The public information officers are just mentioning the section 2f for the refusal of information under RTI act 2005 for the RTI application posted in the month of July and August 2019. The reply from appellate authority also mentioning the same section for refusal of information under RTI Act 2005 for the fist appeal in September 2019. Those replies are not fair enough from PIO and FAA and therefore the first appeal forwarded to them again with appeal dated 19-09-19. But so far no reply from them. Then we will make an second appeal to state information commissioner Tamilnadu for the same information.

From

To
The
Appellate Authority
O/o.
Director
Department
of Geology and Mining
 Chennai – 600 032
Sir/Madam,
Sub:
First Appeal for the refusal of information in six RTI letters dated 23-07-19,
25-07-19, 26-07-19 and 30-07-19, and 09-08-19 under RTI act 2005 posted to PIO
forwarded by P and AR and Public department.
Information
were refused by the PIO on six RTI letters dated 23-07-19, 25-07-19, 26-07-19
and 30-07-19, and 09-08-19 under RTI act 2005 posted to PIO forwarded by P and
AR and Public department fearing that he and his coterie will be caught red handed..
They refused this information to safeguard themselves and the Chief secretary,
Principal secretary in industries department and Director of mining from mining
scam and corruption. This is a scam to the tune of lakh of crores involving
Chief Secretary, Principal Secretary in industries department and director of
mining. They suspended me without telling proper reasons and conducting any
enquiry for suspension even after a period of two months. NHRC order was also
not obeyed by the authority and they have not initiated to reinstate me in the
government service. They are fooling all by quoting irrelevant rules and act.
If they refuse, they are all punishable under IPC 166 and 166A –Public servants
disobeying law and act to cause injury to public and Prevention of corruption
act. Since it is in the larger public interest, their flimsy and third-rate
excuses and 2 f section of RTI act are overridden. Why they are afraid to reply
to the RTI letters? If you do not know the rules, ask some educated people.
The order PIO have quoted from CIC is not
applicable to us. You have murdered all the rules of democracy and government
acts and rules. If we do not get reply to the First appeal within stipulated
time, we would be making a second appeal to SIC. We are also ready to meet them
in Court also.
Yours sincerely,

Cryptic denial of sought information on flimsy ground is undoubtedly a matter of the great concern.

The reply from appellate authority also mentioning the same section for refusal of information under RTI Act 2005

Because of the windictiveness of the the Modi government Against The Right to Information act 2005 it has weakened consequently no Public Information Officer Central Public Information officers are providing the information to the information seekers Under The Right to Information act 2005 as they know that no action will be taken against them by the the state information commission or Central information commission. Think about the gravity of situation that because of rampant corruption in the government machinery this August act has been without teeth and nail. On one side of a screen Modi government advocates honesty in the government machinery only to show the people and the behind the screen itself weakening The Right to Information act 2005 is showing its double standard in regard to curb the corruption from the government machinery.
