Reminder-Matter is concerned with the serious violations of the fundamental rights /Human rights of a staff of the department of the forest, government of Uttar Pradesh. 
Sir now time has come to again draw the kind attention of the Hon’ble Sir to the e-mail representation of the applicant sent on 20-May-2018 under article 32 of the constitution of the India in order to pursue the provisions of the article 51 (A) of the constitution of the India.
Here preservation of constitutional rights and to curb its frequent violations may be preferred rather than taking recourse of procedural lacunae, in the wide public interest of poor countrymen who are so vulnerable that senior rank bureaucrats are easily targeting them.

Most revered Sir –Your applicant invites the kind attention of Hon’ble Sir with due respect to following submissions as follows.



1-It is submitted before the Hon’ble Sir that  51A. Fundamental duties It shall be the duty of every citizen of India (a) to abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem;(h) to develop the scientific temper, humanism and the spirit of inquiry and reform;
(i) to safeguard public property and to abjure violence;
(j) to strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of endeavour and achievement

2-It is submitted before the Hon’ble Sir that Government of Uttar Pradesh is providing the same report in dozen of the applications of the applicant instead of resolving the  serious issue of non payment of emoluments of the salary of poor staff appointed as daily wage staff of the government of Uttar Pradesh.

P. because he used to pay heed to our grievances and now has no time for us. By passing administrative orders to deprive vulnerable government staffs of their rights is justified. On one side of screen few amassing huge salary more than two lakhs per month causing heavy burden on public exchequer and on the other side of screen poor staffs drawing meagre amount Rs,5000 per month are being deprived of salary by passing merely arbitrary circulars by colluding with the senior rank staffs. Whether such anti humanitarian practices may be justified in this largest democracy in the world. Whether in this public infrastructure there is share of only elite class and poor and downtrodden section may die on the verge of hunger. Whether such practice is not the human rights violation of public on the large scale. Whether it is not discrimination on the large scale that few amassing huge wealth from public resources.

3-It is submitted before the Hon’ble Sir that divisional forest officer Gorakhpur Division itself accepted the non payment of 19 months salary but according aggrieved staff aforementioned dues is of 29 months but at the same time he is articulating that work was not sanctioned by his office so payment will be made by his subordinate who took the work without seeking prior approval of his office. His repeated same reply in the submitted grievances is attached to the representation.
4-It is submitted before the Hon’ble Sir that department is providing Rs.174 per day as emoluments of the salary which is too much less in comparison to minimum wages set/prescribed by the government itself which is quite obvious if the Hon’ble Sir may take the perusal of the attached document to this representation.

Sir think about the gravity of the situation that if the government of Uttar Pradesh itself not complying the prescribed norm in regard to minimum wages to working staffs , then how can it ensure to implement these norms in order to be pursued by the private players.

5-It is submitted before the Hon’ble Sir that think about the gravity of situation that those drawing huge salary from public exchequer if two months salary may not be paid them, then they run from pillar to post and when the concerned is making representation to them through the applicant, then they are adopting lackadaisical approach in regard to proper redressal of the submitted grievances. It is the fact that concerned aggrieved served the department not particular individual therefore it is mockery of law of land to procrastinate on due payments to the aggrieved. A meagre amount is being paid to the applicant lower than the fixed minimum wages and surprising is that senior rank staffs are not interested to that amount by behaving like cruel private contractor who exploit its working both physically and mentally.
This is a humble request of your applicant to you Hon’ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness, and chaos in an arbitrary manner by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer in order to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your applicant shall ever pray you, Hon’ble Sir.

description of previous salary payments before the arbitrary withholding of the salary of aforementioned aggrieved staff by the senior rank staff. Hon

Hon’ble Sir may be pleased to take the perusal of the attached documents with this representation.
4-It is submitted before the Hon’ble Sir that third page of the attached documents with this representation is the arrear bill made by local area forest officer of amount Rs.56100.00 at the rate of Rs.5100 per month submitted to senior rank staffs of the government including divisional forest officer, Gorakhpur range but it is unfortunate that concerned senior rank staffs overlooked the legitimate proposal which reflects sheer insolence and tyranny on the part of the senior rank staffs.  Hon’ble Sir may be pleased to take the perusal of the attached documents with this representation.

  5It is submitted before the Hon’ble Sir that fourth page of the attached documents with this representation is the communication, Letter number-110/ 16-1 दिनांक, बाकी, 01/08/2017  of the area forest officer of the Baki Range to Divisional Forest Officer Gorakhpur range signed by Sanjeev Kumar Singh I.F.S. (Pro.) Area Forest Officer Baki. Who categorically sought the payment of the arrears of 19 months remuneration of the aforementioned aggrieved but it seems that senior rank staffs of the government of Uttar Pradesh have made practice not take seriously the request of lower rank in the administrative hierarchy ipso facto obvious. Hon’ble Sir may be pleased to take the perusal of the attached documents with this representation.

