The job of state
bank of India to deliver the ATM Card to account at home through post.
According to superintendent of the post, for delivery of the ATM card, address
of the account holder must contain the name of spouse or guardian in order to
ensure secure delivery but according to lady branch manager of city branch
Mirzapur no need of the name of the spouse or guardian as letter can be
delivered if name of individual and his address is available. Therefore state
bank of India only write the name of individual and the address concerned
without the name of spouse and department of post returns the posts to the
sender and latter these ATM Cards reach to parent branches where bargaining
takes place so need of hour is to carry out a transparent and accountable
inquiry. What is the cause of non delivery of ATM cards reaching at parent
branches. Why not branch manager is made accountable for non delivery of ATM
Card on the large scale. If the name of spouse is must for delivery of ATM
card, then why not concerned branch manager is being punished for the
dereliction of the duty. Vide attached PDF documents.

Hon’ble
Sir-My husband Shree Mahesh Pratap Singh (Yogi M. P. Singh) visited the
branch office and lady branch manager of State Bank of India was made
available Aadhar Card and PAN Card in order to verify the address of the
applicant and the address was found correct. But she denied to provide
ATM Card as it can only be delivered to account holder. My husband
requested her to arrange for delivery of ATM Card at the earliest as
there is no more need of update of address.

With due respect your applicant wants to draw the kind attention of the Hon’ble Sir to the following submissions as follows.

your complaint, we have already advised you to collect your ATM card any time
during working hours on any working day.
Since
you, Mrs. PREETI SINGH, are an individual in yourself, therefore,
for any mail delivery your name and address ought to be sufficient.
We
reiterate that kindly visit the branch with full KYC documents for your
account updation and receipt of ATM card during any day during working hours.
As of
now, bank has not put any instructions for delivery of RETURNED ATM cards by
bank officials to the customer’s home, we are under no obligation to visit
your home and deliver the ATM.
You
are welcome to visit the branch.

4-It is submitted before the Hon’ble Sir that in order to update KYC (
Know Your Customer) both the aforementioned documents are the most credible.
Here
this question arises that when the state bank of India was apprised
with the fact that for the delivery of the ATM Card, name of the spouse/
guardian is must then why had they not mentioned the name of the
husband in the address written on the envelope. Yogi ji was telling that
according to the register, per month average 50 ATM cards were not
delivered by the post office which implies that there is tacit
understanding between state bank of India and department of posts that
state bank of India will not include the name of spouse/ guardian in the
address and in the absence of name of spouse or guardian, department of
post returns back the ATM Card and again it is used to deliver parent
branch for bargaining with the customers. Initially per such card Rs.180
was charged by the staffs of the state bank of India.

Aforementioned
post ID was to be delivered branch manager city branch state bank of
India, then why the applicant was misled which caused physical and
mental tension to the applicant. If the postal ID of speed post sent to
the applicant was made available to the applicant then this speed post
was delivered at the address of the applicant even when the name of
husband was not included in the address because at time applicant
remains alert and concerned post man was inquired in regard to ATM Card.
                    

This
is humble request of your applicant to you Hon’ble Sir that It can
never be justified to overlook the rights of citizenry by delivering
services in arbitrary manner by floating all set up norms. This is sheer
mismanagement which is encouraging wrongdoers to reap benefit of
loopholes in system and depriving poor citizens from right to justice.
Therefore it is need of hour to take concrete steps in order to curb
grown anarchy in the system. For this your applicant shall ever pray you
Hon’ble Sir.

2-It
is to be submitted before the Hon’ble Sir that central public
information officer, state bank of India replied aforementioned sought
information as follows.

Here
it is crystal clear that aforementioned communication 12-April-2019
which states as-In reference of 06-April-2019, you may be apprised
as-Your ATM card has been returned back to branch office by the
department of post which may be received on any working day from the
branch office by you.
Whether it is reply of these three points sought information.

1-Please
provide the additional duration may be taken by the state bank of India to
provide rupay card to the applicant.
2-From
the first page of the attached document, the name of the Husband is Mahesh
Pratap Singh yet you did not mention it in the address caused return back of
rupay card to the sender. Please provide the reason.
3-Please
take the perusal of first and second page, concerned speed post ID was
addressed to Branch Manager, provide the cause to mislead the applicant.

