First Appeal for Information Sought under RTI Act 2005.  Dt.06-09-19

O/o. The Director

Sir/Madam,
Sub: First Appeal for the refusal of information in four RTI letters dated 24-07-19, 25-07-19 and 25-07-19, and 09-08-19 under RTI act 2005 posted to PIO fearing that all will be caught in the mining scam.
Information were refused by the PIO on Four RTI letters posted to PIO on 24-07-19, 25-07-19 and 25-07-19, and 09-08-19 under RTI act 2005 fearing that all including DGM will be caught in the mining scam.
There was no reply for first three RTI letters within one month of time.  All these information of data are readily available in DGM office database and they have to give all the information as asked in four RTI applications in the interest of larger public. It is suspected that thousands of crores of rupees are involved in the looting of mining scam by Geology and mining staffs including DGM. It is not a personal grievance. Hence Section 2(f) and other sections are not applicable since it is in the larger interest of the public. DGM can ask their legal advisor also if he does not know RTI act.  Disciplinary action should be taken as per RTI ACT on PIO for his refusal to give information. We are only asking for facts and want their credentials. If they refuse they are all punishable under IPC 166 and 166A –Public servants disobeying law and act to cause injury to public and Prevention of corruption act. Since it is in the larger public interest, their flimsy and third rate excuses are overridden. PIO should be fined Rs.25000 for each of the RTI queries( Total one lakh of Indian rupees) as per RTI act for refusing to give information.
If  we do not get the information for our first appeal, we shall be filing a second appeal to SIC.
Yours Sincerely,

                                Sudalai Kumar

  1. Undoubtedly corruption is rampant in the government machinery so for better governance, elimination of corruption is must and if some one is wrongdoer, the he must be subjected to the penal proceedings of the Land.

  2. Whether it is not reflection of rampant corruption in the government machinery that whistle blower is sounding the alert but more surprising is that instead of taking action against perpetrators of corruption whistle blower was targeted by the corrupts and pseudo honest political masters are mute spectators of it.

  3. There is no doubt that this whistleblower who was fighting against corruption in the government machinery was subjected to the persecution by the corrupt officials of government of Tamilnadu and entire country is the mute spectators of it and they are not supporting this whistleblower when on public platform our political Masters Express gratitude to the the whistleblowers but their actual faces are totally different whether it is justified, why our political Masters are not protecting the rights are whistleblower, why, they suspended this whistleblower, why they are not taking appropriate action against the corrupt public staffs belonging to the Government of Tamilnadu, whether this act of the Government of India is not against the federal structure of the central government and state machinery thanks.
