Hon’ble Sir when the anomaly under MGNREGA scheme from year2007 to 2010 is being looked into by C.B.I. in the the compliance of order of High court of judicature at Allahabad ,then how the concerned matter can be overlooked by apex investigating agency and its supervisory merely on the flimsy ground that matter is concerned with the state government.

2-It is submitted before the Hon’ble Sir that please take a glance of order passed by Lucknow bench of High court of judicature at Allahabad.
In the view of above, we allow the writ petition with
following order :
(I) A writ in the nature of mandamus is issued directing the Central Bureau of Investigation to investigate the abuse and misappropriation of fund as well as the abuse of power under Mahatma Gandhi National Rural Guarantee Scheme with regard to seven districts of Division bench of justice D.P.Singh and Ashok Pal passed excellent order of C.B.I. enquiry in uttar pradesh. 18/11/2015 Division bench of justice D.P.Singh and Ashok Pal passed excellent order of C.B.I. enquiry in uttar pradesh.

State of U.P, namely Balrampur, Gonda, Mahoba, Sonbhadra, Sant Kabir Nagar, Mirzapur and Kushinagar in the years 2007 to 2010 with appropriate action and prosecution in accordance with law.

(II) A further writ in the nature of mandamus is issued directing the Central Bureau of Investigation to hold a preliminary enquiry under Chapter IX of CBI Manual with regard to other districts of the State of U.P for the aforesaid three years relating to abuse, misuse or misappropriation of fund provided by the Government of India under Mahatma Gandhi National Rural Guarantee Scheme(supra) with followup regular enquiry, if required.
3-It is submitted before the Hon’ble Sir that whether the function of central bureau of investigation is not supervised by Central Vigilance Commission. Here wrongdoings done by wrongdoers is not subjected the enquiry carried out by C.B.I. In order to comply the order of division bench of High court of judicature at Allahabad of Lucknow bench. For detail take a glance of attached documents with this representation.

                                      
This is humble request of your applicant to you Hon’ble Sir that It can never be justified to overlook  the rights of citizenry by delivering services in arbitrary manner by floating all set up norms. This is sheer mismanagement which is encouraging wrongdoers to reap benefit of loopholes in system and depriving poor citizens from right to justice. Therefore it is need of hour to take concrete steps in order to curb grown anarchy in the system. For this your applicant shall ever pray you Hon’ble Sir.

In view of above, we allow the writ petition with following order : 
(I) A writ in the nature of mandamus is issued directing the Central Bureau of Investigation to investigate the abuse and misappropriation of fund as well as the abuse of power under Mahatma Gandhi National Rural Guarantee Scheme with regard to seven districts of State of U.P, namely Balrampur, Gonda, Mahoba, Sonbhadra, Sant Kabir Nagar, Mirzapur and Kushinagar in the years 2007 to 2010 with appropriate action and prosecution in accordance with law. 
(II) A further writ in the nature of mandamus is issued directing the Central Bureau of Investigation to hold a preliminary enquiry under Chapter IX of CBI Manual with regard to other districts of the State of U.P for the aforesaid three years relating to abuse, misuse or misappropriation of fund provided by the Government of India under Mahatma Gandhi National Rural Guarantee Scheme(supra) with follow-up regular enquiry, if required. 
(III) The State Government is further directed to provide all necessary assistance including manpower to CBI within a month from the date of receipt of request to proceed for investigation in pursuance to the present judgment. 
(IV) A writ in the nature of mandamus is issued directing the State Government to consider for establishment of multi-member State Quality Monitor at district and State level to supervise unitilisation of fund under Mahatma Gandhi National Rural Guarantee Scheme till the Government of India frames appropriate rules, regulations or issue appropriate order keeping in view the observation made in the body of judgment. 
The CBI shall submit status report to this Court at the interval of every three months with regard to investigation done in pursuance to the present judgment. 
The writ petition is allowed accordingly. No order as to costs. 
Since it is a final judgment, Registry shall ensure to list the writ petition before the present Bench to monitor the compliance of the judgment. 
Let a copy of the judgment be sent to the Chief Secretary, Government of U.P., Principal Secretary, Home, Government of U.P., Secretary, Ministry of Law & Justice, Government of India, Director, C.B.I., New Delhi for compliance and appropriate action in pursuance to the observation made in the body of the judgment.

Hon’ble Sir-With due respect your applicant wants to draw kind attention of the Hon’ble Sir to the following submissions as follows.
1-It is submitted before the Hon’ble Sir that villagers of village panchayat- Nibee Gaharwar ,Block-Chhanbey ,District-Mirzapur ,State-Uttar Pradesh submitted representation addressed to D.M. Mirzapur dated- 30.5.2014 alleging large scale irregularity in MGNREGA scheme and demanded stern action against wrongdoers. The scan copy of aforesaid representation is attached with this e-mail.
2-It is submitted before the Hon’ble Sir that
If Hon’ble Sir will see the attached photo ,then in this photo a new designed house is made and before the house a new tractor with trolly is parked belong to Ramesh Chandra Dubey S/O Gaja Nand Dubey who is the MGNREGA worker whose name was deleted because of fear of CBI enquiry and family members of gram pradhan also deleted . Latest forming land of one million approximate was purchased by by Ramesh Chandra Dubey and his elder brother as family consist of two brothers.

Grievance Description : With due respect your applicant wants to draw the kind attention of the Hon’ble Sir to the following submissions as follows-1-It is submitted before the Hon’ble Sir that MGNREGA job card holder Gulab UP-62-001-022-001/136 , account number 19386 ,district cooperative bank, Pintu UP-62-001-022-001/137 ,account number 19384 , district cooperative bank and Ghanshyam UP-62-001-022-001/139 ,account number nill I.e. no bank or post office account were registered as MGNREGA worker on 12/4/2006 , 12/4/2006 and 12/4/2006 by concealing its title Dubey as all are Dubey. There are family members of gram pradhan Santosh Dhar Dubey village panchayat-Nibigaharwar Block-Chhanbey District-Mirzapur State-Uttar Pradesh and are landlords and itself hire workers for farming . 2-It is submitted before the Hon’ble Sir that Whether an individual working at seven hundred kilometer away from the village panchayat, how can work as MGNREGA worker? Whether it is justified that those entitled for job under MGNREGA may be deprived from this opportunity arbitrarily . 3- It is submitted before the Hon’ble Sir that Whether material supplier under MGNREGA may be MGNREGA worker as being done by gram pradhan Santosh Dhar Dubey and secretary of the village panchayat. From the working style of District level officers ,every thing is possible for the gram pradhan. Whether Government officers ever take the perusal of provision of MGNREGA. There is sheer irregularity in the implementation of the act.

Whether it is precondition that material supplier under MGNREGA be the close relative of Gram Pradhan and MGNREGA job holder. It seems that MGNREGA scheme of Government is the excellent source of income for the relatives of Gram Pradhan.

3-It is submitted before the Hon’ble Sir that more than one year passed since the order was passed by Hon’ble Judges but whenever C.B.I. Comes in the district first it halts in the district under the hospitality of district administration and then it moves towards Haliya block. EOW agency of state government did better job in less time but the fault was that sanction was not granted by state functionaries at that time. Hon’ble please take a glance of following stories. Quantum of corruption in the government machinery can be easily guessed from these facts that there is ample evidence of siphoning of public funds by the corrupt public functionaries but concerned are not taking action against wrongdoers and most surprising is that two district level officers carried out enquiry and submitted the enquiry reports to district magistrate, chief development officer and DPRO Mirzapur but concerned didn't take action against the wrongdoers.
