The State government is not following any order of nhrc and example one order was given by reinstatement of S. Sudalai Kumar chemist in the department of Geology and Mining after the suspension under grave fake allegation. They are also not replying to RTI queries. Like this way they run jungle rajiyam in Tamilnadu after murdering democracy and rule of law in Tamil Nadu state. Therefore I request you to take action on these orders 1545/22/13/2019 dated 22nd July 2019 attached. The same matter has been communicated to the state government through cm cell and RTI query but no response to Mr. P. Balasubramanian.

  1. 534 Payment of Subsistence [I981 : T.N. Act 43

    Allowance

    THE TAMIL NADU PAYMENT OF SUBSISTENCEALLOWANCE ACT, 1981.

    3. (1) An employee who is placed under suspension, during the period of such suspension, be entitled to receive payment from the employer as subsistence allowance. An amount equal to fifty percent of the wages which the employee was drawing immediately before suspension, far the first ninety days reckoned.

    Provided further that where the period of suspension exceeds ninety days, but does not exceed one hundred and eighty days, the employee shall be entitled to receive, after the said period of ninety days, a subsistence allowance equal to seventy-five percent of the wages which the employee was drawing immediately before his suspension : Provided further that where the period of suspension exceeds one hundred and eighty day, the employee shall be entitled to receive wages in full which the employee was drawing immediately before his suspension:

  2. Undoubtedly suspension was illegal, therefore they revoked the suspension ipso facto obvious.

  3. Such practices are quite common in the public offices where corruption is rampant but in the wider interest of public such practices must be curbed at any cost in order to win the faith of the common people in the state.
