 When the UPSIC itself doesn’t regard the provisions of Right to Information Act ,then how can it be instrumental in providing sought information  to information seeker? The goal of transparency act is to enhance transparency and accountability in the working of public authority but when there is no transparency and accountability in the working of UPSIC itself ,then how such constitutional institution may be instrumental in ensuring transparency and accountability in the working of public authorities in the state.

With due respect your applicant wants to draw the kind attention of the Hon’ble Sir to the
following submissions as follows.
1-It is submitted before the Hon’ble Sir that  why did UPSIC not furnish access to information
even after the following second appeal under subsection (3) of section 19 of Right to Information Act 2005.

1-It is submitted before the Hon’ble Sir that whether it is justified that PIO ,UPSIC may not entertain the aforesaid RTI communique when made contact with him by the information seeker/your applicant ,he was simply told by the lady staff that RTI communique is not available to the office of public information officer.
2-It is submitted before the Hon’ble Sir that Hon’ble Sir may be pleased to take a glance of the first appeal earlier submitted on 30-November-2014 as follows.

My RTI communique dated 27.10.2014 addressed to Chief Information Commissioner
,Government of Uttar Pradesh, didn’t reach to Uttar Pradesh Information Commission , Lucknow while dispatched through speed registered post as told by staff of UPSIC on 27.11.2014 when your applicant enquired them.

Hon’ble Sir-Whether UPSIC will ever trace the file of complaint missing since years
and during the hearings each time subordinate staff is directed by Hon’ble commissioner Mr.Gyan Chandra Maurya to trace the file. Please trace the missing files of complaint S-11-169/C/2009/Mirzapur Yogi M. P. Singh versus
CRO Mirzapur .Next date of hearing is 8-July-2014 .
Most surprising is that my complaint S-11-1903/C/2010/ Mirzapur ,Yogi M. P. Singh versus
additional district Judge, High court Allahabad is not updated on the website of UPSIC as during the hearing on 9-Oct-2013, your applicant was told that next date of hearing is 8-July-2014 . My apprehension is this file may be also missing as judicial members are more Influential in
comparison to bureaucrats. When bureaucrats can set to get complaint files missing, then why not judicial members?

१-श्री मान जी ८ जुलाई की सुनवाई के दौरानजब प्रार्थी द्वारा गायब शिकायतसंख्याcomplaint
S-11 169/C/2009/Mirzapur केबारे में जान कारी चाही तो माननीय सूचनाआयुक्त को मेरे मिसिंग फाइल कहने पर बहुतज्यादा आपत्ति थी उनके अनुसार हमें मिस- प्लेस्ड फाइल कहना चहिये किन्तु यदि वहफाइल मिस-प्लेसड  थी और  जिसको खुजवा लेनेकी बात कही वह २७ नवम्बर -२०१४ को क्योंनहीं लिस्ट की गयी | इसका मतलब कई सालोंपहले अपने स्थान से हटी फाइल अभी भी अपनेस्थान पर नहीं आई |

3-It is submitted before the Hon’ble Sir that according to General clause act if letter sent through registered post and copy and receipt of letter is presented on demand and there is no denial to receive letter ,then it is accepted that letter has been received by the addressee.
Ipso facto obvious from attachment of this e-mail representation that ,there is copy of letter and receipt   of postal department.
Department of UPSIC is falsely stating that sent RTI Communique is not
available in its office.

This is humble request of your applicant to you Hon’ble Sir that It can never be
justified to overlook the rights of citizenry by delivering services in arbitrary manner by floating all set up norms. When the aggrieved are ready to accept all tyranny ,then why such circumstances are being created which couldn’t be tolerated by complainants. Whether it is justified that concerned department wants to loot the public fund meant to poor and downtrodden and office of constitutional functionaries may shield them. It seems that honesty
has no value otherwise genuine citizens raising voice against the wrongdoings erring staff of Government may not be harassed by erring staff. Please take actions in accordance with the law . For this your applicant shall ever pray you Hon’ble Sir.

2-It is submitted before the Hon’ble Sir that how can an ombudsman appointed under Right to
Information Act 2005,  be information seeker friendly if there is sheer anarchy in its function. Penal action is the provision under the transparency act  which creates fear in the mind of erring PIOs but the collusion between members of transparency panel and erring PIOs made it ineffective. It seems that we are living in banana republic instead of democratic republic.

This is humble request of your applicant to you Hon’ble Sir that It can never be justified to overlook  the rights of citizenry by delivering services in arbitrary manner by floating all set up norms. This is sheer mismanagement which is encouraging wrongdoers to reap benefit of loopholes in system and depriving poor citizens from right to justice. Therefore it is need of hour to take concrete steps in order to curb grown anarchy in the system. For this your
applicant shall ever pray you Hon’ble Sir.

  2. In this banana republic ,every accountable public functionary except few one have made its own settings to accelerate back door income. How a member belonging to poor family can get justice. Think about the gravity of situation that file is missing and case was closed forcibly overlooking all prayers. Where is rule of law in this largest democracy in the world.