    6 It is submitted before the Hon’ble Sir that fifth page of the attached documents with this representation is the communication, letter number-520 /16F16A दिनांक, गोरखपुर, जुलाई 26, 2017  of the  Divisional Forest Officer Gorakhpur range addressed to Area Forest Officer Baki which contained the reference of the letter of aggrieved applicant addressed to Hon’ble chief minister, government of Uttar Pradesh endorsed to divisional forest officer, Gorakhpur range but it is unfortunate that concerned didn’t take seriously to the reference of Chief Minister otherwise letter might not be treated in a customary way to procrastinate into the matter.
 7–  It is submitted before the Hon’ble Sir that sixth page of the attached documents with this representation is a representation of the aggrieved applicant addressed to Hon’ble chief minister, the government of Uttar Pradesh dated 12/05/2018 in which he cried before the Hon’ble Sir in regarding miseries as a consequent to non-payment of emoluments of the salary. Hon’ble Sir may be pleased to take a glance at the attached documents with this representation.
   8–  It is submitted before the Hon’ble Sir that if death takes place because of hunger, perpetrated by the senior rank staffs, then where is Right to life? Whether Right to life is not being snatched by the concerned divisional forest officer, Gorakhpur range?

Article 2 of the Human Rights Act protects your right to life. This means that nobody, including the Government, can try to end your life. It also means the Government should take appropriate measures to safeguard life by making laws to protect you and, in some circumstances, by taking steps to protect you if your life is at risk. Public authorities should also consider your right to life when making decisions that might put you in danger or that affect your life expectancy.


Whether the family of the aggrieved is not on the verge of hunger?


This is a humble request of your applicant to you Hon’ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness, and chaos in an arbitrary manner by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer in order to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your applicant shall ever pray you, Hon’ble Sir.

Hon'ble Sir may be pleased to direct aforementioned respondents to pay the wages/remuneration of the aforementioned aggrieved staffs as soon as possible as such incidence is the violation of both fundamental rights and human rights of the aggrieved. Those accountable for non-payment of the meagre wages provided as maintenance to aforementioned aggrieved daily wage staff may be subjected to proper scrutiny under appropriate law of land.

Think about the gravity of the situation that chief minister office claims to monitor Jansunwai portal minutely but what happened when such a serious matter is being overlooked by them. It seems that saffron brigade has been frustrated in the state because of its dismal performance.
फीडबैक : दिनांक 21/04/2019को फीडबैक:- सोचिये २९ महीने की तनख्वाह नही दे रही है सरकार और सिर्फ पाच हजार रुपये पर महीने क्या सरकार का यह चेहरा किसी निर्दयी ठेकेदार जैसा नही है | यदि कोई प्राइवेट संस्था या कोई प्राइवेट कंपनी यह निंदनीय कार्य करती तो प्रजा राजा के पास जाती और न्याय का गुहार लगाती किन्तु यहा गुनाहगार राजा ही है फिर प्रजा जाय तो जाय कहा | जब इस तरह की घटनाए आम हो गई तो और राजा निरंकुश होता चला गया तो बिधि के शासन की बात की गयी और उसको सर्वोच्च माना गया किन्तु यह तो बिधि का शासन नही बल्कि जंगल राज है जहा पर सरकार के तीनो अंग मिल कर जनता पर कहर बरपा रहे है | सोचिये एक तरफ आप मनमाना तीन लाख चार लाख रुपये मासिक तनख्वाह ले रहे है दूसरी तरफ गरीब और असहाय जनता को २९ महीने की तनख्वाह वह भी सिर्फ पाच हजार रुपये हड़प करना चाहते है | यही है जनता के प्रति निष्ठा यही कारण है जनता इसी आस में की अगली सरकार आयेगी तो कुछ परिवर्तन होगा सरकारे बदल रही है | इससे बड़ी आराजकता क्या होगी की सारे नियम सिर्फ दिखावटी है और शासन के नाम पर सिर्फ मनमानापन और तानाशाही है और इस आराजकता में मानवीय मूल्यों का संरक्षण कैसे संभव है | यह सिर्फ इसलिए संभव हो रहा है की मताधिकारी जागरूप नही है वे उचित अनुचित का भेद नही समझ रहे है | इस समय पर निचले स्तर पर भ्रस्टाचार को खुली छूट है | मेमना कहे उसे सुरक्षा चाहिए तो भेड़िया को लगा दीजिए तो आहार बनने में कितना समय लगेगा | सोचिये एक ही रिपोर्ट दो दर्जन शिकायतों में लगाईं गई और जिसकी शिकायत के बिन्दुओं से दूर तक की सम्बन्ध नही है हास्याश्पद यह है कुछ लोग यह भूल चुके है की लोकतंत्र में जनता को बार बार धोखा नही दिया जा सकता है |

There is no doubt that wolf will not protect calf but calf will have to make efforts in order save life from the wolf otherwise he will be easy prey in the hand of wolf which will be called suicide. Our prime Minister Mr Narendra modi did not make single efforts to curb the corruption from the government machinery since five years. During the last parliamentary elections Prime Minister Narendra Modi made several election rhetorics to the electorates of this country but it is unfortunate he did not keep one of them search is the quality of a cheater. No body should be allowed to cheat the innocent and gullible citizenry of this country.
