S/O –Vijay Narayan Singh Village-Kothara Kantit Police station-Jigana District-Mirzapur (U.P.) Respondent-Public Information Officer /Additional S.P. City District-Mirzapur (U. P.) Prayer-PIO denied the sought information on flimsy ground which is sheer illegal and unconstitutional. Hon’ble Sir-With due respect your applicant wants to draw the kind attention of the Hon’ble Sir to the following submissions as follows. 1-It is submitted before the Hon’ble Sir that according to PIO ,R.T.I. Communique is not maintainable because at the place of Rs.10 your applicant made available an Indian postal order of Rs.20. Hon’ble Sir be informed that your applicant also sought copy of F.I.R. so additional charge might have been taken by the PIO but it seems that PIO didn’t take the perusal of R.T.I. Communique or he has no knowledge of provisions of R.T.I. Act 2005. Hon’ble Sir Guide lines issued by the Government is attached with this appeal. 2-It is submitted before the Hon’ble Sir that if R.T.I. fee is not paid and information seeker is above poverty line ,then if required fee is not paid ,then R.T.I. communiqué is not maintainable before the competent authority. If the fee was additionally paid ,then after providing the sought information if PIO thinks fit may return back additional paid amount to information seeker in the interest of justice. It can never be justified to withhold the sought information in cryptic way. 3-It is submitted before the Hon’ble Sir that your applicant is sending the same Indian Postal order of Rs 20.00 with this appeal and Hon’ble Sir direct the PIO to made available the sought information. Copy of denial of sought information is also annexed with appeal. This is humble request of your applicant to you Hon’ble Sir that It can never be justified to overlook the rights of citizenry by delivering services in arbitrary manner by floating all set up norms. This is sheer mismanagement which is encouraging wrongdoers to reap benefit of loopholes in system and depriving poor citizens from right to justice. Therefore it is need of hour to take concrete steps in order to curb grown anarchy in the system. For this your applicant shall ever pray you Hon’ble Sir.
