The matter is concerned with the school of mute and dumb situated at village Lakshirampur closed to city Azam Garh in district Azamgarh Uttar Pradesh .

1-It is submitted before the Hon’ble Sir that

विद्यालय में फूड प्वायजनिंग से बच्चों की हालत गंभीर होने की सूचना मिलते ही जिला प्रशासन में हड़कंप मच गया था। मुख्य चिकित्साधिकारी डा. बीबी सिंह, बेसिक शिक्षा अधिकारी राकेश, खाद्य निरीक्षक अभय कुमार आदि मौके पर पहुंच गए। सीएमओ ने बताया कि जांच में पाया गया कि रात को जो भोजन बना था, वह अधपका था, उसे खाने से बच्चों को अपच हो गई। भोजन का नमूना लिया गया है। जांच रिपोर्ट आने के बाद दोषी के विरुद्ध कार्रवाई की जाएगी।
2-It is submitted before the Hon’ble Sir that according to warden Usha -in the night of Tuesday ,Children were served pulses ,rice and chapatis . In the morning of Wednesday few children made complaint of stomach-ache .Thereafter one by one ,19 children became tired and got exhausted because of pain and omitting . When the situation got out of control ,then all the diseased children were admitted to district hospital Azam Garh where after primary remedy/treatment 12 children were returned back but 7 students were still undergoing treatment. Dr. P.K. Jha made the apprehension of food poisoning. Attempts are being made for proper treatment of serious students.
3-It is submitted before the Hon’ble Sir that as reported in the Amar Ujala daily on 13-March-2014 -This information that because of food poisoning ,19 students fell ill spread like jungle fire in the district administration. The officers who reached on the site for damage control were chief medical officer ,B.S.A. Azam Garh ,food inspector . Latter food poisoning was replaced by semi-cooked food by chief medical officer and also assured that traces of food were sent to lab if some one found guilty, action will be taken.
4-It is submitted before the Hon’ble Sir that whether action will be taken by police or C.M.O. Here this question arises that why F.I.R. was not lodged still in the concerned matter? Whether police don’t think proper to entertain such cases if murder ,rape and robbery like offences are not informed to police. Whether this is not a police case as semi-cooked meal can’t cause such mass havoc on children. Here food material may be of third grade which is being concealed by accountable functionaries. Whether our public functionaries are serving the balanced diet or mal-nutrition must be decided by competent authority.
HighCourt today sought Uttar Pradeshgovernment’s reply on a PIL which alleges that Vasudev Yadav, who holds dual charge as the director of the basic as well as secondary education departments in the state, set up institutions in the names of his wife and children.
A Division Bench comprising Justices Sunil Ambwani andDinesh Gupta, while fixing February 25 as the next date of hearing in the case, said, “It appears that the entire education department has been monopolised by a single person.”
Article 7 of U.D.H.R. states that all are equal before the law and are entitled without any discrimination equal protection of law .All are entitled to equal protection against any discrimination in the violation of this declaration and against any incitement to such discrimination. Whether for protection of children any steps were taken and concerned bureaucrats only trying to save its skin. Article 8 of U.D.H.R. states that every one has right to an effective remedy by the competent national tribunals for the acts violating the fundamental rights granted him by the constitution or by law. Right to life is fundamental right as well as human right. These aggrieved children will get remedy when appropriate authority will inquire into fact and book those accountable for playing game with health and hygiene of vulnerable children. Here role of state government is like a cunning man who wants to show its charity in public but don’t want to spend a penni/coin on needy people . This is a exposure of mismanagement of state government as well as corruption in the system.
Most Hon’ble Sirs who want to curb the human rights violation may take effective steps so that betterment of society could be possible which is the need of hour.