3-It
is to be submitted before the Hon’ble Sir that whether CPIO is a layman
who couldn’t understand that what information was sought by the
information seeker from him? Undoubtedly matter is concerned with the
negligence of staffs of the state bank of India so public authority
state bank of India is avoiding to provide the sought information. There
is no relation between the sought information and information provided
by CPIO State Bank of India. 

4-It
is to be submitted before the Hon’ble Sir that now appellant made
appeal under subsection 1 of the section 19 of Right to Information Act
2005 as well as three communications as reminders to the aforementioned
First Appellate Authority which is attached to this appeal.Consequently
central public information officer made available following three points
misleading information to the appellant. 



5-It is to be submitted before the Hon’ble Sir that under point 1  appellant sought following information

1-Please
provide the additional duration may be taken by the state bank of India to
provide rupay card to the applicant.
CPIO replied as 1-On receipt of the request from the customer, ATM Card/ Rupay Card is immediately issued by the bank , Bank dispatches the
ATM Card/ Rupay Card through post office. how much time is taken by them.
Hon’ble Sir
ATM Card/ Rupay Card was returned back by the
department of post because name of spouse/husband /guardian was not
written in the address written on the envelope which is the fault on the
part of bank staff. Here already prolonged delay was made by the bank
concerned in order to delivery of the
ATM Card/ Rupay Card to the appellant so appellant wants
to know additional duration will be taken by the bank in the delivery
of the said card under R.T.I. Act 2005.

6-It is to be submitted before the Hon’ble Sir that under point 2  appellant sought following information

CPIO
replied as 2-Beneficiary address is printed on the system itself.
Accordingly, beneficiary name and her address was printed.

Hon’ble Sir superintendent of post repeatedly in its communications told the appellant that no 
ATM Card/ Rupay Card can be delivered if it lacks 
name of spouse/husband /guardian in the address
of card holder on the envelope which means it compulsory duty of the
bank to include the name of guardian in the address for security of
dispatch. Undoubtedly they did not feed the data including the name of
husband of the appellant so Central Public Information Officer may
provide appropriate reason of not including the name of husband in the
address which caused the return of 
ATM Card/ Rupay Card and created huge troublesome before the appellant under section 4 (1) d of the Right to Information Act 2005.

7-It is to be submitted before the Hon’ble Sir that under point 3  appellant sought following information

3-Please

addressed to Branch Manager, provide the cause to mislead the applicant.

CPIO
replied as 3-In the case nondelivery of the envelope, it is printed on
the envelope to return the same to the sender only, from where, it is
sent to parent branch for the delivery to the account holder. 



Hon’ble Sir Message was sent on the registered mobile number 9794103433 of the appellant, registered in the state bank of India that your
ATM Card/ Rupay Card
has been dispatched with postal ID such and such but actually this post
was addressed to the branch manager city branch according to
information made available by the superintendent of the post Mirzapur.
Here
misleading is that if the communication was addressed to branch manager
then why appellant was sent information regarding the dispatch of post
on her address and dispatch ID was provided.
If the
post ID of letter addressed to me had been provided to me whether
through phone or SMS , then such difficulty might not arise.
Now it is their obligatory duty of CPIO to provide the reason of misleading the appellant as aforementioned.


This
is a humble request of your applicant to you Hon’ble Sir that how can
it be justified to withhold public services arbitrarily and promote
anarchy, lawlessness and chaos in an arbitrary manner by making the
mockery of law of land? There is need of the hour to take harsh steps
against the wrongdoer in order to win the confidence of citizenry and
strengthen the democratic values for healthy and prosperous democracy.
For this, your applicant shall ever pray you, Hon’ble Sir.

It is too much unfortunate that our government functionaries are not providing information under Right to Information act 2005 because of the the quiet negative approach of the government which is interested in diluting the provisions of the right to Information act 2005 quite obvious from the working style of the government as it is trying to take the autonomy of the information commission under its hand which is quite unconstitutional but because of rampant corruption in the government machinery no one is raising hand against the accountable public functionaries of the government such practices must be stopped in order to establish a good governance in this country and to curb the growing corruption in our government machinery and in the departments of Government of India so that there maybe throughout development in our country Thanks to all friends.
