Charges against an Indian diplomat whose arrest strained US-India
relations have been dropped by a US judge.
Judge Shira
Scheindlin ruled Devyani Khobragade had diplomatic immunity at the time of her
indictment on visa fraud and underpaying her housekeeper.
Ms
Khobragade, who has since left the US, said through a lawyer she felt the rule
of law had prevailed.
India
demanded an apology after she was arrested and strip-searched.
Delhi said
it was “shocked and appalled” at the manner of her arrest, and
ordered a series of diplomatic reprisals against the US, including the
withdrawal of a US diplomat from India.
US Attorney
Preet Bharara said Ms Khobragade was afforded courtesies most Americans would
not receive during an arrest and said the search, done by a female agent, was a
standard practice.
Ms Khobragade was detained in
December on suspicion of visa fraud and making false statements, after being
accused of paying her Indian maid below the US minimum wage.
She returned to India in January
after she was indicted on criminal charges and India refused to waive her
immunity.
Tuesday’s ruling does
leave open the possibility that prosecutors could bring a new indictment.

Here this  question arises that whether United State came under pressure of reprisal measures commenced by the Government of under the pressure of bureaucratic lobby even when does not have support of people of state.Here this question arises that whether prosecutors will bring up new indictment.
As earlier stated by prosecution counsel as- Finally, this Offices sole motivation in this case, as in all cases, is to uphold the
rule of law, protect victims, and hold accountable anyone who breaks the law
no matter what their societal status and
no matter how powerful, rich or connected they are.

  1. Tuesday's ruling does leave open the possibility that prosecutors could bring a new indictment.
    Here this question arises that whether United State came under pressure of reprisal measures commenced by the Government of under the pressure of bureaucratic lobby even when does not have support of people of state.Here this question arises that whether prosecutors will bring up new indictment.
    As earlier stated by prosecution counsel as- Finally, this Office’s sole motivation in this case, as in all cases, is to uphold the rule of law, protect victims, and hold accountable anyone who breaks the law – no matter what their societal status and no matter how powerful, rich or connected they are.

  2. Whether any relation can be stable which foundation is based on corruption . Undoubtedly under the pressure of bureaucratic lobby whatever steps were taken by Government of India can never be justified. Special privileges are granted to diplomats to shield them from unjustified acts of other governments but not to perpetrate crime under the blanket of such privileges. If no action was taken against wrongdoer diplomat ,then it will set up bad precedent in the society and will open the gate for other diplomat to indulge in wrongdoings.
