Whether government never checks the breach of provisions of R.T.I. Act 2005 as it seems that August act is thrown into dustbin because of rampant corruption?

Appeal through authorised representative of the appellant by Yogi M. P. Singh as sought information is still unavailable to the appellant as 45 days passed since the date application was received in the office of the public authority quite obvious from online tracking of the speed post.

An appeal under subsection 1 of section 19 of the Right to Information Act 2005 as PIO i.e. Public information officer BOARD OF TECHNICAL EDUCATION UTTAR PRADESH LUCKNOW did not make even communication in regard to R.T.I. Communique dated-24-09-2019 while this communique was received by his office on 27/09/2019 quite obvious from the speed post tracking made online by the appellant on the website of the department of the post.

 7. (1) Subject to the proviso to sub-section (2) of section 5 or the proviso to subsection (3) of section 6, the Central Public Information Officer or State Public Information Officer, as the case may be, on receipt of a request under section 6 shall, as expeditiously as possible, and in any case within thirty days of the receipt of the request, either provide the information on payment of such fee as may be prescribed or reject the request for any of the reasons specified in sections 8 and 9:

Which means public information officer cryptically denied the sought information as his silence on the issue is tantamount to denial of sought information.

  2-It is to be submitted before the Hon’ble Sir that following information sought by the appellant through R.T.I. Communique as aforementioned and copy is attached to the appeal.

1-Please provide access to information as follows.

a-Name of the staff who processed the aforementioned grievance.

b-Name of the designation of the staff processed the aforementioned grievance.

c-Noting made in regard to the aforementioned grievance be made available to the applicant.

2-In second step, provide access to information as follows.

a-Provide copy of the checked answer sheet as the detail is mentioned in the grievance.

b-This is your report-आप अपनी उत्तर पुस्तिका का पुनर्मूल्यांकन या स्क्रूटिनी करा सकते है | 

Aforementioned report is information not redress of the grievance.

Please provide the name and designation of the public staff under whose supervision, the aforementioned report was submitted by the subordinated staff as a reprieve to the aggrieved applicant.

    3-It is to be submitted before the Hon’ble Sir that under subsection 2 of section 7 of the Right to Information Act 2005 stated as follows-

  (2) If the Central Public Information Officer or State Public Information Officer, as the case may be, fails to give decision on the request for information within the period specified under sub-section (1), the Central Public Information Officer or State Public Information Officer, as the case may be, shall be deemed to have refused the request.  

                                             Please direct concerned public information officer to provide the aforementioned sought information pointwise as sought by the information seeker. For this appellant shall ever pray you, Hon’ble Sir.
