.00 Whether this huge amount was charged from the candidates to appoint few of
them without pursuing the standard set up norm. Whether it is justified. I visited
the website  of UPSIC today and tried to
know the biodata of appointed candidates , four of them is available but rest
four of them is unavailable. What was the motive of state government to charge
huge fee from the aspirants if they had not to adopt any process which may be
transparent and accountable. Government adopting cryptic process in order to
appoint members of transparency panel whose job is to make the working style of
public functionaries transparent. Whether these constitutional functionaries
would be ever successful in order to provide desired result. Undoubtedly this
act of state government disappointed others who were not given opportunity to
show its capability. Here most troublesome is that state government behaved
like private money minted institution. It seems that R.T.I. activists were
overlooked again in this process. Honesty was not given paramount due
importance in the selection process. This selection was made keeping
forthcoming election in the mind. If this process was carried out after
loksabha election ,then there was no need to publish the biodata of anyone on
the website. At least four out of babudom. Media also plays the vital role in
the election as rumour mongers. Poor R.T.I. activists should make an
organization in order to safeguard its rights. These people dedicate entire
life for noble cause but credit goes to some one else. Again my demand from
state government is that these two must not be spared from the penal action-
In two financial years ,only
three imposed penalties on two erring PIOs but unfortunately still to be
recovered.
In a
crucial development, however, the high court directed the state government to
file a counter-affidavit within four weeks, to a petition challenging the
appointment of the ICs. It also granted two weeks to the petitioner to furnish
a rejoinder affidavit and directed both parties to come prepared for a final
hearing into the matter during on the next date.
The order
came from a bench of Justice Rajiv Sharma and Justice Mahendra Dayal on a writ
petition filed by IPS officer Amitabh Thakur. His counsel said that the state
government, through an advertisement, invited applications for the post of ICs.
Though Thakur applied and paid the prescribed fee, like 650 others, he received
no communication about the selection process. He also said the state did not
conduct an examination or interview of applicants and directly announced the
names of eight persons.
Pleading that the process of
appointment was neither fair, nor transparent, the petitioner has also demanded
that the appointments be quashed. He has also asked that the court should
direct the state to formulate a definite, fair and transparent selection
process for the appointment of information commissioners.
The Uttar Pradesh government has for
the first time advertised to fill up the posts for information commissioners
(ICs) and imposed a fee of Rs 2,000 to ward off frivolous applicants.

The state has eight vacant posts of information commissioners.
The government feels that the fee would discourage fresh
graduates, engineering and medical passouts from applying as the minimum
qualification is graduation.
Senior officials in the administrative reforms department
(ARD) said initially Rs 10,000 was proposed but it was later fixed as Rs 2,000.
“This is to discourage graduates from applying. Had there been no fee, we
would have received lakhs of applications,” said principal secretary, ARD,
Prabhat Kumar Sarangi.

  2. If the honest and public spirited people will be appointed at the post of information commissioners ,then automatically it will bring up more transparency and accountability in the system. But if there will bargaining in appointing the individuals at constitutional posts and motive to earn fund ,then it is not possible to appoint efficient person at constitutional posts. Members of transparency panel must be appointed in transparent and accountable way.

  3. Whether constitutional provisions allow them to do so. Unfortunately no one dares to oppose them when they take provisions of constitution under teeth. We want justice but who will deliver us justice? Here betterment of society is possible only when few wrongdoers may have been put behind the bar for their wrong deeds . Whether corrupt can award punishment to corrupt. There is need of honesty in the system.
