An appeal under subsection 3 of section 19 of Right to Information Act 2005 before the state information commission, Uttar Pradesh, Lucknow as state public information officer in the office of director-general of police Lucknow did not provide information to the information seeker most surprising did not deem it fit to entertain.

Prayer-State Public Information Officer in the office of director-general of police Lucknow even did not process the submitted R.T.I. application online which implies that he took under teeth the provisions of the Right to Information Act 2005. It seems that the Right to Information Act 2005 has been thrown into a heap of garbage in this largest populous state of this largest democracy in the world.

Disposal of request. Provided that the transfer of an application according to this subsection shall be made as soon as practicable but in no case later than five days from the date of receipt of the application. 7. (1) Subject to the proviso to sub-section (2) of section 5 or the proviso to subsection (3) of section 6, the Central Public Information Officer or State Public Information Officer, as the case may be, on receipt of a request under section 6 shall, as expeditiously as possible, and in any case within thirty days of the receipt of the request, either provide the information on payment of such fee as may be prescribed or reject the request for any of the reasons specified in sections 8 and 9: Provided that where the information sought for concerns the life or liberty of a person, the same shall be provided within forty-eight hours of the receipt of the request.

SPIO in its response articulated as You are advised to contact the above-mentioned officer for further details. This advice followed by the appellant quite obvious from the document attached to this appeal but, unfortunately, this representation was also sent by the SPIO into the heap of garbage. Here insolence of the SPIO can not be overlooked as he is undermining the authority of the august act. SPIO may retrospect to take the perusal of the date of filing of the R.T.I. Communique is 07/06/2020 and today is 07/08/2020 which means two months passed. This implies that SPIO in the office of director-general of police Lucknow Uttar Pradesh infringed subsection 1 of section 7 of the Right to Information Act 2005. According to the law of land, action must be taken against SPIO as he took under teeth the provisions of Right to Information Act 2005.

No information is being made available in the regime of Yogi and Modi and every institutions are failed in this country. Where is good governance if such anarchy is prevailed every where?

Right to Information act 2005 was introduced by the government of India to promote transparency and accountability in the working of public authorities but in the Government of Uttar Pradesh not a single point information is being provided by the public authorities and whatever penalties are being imposed by the state information commission that is not recovered by the government of Uttar Pradesh which is the root cause that State Public Information Officer in the Government of Uttar Pradesh are not providing any information to the information seekers and same thing happened in the office of Director General of Police Lucknow.

If there is fragment of honesty in the government of Uttar Pradesh, then they must think about it, how the law of land is conserved if office of director general of police and home secretary is not providing information to the information seeker in the matter concerned. Think about the gravity of situation that 709 public information officers were penalized with pecuniary penalty of rupees 25000 but not a single recovery was made by the Yogi government in the state.
