Subject/Prayer-Aforementioned PIO/Respondent took under teeth the provisions of Right to Information Act 2005 caused your appellant to file this appeal in order to safeguard its rights as being breached by the said PIO by withholding sought information.
With due respect your applicant wants to draw the kind attention of the Hon’ble Sir to the following submissions as follows.
1-It is submitted before the Hon’ble Sir that please take a glance of sent representation to various accountable public functionaries as well as registered post to respondent through registered post which was received by his office on
18/01/2016 as obvious from annexures.
Matter is concerned with the atrocity on woman whose husband is employed in the other state.
2-It is submitted before the Hon’ble Sir that please take the perusal of subsection 1 of section 7 of Right to Information Act 2005.
Subject to the proviso to sub-section (2) of section 5 or the proviso to sub-section (3) of section 6, the Central Public Information Officer or State Public Information Officer, as the case may be, on receipt of a request under section 6 shall, as expeditiously as possible, and in any case within thirty days of the receipt of the request, either provide the information on payment of such fee as may be prescribed or reject the request for any of the reasons specified in sections 8 and 9:
Hon’ble Sir whether this provision was not violated by the aforementioned public information officer as sought information was not made available still .
3-It is submitted before the Hon’ble Sir that Hon’ble Sir may be pleased to take a glance of subsection 1 of section 19 of Right to Information Act 2005 as
Any person who, does not receive a decision within the time specified in sub-section (1) or clause (a) of sub-section (3) of section 7, or is aggrieved by a decision of the Central Public Information Officer or State Public Information Officer, as the case may be, may within thirty days from the expiry of such period or from the receipt of such a decision prefer an appeal to such officer who is senior in rank to the Central Public Information Officer or State Public Information Officer as the case may be, in each public authority:
This is humble request of your applicant to you Hon’ble Sir that It can never be justified to overlook the rights of citizenry by delivering services in arbitrary manner by floating all set up norms. This is sheer mismanagement which is encouraging wrongdoers to reap benefit of loopholes in system and depriving poor citizens from right to justice. Therefore it is need of hour to take concrete steps in order to curb grown anarchy in the system. For this your applicant shall ever pray you Hon’ble Sir.
