With due respect, I want to intimate the concerned SPIO of the government of Uttar Pradesh who is habitual to not providing sought information under the Right to Information Act 2005 and FAA habitual to not entertaining the appeals submitted under subsection 1 of section 19 Right to Information Act 2005 that my appeal has been received by the state information commission and now he has only two options and select one of them, either provide the sought information to the information seeker or be ready to tell the genuine reason of not providing sought information to Hon’ble Information Commissioner, Government of Uttar Pradesh.

An appeal under subsection 3 of section 19 of the Right to Information Act 2005 as PIO cryptically denied sought information and FAA remained a mute spectator of cryptic denial of sought information ipso facto obvious.

Prayer- Public information officer BOARD OF TECHNICAL EDUCATION UTTAR PRADESH LUCKNOW / Mr Varun Kumar Yadav designation-Deputy secretary through its communication dated-25/11/2019 seeking more fee Rs.98 which means postal order of Rs.100 in regard to R.T.I. communiqué sent by the applicant received in the office of public authority on 27/09/2019.
Public Information Officer took near about three months in seeking the more fee when the applicant submitted the first appeal under subsection 1 of section 19 of the Right to Information Act 2005 and at this time, to take a decision on the first appeal has also expired. Which means both SPIO and FAA have violated the provisions of the Right to Information Act 2005 and subsequent communication aforementioned is only a cunning trick to make excuses before the commission nothing else.
Hon’ble Sir may be pleased to take a perusal of the following provision i.e. subsection 6 of section 7 of the Right to Information Act 2005.

Notwithstanding anything contained in sub-section (5), the person making request for the information shall be provided the information free of charge where a public authority fails to comply with the time limits specified in sub-section (1). |

Most revered Sir-Public Information Officer and First Appellate Authority made the mockery of the provisions of the Right to Information Act 2005 as first they procrastinated even in responding to the R.T.I. Communique submitted under subsection 1 of section 6 of the Right to Information Act 2005 and first appeal under subsection 1 of section 19 of the Right to Information Act 2005. Now they are applying the cunning trick to deviate the attention from the real issue that they took under teeth the provisions of the Right to information act 2005 through the aforementioned communication. The matter invites the action under section 20 of the Right to Information Act 2005. Most revered Sir scan copy of the RTI communiqué is attached to the attached e-mail to this representation cum second appeal. Moreover along with the hard copy of this appeal, both the R.T.I. Communique and First appeal will be enclosed.

Undoubtedly there must be transparency and accountability in the government offices and especially when they are checking the answer sheets of the students because students do work hard
Undoubtedly Satyam Shukla had to be provided the sought information as concerned with the negligence in checking copy of students which tantamount to play bad game with the future of students.
Undoubtedly it is complete mis management if State Public Information officers are not providing information sought by the information seekers it is mockery of the law of land because it is tantamount to throw The Right to Information act 2005 into dustbin and same thing is performed by the state functionaries in the state as several applications are submitted under RTI act 2005 but not a single information is being provided by the concerned State Public Information officers on flimsy ground. Undoubtedly action must be taken against these Public Information officers but Modi Government and yogi government is not taking any action even those penalties which are imposed on the wrongdoer public information officers are not recovered by the accountable public functionaries in the state.
Since there is no fear of penal action so not frightened PIOs are violating the provisions of the Right to Information Act 2005. Why will they frighten if no action will be taken against them even after the slapping of penalties, imposed penalties are never recovered from the salaries of the wrongdoer public information officers.
