Incident Details

Submissions before Human Rights Commission State of Tamil Nadu for seeking expenses subsection 2 of section 160 of the Cr.P.C.

Distance between Mirzapur district to  DISTRICT-TIRUNELVELI is 42 hr (2,386.2 km) via Srinagar - Kanyakumari Hwy and NH 44
Therefore  Superintendent of Police DISTRICT-TIRUNELVELI, State of Tamil Nadu  should call your applicant for witness testimony after paying expenses of boarding and lodging with traveling from Mirzapur district to  DISTRICT-TIRUNELVELI up to destination.
According to subsection 2 of section 160 of the Cr.P.C. The State Government may, by rules made in this behalf, provide for the payment by the police officer of the reasonable expenses of every person, attending under sub- section (1) at any place other than his residence.
The applicant knows only two languages 1-English 2-Hindi so please direct  Superintendent of Police DISTRICT-TIRUNELVELI, State of Tamil Nadu  to communicate in the aforementioned two languages so that I may understand their motives.
Most respectfully sheweth that
1-applicant received communication details as follows
Booked At Nanguneri SO, Booked On  02/11/2021 11:00:07, Destination Pincode  482001 Tariff  25.00, Article Type Registered Letter
Delivery Location  Jabalpur H.O. as it was addressed properly which is the address of the applicant.
2-From the post tracking and a few letters written in English, I guess that it is a notice sent under subsection 1 of section 160 of Cr.P.C. which description is given below.
3-applicant has no source of income and is facing financial crunch so subsection 2 of section 160 must also be taken into account by the concerned investigation officer.
4-applicant is a human rights defender so such communications are quite common so detail must be either of the languages as aforementioned 1-English 2-Hindi with the detail of the matter concerned so that applicant may know the factual position.
5-This communication cum grievance must be ensured to reach all concerned so that there may be no impediment in the proceedings of the matter investigated by the police officer.
6-It is submitted before the Hon’ble Sir that  51A. Fundamental duties It shall be the duty of every citizen of India (a) to abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem;(h) to develop the scientific temper, humanism and the spirit of inquiry and reform;

(i) to safeguard public property and to abjure violence;

(j) to strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of endeavour and achievement.
Here the applicant made enquiry but concerned are threatening me which signals anarchy and lawlessness ipso facto.
Still the applicant could not know the factual position of the matter unless more light is put on it in either of the aforementioned two languages.
This is a humble request of your applicant to you Hon’ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your applicant shall ever pray for you, Hon’ble Sir.
