Hon’ble Sir -With great respect and honour to Hon’ble Sir your applicant wants that all the competent authorities may forward his representation to Chief Information Commissioner, Government of Uttar Pradesh in order to avoid unnecessary loss public fund in public interest. This communication contains all the documents as attachment which were made available by concerned staff of Government of Uttar Pradesh to your applicant. Hon’ble Sir PIO, DGP office Lucknow must reply the communications under R.T.I. Act 2005 with due care and attention. He must also be included as respondent like 1,2,3 and 4 in the processing of this Appeal before UPSIC.

Prayer-No information was made available by concerned and denial of sought information on flimsy ground by the PIO was justified by First Appellate Authority through cryptic words.
            Short submissions .
1-It is submitted before the Hon’ble Sir that –
                                 Sought Information.
1-Please made available the copy of counter affidavit submitted by the government of uttar pradesh to High court.
2-What action was taken by Government of Uttar Pradesh on the submissions of your applicant ? Please made available the noting on the representation of your applicant as aforesaid.
3-How much loss incurred to public exchequer because of this long lasting strike called by few employee unions in order to pressurize the government.
4-Whether action was taken against few leaders who indulged in criminal activity during the strike.
5-Whether the principle of no work no pay was applied on strikers as the strikes are declared illegal by apex court of India.
6-Who afforded the huge loss incurred on public exchequer  due to this long lasted strike call by strikers under which provision  of law of land.
2-It is submitted before the Hon’ble Sir that
Public Information Officer is denying sought information on the ground that matter is concerned with the pending litigation. Here this question arises that under which provision of Right to information Act 2005 ,applicant was denied sought information? He can deny the sought information under section 8&9 of Transparency Act but section aforesaid have no such provision that if sought information concerned with pending litigation, then such information exempted from disclosure.
3-It is submitted before the Hon’ble Sir that here role of first appellate authority is too much misleading and concealing the facts “as denial of information was considered by him as made available information by public information officer” through its letter dated 23-May-2014 as attachment to this e-mail.
This is humble request of your applicant to you Hon’ble Sir that aforesaid sought information be made available to your applicant. Those accountable for creating hurdle in furnishing sought information must penalized in accordance with the law. For this your applicant shall ever pray you Hon’ble Sir.

Subject-Not even a single point information was made available by the staff of Government of Uttar Pradesh ,they only procrastinated on the representations submitted by your applicant showing lawlessness and anarchy in the system.
With due respect your applicant wants to draw the kind attention of the Hon’ble Sir to the following submissions as follows.
1-It is submitted before the Hon’ble Sir that information is sought from those public authorities under whose custody sought information is protected. Here no doubt part of information is under custody of D.G.P. Office of Government of Uttar Pradesh but rest of information is under custody of chief secretary office or its subordinates.
Whether the office of Superintendent of Police Mirzapur is the file custodian of following sought information if not why R.T.I. Communique dated 24.03.2014 was transferred under subsection 3 of section 6 of Right to Information Act 2005 to PIO office of Superintendent of police Mirzapur.
 Sought Information.

2-It is submitted before the Hon’ble Sir that it was most surprising for me when the matter was transferred to public information officer in office of superintendent of police in Mirzapur district as obvious from the reply of additional S.P. that office is zero custodian of sought information. 
This is humble request of your applicant to you Hon’ble Sir that please direct concerned accountable functionaries who are seated in state head quarter made available the sought information. Matter is concerned with the D.G.P. office and chief minister office. Information has been in public interest so such procrastination and dilly dallying approach must be avoided. Please direct concerned to made available sought information. For this your applicant shall ever pray you Hon’ble Sir.

Hon’ble Sir whether it is appropriate to forward my R.T.I. Communique to those who have zero information as already it has been established fact.
This is humble request of your applicant to you Hon’ble Sir that It can never be justified to overlook  the rights of citizenry by delivering services in arbitrary manner by floating all set up norms. When the aggrieved are ready to accept all tyranny ,then why such circumstances are being created which couldn’t be tolerated by complainants. Whether it is justified that concerned department wants to loot the public fund meant to poor and downtrodden. It seems that honesty has no value. Please take actions in accordance with the law . It is submitted before the Hon'ble Sir that here role of first appellate authority is too much misleading and concealing the facts "as denial of information was considered by him as made available information by public information officer" through its letter dated 23-May-2014 as attachment to this e-mail.

  2. Whether a country can develop if its government may full of corrupt staffs. Few staffs took on ransom entire state machinery in the name of strike for21 days and now when Information is being sought only correspondences are being made in the name of providing information.
