An appeal under subsection 1 of section 19 of the Right to Information Act 2005 before District Magistrate Mirzapur for next action in accordance with the law as the public information officer collectorate didn’t entertain the R.T. I. Communique submitted under subsection 1  of section 6 of Right to Information Act 2005 within time as stipulated under subsection 1 of section 7 of Right to Information Act 2005.

Subject -Violation of subsection 1 of section 7 of Right to Information Act 2005 by public information officer collectorate so action must be taken against him for infringement of the aforementioned provision of Right to Information Act 2005 and public information officer collectorate may be directed to provide the sought information as soon as possible. 

With due respect, your appellant kindly draws the attention of the Hon’ble Sir to the following submissions as follows. 
1-It is submitted before the Hon’ble Sir that your appellant invited five point-wise information from public information officer collectorate on 28/03/2018 which was received in the office of Hon’ble Sir on the same date. Hon’ble Sir today is 14/05/2018 which shows that 47 days elapsed but public information officer collectorate didn’t provide the sought information as sought from him. Hon’ble Sir may be pleased to take a glance at the attached documents with this representation.
  2-It is submitted before the Hon’ble Sir that the following information was sought from public information officer collectorate as follows. 

1-You Hon’ble Sir may provide the access to information in regard to class -2, class-3 and class 4 employees posted at Tahsil Sadar in Mirzapur district as follows.
1-A-Name of the public staff.
1-B-Class and designation.
1-C-Duration/span of the posting in Sadar Tahsil Mirzapur.
1-D-If second posting in the Tahsil Sadar then provides the detail of first posting in Sadar Tahsil Mirzapur. 
2- You Hon’ble Sir may provide the access to information in regard to transfers made in the light of communication made by chief secretary Rahul Bhatnagar, Government of Uttar Pradesh dated 03-May-2017, letter number-संख्या –2/2017/1/3/96-का-4-2017 addressed to all additional chief secretary/principal secretary/ secretary, Government of Uttar Pradesh.
3-It is submitted before the Hon’ble Sir that when public information officer collectorate itself not interested in providing the sought information, then how will he be instrumental in providing the sought information which is in possession of other public authority? Whether to perform allocated duties in a schizophrenic way by an accountable public functionary is justified? First, overlook the setup rules and regulations and later apologies are ideal practices adopted by public servants in these days. 
                    

This is a humble request of your applicant to you Hon’ble Sir that It can never be justified to overlook the rights of the citizenry by delivering services in an arbitrary manner by floating all set up norms. This is sheer mismanagement which is encouraging wrongdoers to reap the benefit of loopholes in the system and depriving poor citizens of the right to justice. Therefore it is need of the hour to take concrete steps in order to curb grown anarchy in the system. For this, your applicant shall ever pray you, Hon’ble Sir.

ट्रान्सफर और पोस्टिंग में बहुत पैसा है इसलिए मनमाना नियम बना कर खूब कमाई हो रही है सोचिये नियमो की क्या वैल्यू है जिनको सिर्फ तोड़ने के लिए बनाया जाता है जब की दिखाया जाता है की सुशासन स्थापित करने के लिए ऐसा किया गया | सोचिये गलत कार्य वह भी अच्छाई का आडम्बर करके ठीक उसी प्रकार जैसे अमृत के कलश में मदिरा भर दिया जाय |
