications received under R.T.I. Act 2005. Chief Revenue Officer is also the administrative head of the all four Tahsils in the district Mirzapur. He supervises the activities of the subordinates acting in the fourTahsils of the district on behalf of District Magistrate. From the RTI Application, it is quite obvious that the matter concerns the Tahsil Sadar as this word Tahsil Sadar is mentioned at several places in the contents of the application unfortunately C.R.O. Mirzapur is so incompetent that he could not understand the matter and forwarded the matter to other Tahsil. Most surprising is that this Tahsil in the name of information only provided that the matter concerns the Tahsil Sadar and this incompetent nadal officer accepted the aforemenioned advice note as the information which is the reflection of the deep rooted corruption in his working and indirectly in the working of the District Magistrate Mirzapur. Moreover, the concerned public information officer had to forward the matter under subsection 3 of the section 6 of the Right to Information Act 2005 but he acted cryptically in a well planned manner to deny information. Consequently, the concerned public information officer violated the aforementioned section of the Right to Information Act 2005.

* Description of Information Sought A Lekhpal reports to Kanoongo. So basically he is viewed as the ears and eyes of the Collector at the village level. A Lekhpal reports the death of a person in a village to update data (like property mutation). 

PIO may provide the following information to the information seeker under subsection 1 of section 6 of the Right to Information Act 2005 within time as stipulated under subsection 1 of section 7 of the Right to Information Act 2005. 

1-First page of the attached PDF document is the death certificate of the deceased Rajendra Pratap Singh S/O Devraj Singh which categorically reveals that death took place on 03 May 2021. Please provide the date and time when the death was reported by the concerned Lekhpal to the respective staffs of the collectorate/Tahsil Sadar. 

2-Provide the name and designation of the staff of the Tahsil Sadar who was reported by the Lekhpal as aforementioned under point 1. 

3-Whether for property mutation, to submit an online form is not a necessary obligation or necessary obligation? If necessary, then provide the corresponding government orders and circulars supporting necessary obligation to submit an online form for property mutation. 

4-Provide the detail regarding the visit of any staff of the Tahsil Sadar including Lekhpal of the area in the village panchayat Nibi Gaharwar in the span of time between 03 May 2021 to uptill now with motives and agenda detail.

* Prayer or Relief Sought Sir, chief revenue officer on behalf of District Magistrate Mirzapur supervises or monitors  the activities in the four Tahsils. Tahsil Sadar includes in them. The matter concerns the Tahsil sadar quite obvious from the fact that in each point of sought information name of Tahsil sadar is included. Since the matter concerns deep-rooted corruption of the Tahsil Sadar which is the chief revenue source of the back door income so in order to conceal the sought information, you preferred to close the chapter by arbitrarily advising that the matter concerns the Tahsil sadar, so you can seek information from the Tahsil sadar. You, fellow, did it deliberately otherwise you are the public information officer of the collectorate, so duty bound to provide the sought information concerns the Tahsil sadar as Tahsil sadar in the ambit of PIO collectorate who is designated as the chief revenue officer. District Magistrate Mirzapur is also the nodal officer of the district and on behalf of him chief revenue officer is executing this act. If the matter concerns the other public authority then in order to provide information, PIO transfers the RTI communique to the other public authority under subsection 3 of section 6 of the Right to Information Act 2005 but here whatever has been done by the concerned is the sheer mockery of the Right to Information Act 2005. It seems that district magistrate Mirzapur has set up in mind to throw the Right to Information Act 2005 into the dustbin, ipso facto from his cryptic working style. RTI communique and its documents also attached to this appeal. Please initiate disciplinary proceedings against wrongdoer public information officer making mockery of the provisions of the Right to Information Act 2005.

Undoubtedly it is quite obvious that government of Uttar Pradesh has thrown the right to information act 2005 into a dustbin quite obvious from their cryptic working style as they are not providing any information to the information seekers and only communicate with information seekers that they cannot provide information on the flimsy ground like in the raised matter.
