Why is UPSIC overlooking RTI communique seeking information concerned with missing files?


Please direct concerned authority to entertain my this appeal under prescribed provisions of Transparency Act. My RTI communique dated 27.10.2014 addressed to Chief Information Commissioner ,Government of Uttar Pradesh, didn’t reach to Uttar Pradesh Info

My RTI communique dated 27.10.2014 addressed to Chief Information Commissioner ,Government of Uttar Pradesh, didn’t reach to Uttar Pradesh Information Commission , Lucknow while dispatched through speed registered post as told by staff of UPSIC on 27.11.2014 when your applicant enquired them.
 An appeal under subsection 1 of section 19 of Right to Information Act 2005.

Subject-Please direct First appellate authority of UPSIC to consider my first appeal in accordance with the provisions of Right to Information  Act 2005.
1-It is submitted before the Hon’ble Sir that your applicant on 27.10.2014 submitted an application before CIC,UPSIC under subsection 1 of section 6 of Right to Information Act 2005 through speed registered post seeking information under points 2(a),2(b),2(c) and 2(d) containing two postal orders of Rs.10 as annexures in order to pay requisite fee as prescribed under Right to Information Act 2005. The scan copy of aforesaid RTI communique is attached with this e-mail representation.
2-It is submitted before the Hon’ble Sir that Hon’ble Sir may be pleased to take a glance of following representation  sent on 24-Sep-2014 but still awaiting redressal.
Please made available the copy of order passed by Hon’ble information commissioner Mr. Gyan Chandra Maurya in complaint S-11-1903/C/2010/Mirzapur.

With due respect your applicant wants to draw the kind attention of the Hon’ble Sir to the following submissions as follows.
1-It is submitted before the Hon’ble Sir that when your applicant appeared in the information commission 8-July-2014 in order to attend the hearing in the aforesaid case but case was not listed when your applicant enquired with the concerned staff ,I was informed that in the case order has been reserved so case was not listed.

Hon’ble Sir-Whether UPSIC will ever trace the file of complaint missing since years and during the hearings each time subordinate staff is directed by Hon’ble commissioer Mr.Gyan Chandra Maurya to trace the file. Please trace the missing files of complaint S-11-169/C/2009/Mirzapur Yogi M. P. Singh versus CRO Mirzapur .Next date of hearing is 8-July-2014 .
Most surprising is that my complaint S-11-1903/C/2010/ Mirzapur ,Yogi M. P. Singh versus additional district Judge, High court Allahabad is not updated on the website of UPSIC as during the hearing on 9-Oct-2013, your applicant was told that next date of hearing is 8-July-2014 . My apprehension is this file may be also missing as judicial members are more Influential in comparison to bureaucrats. When bureaucrats can set to get complaint files missing, then why not judicial members?

प्रार्थी श्री मान मुख्य सूचना आयुक्त का ध्यान निम्न विन्दुओं पर आकृष्ट करता हैं |
श्री मान जी ८ जुलाई की सुनवाई के दौरान जब प्रार्थी द्वारा गायब शिकायत संख्याcomplaint S-11-169/C/2009/Mirzapur के बारे में जान कारी चाही तो माननीय सूचना आयुक्त को मेरे मिसिंग फाइल कहने पर बहुत ज्यादा आपत्ति थी उनके अनुसार हमें मिस– प्लेस्ड फाइल कहना चहिये किन्तु यदि वह फाइल मिसप्लेसड थी और  जिसको खुजवा लेने की बात कही वह २७नवम्बर २०१४ को क्यों नहीं लिस्ट की गयी | इसका मतलब कई सालों पहले अपने स्थान से हटी फाइल अभी भी अपने स्थान पर नहीं आई |
प्रार्थी कुछ सूचना मुख्य सूचना आयुक्त  कार्यालय से चाही   किन्तु अभी तक वह सूचना अप्राप्त हैं और Please direct Nakal section to made available the copy of the order passed by aforesaid information commissioner in the complaint instituted by Yogi M. Please made available the copy of order passed by Hon’ble information commissioner Mr. Gyan Chandra Maurya in complaint S-11-1903/C/2010/Mirzapur.और अब केस भी नहीं लिस्ट हो रही हैं चार सालों से जिस केस की वजह से लखनऊ आता रहा क्या मुझे यह भी जानने का हक़ नहीं की उसमे आयोग द्वारा क्या कार्यवाही की गयी |श्री मान जी S-11-1903/C/2010/Mirzapur, complaint no. S-11-169/C/2009 ये शिकायते २७नवम्बर को भी लिस्ट नहीं की गयी हैं |

4-It is submitted before the Hon’ble Sir that my RTI Communique dated 27.10.2014 was sent through speed registered post and it was not received back so it will be considered as received by the staff of addressee. Here oral denial of non receipt by the staff of addressee is meaningless .
  5-It is submitted before the Hon’ble Sir that matter is concerned with the missing file of UPSIC and other matter is concerned with the judiciary so in order to avoid to provide sought information such bad game is being played with my RTI Communique.
                   This is humble request of your applicant to you Hon’ble Sir that please direct public information officer of UPSIC to provide your applicant point-wise information as sought. For this your applicant shall ever pray you Hon’ble Sir.

  1. फाइल तो यहाँ गायब होती रहती हैं बस लोग भय बस कहते नहीं जब यहाँ कोर्ट की फाइल गायब हो सकती हैं तो सूचना आयोग से गायब हो गयी तो कौन आश्चर्य जनक बात हैं वैसे तो भारतीय क़ानून ब्यवस्था में इसके लिए दंड का विधान हैं लेकिन ब्यवहारिक जीवन में केवल उन्ही को दण्डित किया जाता हैं जिसके ऊपर आकाओं का वरद हस्त नहीं होता हैं |
