Whether lackadaisical approach of police is not showing that we are promoting the criminal elements in the society.
With due respect your applicant wants to draw the kind attention of the Hon’ble Sir to the following submissions as follows.
1-It is submitted before the Hon’ble Sir that a news item is published in Amar Ujala daily on Tuesday i.e.29-April-2014 on page 4 with title “Rape with the student gone to appear in the exam” is as follows.
Matter is concerned with the Adalhat police station ,District-Mirzapur. According to news item , The son of peon of college raped the girl student by forcibly entering into the bathroom and this degree college is situated in Adalhat market where girl student came to appear in the practical exam of B.A. Third year on Monday . This news created the sensation in the college . On information when family members reached to college ,they submitted the application against the alleged rapist. According to victim , she came to college to appear in the practical exam of Geography , after noon at 1 “O” clock she went to bathroom of degree college but she was silently followed by son of peon of college and rapist then also forcibly entered into the bathroom with her where rapist raped the girl by shutting her mouth. Alleged rapist also threatened to kill the victim if she revealed the story to some one else ,then rapist ran away from the site. Now police is searching the alleged rapist. Whether police will detain the rapist or not ,only time will tell.
2-It is submitted before the Hon’ble Sir that Here this question arises that whether the public places are not safe in this largest state of country. At least ,adequate attention must be given to public locations. There is continuous attack on the dignity of women in this district.
3-It is submitted before the Hon’ble Sir that
Equality before the law, also known asequality under the law, equality in the eyes of the law, or legal equality, is the principle under which all people are subject to the same laws of justice (due process). The belief in equality before the law is called legal egalitarianism. Laws raise important and complex issues concerning equality, fairness, and justice.
Hon’ble Sir-Article 6 of U.D.H.R. states that every one has right to recognition every where as a person before the law. But even citizens are deprived from this right in this country.
Article 7 of U.D.H.R. states that all are equal before the law and are entitled without any discrimination equal protection of law .All are entitled to equal protection against any discrimination in the violation of this declaration and against any incitement to such discrimination.
Article 8 of U.D.H.R. states that every one has right to an effective remedy by the competent national tribunals for the acts violating the fundamental rights granted him by the constitution or by law.
Whether our constitution quotes that if rape victim may knock the door of competent authoritiesthen such government functionaries may adopt dilly dallying practice on such complaints so that existing evidences may be automatically be annihilated.
This is humble request of your applicant to you Hon’ble Sir that please direct concerned police to act swiftly so that victim may get justice . For this your applicant shall ever pray you Hon’ble Sir.
