Hon’ble Sir-Think about the gravity of the situation that UPSIC is not instrumental in providing sought information to your applicant. Erring PIOs are not providing sought information to Information seekers but UPSIC only procrastinate on the second appeals filled by the information seekers on flimsy ground. 

Whether chief information commissioner UPSIC would be
instrumental in providing sought information to your applicant.

PrayerNot a single point information was made available by PIO ,UPSIC Lucknow as sought by appellant through the RTI Communique 07/03/2015 and blunder on the part of PIO is that he didn’t deem fit to make correspondence in regard to sought information and
first appellate authority also took under teeth the provisions of transparency act by overlooking the first appeal of appellant made under subsection 1 of section 19 of Right to Information Act 2005 dated 14May2015. Copy of R.T.I. Communique and first appeal is attached

My inner conscious don’t allow to attend the appeals fixed for hearing on 5-May-2015 in the information commissioner Mr. Gajendra Yadav court.

Since all the concerned accountable public functionaries remained failed in providing justice against the tyranny and arbitrary decision of Information Commissioner Mr. Gajendra Yadav so your applicant  boycott his court on 5-May-2015 as plea of your applicant Sun, Mar 8, 2015 at 10:43 AM was overlooked by 
C.I.C. Of UPSIC.

3-It is submitted before the Hon’ble Sir that your applicant is too much aggrieved with such cryptic dealing so consequently decided that aforesaid cases fixed for hearing in the court of Mr. Gajendra Yadav on 5-May-2015 be transferred to the court of chief information commissioner of Government of Uttar Pradesh in the interest of justice.
Hon’ble Sir-What was wrong if Hon’ble chief information commissioner may hear my complaints on 5-May-2015 which were languishing in the commission headed by him since several years. Now his companion Hon’ble commissioner will have full freedom to free erring public information officers in the absence of appellant which is usual practice.

Subject-To direct the Executive Engineer EDD II Mirzapur to made available sought information as sought by your appellant through R.T.I. Communique dated 08/02/2015 . This R.T.I. Communique along with relevant annexures are attached with this appeal.
With due respect your applicant wants to draw the kind attention of the Hon’ble Sir to the following submissions as follows.
1-It is submitted before the Hon’ble Sir that your appellant through aforesaid R.T.I. Cmmunique sought information under six points . This R.T.I. Communique was sent through speed registered post as well as copies to various government authorities through e-mails.

Executive engineer EDD II Mirzapur did not furnish access to information as sought by your applicant through RTI Communique 08/02/2015 .
An application under subsection (1) of section (19) of Right to Information Act 2005.
Subject-Sheer violation of provisions of Right to Information Act 2005 by the Executive Engineer EDD II Mirzapur.
3-It is submitted before the Hon’ble Sir that this is the need of hour to take harsh steps against Executive Engineer EDD II Mirzapur who not only violated the provisions of RTI Act 2005 wilfully but acted against the spirit of transparency Act.
                                     
This is humble request of your applicant to you Hon’ble Sir that It can never be justified to overlook  the rights of citizenry by delivering services in arbitrary manner by floating all set up norms. This is sheer mismanagement which is encouraging wrongdoers to reap benefit of loopholes in system and depriving poor citizens from right to justice. Therefore it is need of hour to take concrete steps in order to curb grown anarchy in the system. For this your applicant shall ever pray you Hon’ble Sir.

  2. Every one knows Information Commissioner plays vital role in providing information to information seekers. Here information commissioner itself playing negative role by its cryptic dealings and he must be instrumental in providing sought information but he prefers to support the wrongdoings of erring public information officers of the state. It seems that they are specially appointed to promote anarchy in the system instead of transparency and accountability .
