Sir it is most embarrassing situation that because of rampant corruption in the public offices, a man of dignity avoid to attend the public offices because of the fear that he may be asked for illegal gratification. Sir this is election hour as forthcoming election is going to be held soon so it is must that those remained in power since five years must tell the people of this country about their efforts made in regard to appointment of anticorruption ombudsman as last government of the congress faced humiliating defeat on the issue of appointment of anticorruption mechanism in the country which is the foremost need of the countrymen except few corrupt.

Hon’ble CPIO of the prime minister office, the information seeker invites following pointwise information under subsection 1 of section 6 of the Right to Information Act 2005.
1- The historic Lokpal and Lokayuktas Act, 2013 was passed by Indian Parliament paving the way for the establishment of a Lokpal (Ombudsman) to fight corruption in public offices and ensure accountability on the part of public officials, including the Prime Minister, but with some safeguards.
Please provide the minute’s proceedings and communications exchanged by the prime minister office of the government of India in regard to the appointment of the Lokpal and its office bearers.
2-If the Lokpal was ever appointed by the government, provide his detail.
3-If still the appointment of the Lokpal is pending, then what is being done by the ongoing incumbent to create a safe passage for the appointment of the Lokpal as corruption is rampant in the government machinery so the appointment of an anti-corruption ombudsman is must in the central government in view of wide public interest which may curb the corrupt activities of the executives and bureaucrats.
                 Please provide the aforementioned pointwise sought information within the prescribed time as stipulated under subsection 1 of section 7 of the Right to Information Act 2005.
 This is a humble request of your applicant to you Hon’ble Sir that It can never be justified to overlook the rights of the citizenry by delivering services in an arbitrary manner by floating all set up norms. This is sheer mismanagement which is encouraging wrongdoers to reap the benefit of loopholes in the system and depriving poor citizens of the right to justice. Therefore it is the need of the hour to take concrete steps in order to curb grown anarchy in the system. For this, your applicant shall ever pray you, Hon’ble Sir.

The Lokpal and Lokayuktas Act, 2013[edit]
The historic Lokpal and Lokayuktas Act, 2013 was passed by Indian Parliament paving the way for the establishment of a Lokpal (Ombudsman) to fight corruption in public offices and ensure accountability on the part of public officials, including the Prime Minister, but with some safeguards.
Lokpal will consist of a chairperson and a maximum of eight members, of which 50% will be judicial members 50% members of Lokpal shall be from SC/ST/OBCs, minorities and women. Selection of chairperson and members of Lokpal through a selection committee consisting of PM, Speaker of Lok Sabha, leader of opposition in Lok Sabha, Chief Justice of India or a sitting Supreme Court judge nominated by CJI. Eminent jurist to be nominated by President of India on basis of recommendations of the first four members of the selection committee “through consensus”. Lokpal’s jurisdiction will cover all categories of public servants. All entities (NGOs) receiving donations from foreign source in the context of the Foreign Contribution Regulation Act (FCRA) in excess of Rs 10 lakh per year are under the jurisdiction of Lokpal. Centre will send Lokpal bill to states as a model bill. States have to set up Lokayuktas through a state law within 365 days.
·         Lokpal will have the power of superintendence and direction over any central investigation agency including CBI for cases referred to them by the ombudsman.
·         A high-powered committee chaired by the PM will recommend selection of CBI director. The collegium will comprise PM, leader of opposition in Lok Sabha and Chief Justice of India PM has been brought under purview of the Lokpal, so also central ministers and senior officials.
·         Directorate of prosecution will be under overall control of CBI director. At present, it comes under the law ministry.
·         Appointment of director of prosecution to be based on recommendation of the Central Vigilance Commission.
·         Director of prosecution will also have a fixed tenure of two years like CBI chief.
·         Transfer of CBI officers investigating cases referred by Lokpal with the approval of watchdog.
·         Bill incorporates provisions for attachment and confiscation of property acquired by corrupt means, even while prosecution is pending.
·         Bill lays down clear timelines for preliminary enquiry and investigation and trial. Provides for special courts Public servants will not present their view before preliminary enquiry if the case requires ‘element of surprise’ like raids and searches.
·         Bill grants powers to Lokpal to sanction prosecution against public servants.
·         CBI may appoint a panel of advocates with approval of Lokpal, CBI will not have to depend on govt advocates.
On May 15th 2018, Mukul Rohtagi (Former Attorney General of India) has been appointed as an eminent jurist in the selection panel of Lokpal.
This is a humble request of your applicant to you Hon’ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness and chaos in an arbitrary manner by making the mockery of law of land? This is the need of the hour to take harsh steps against the wrongdoer in order to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. It is well established fact that corruption originates from greed so it is reflection of adverse effect when the members of anti corruption ombudsman office is demanding salary and perks from the government such members cannot be proved to control the corruption from the system. Undoubtedly those hankering after wealth cannot be instrumental in controlling the corruption growing in our government machinery. Whether it is not surprising that concerned are instead of thinking about the allocated duty indulged in pursuing unproductive activities. At the present time our country is burning in the fire of corruption and we have to curb this fire we also have to keep away anti corruption ombudsman office from this fire of corruption.A

Think about the gravity of situation that on one side of a screen Modi is talking of honesty on the public platforms but on the other side of screen he did not make any efforts in order to appoint Lokpal which was the sheer cheating with the electorates of this country as Bharatiya Janata Party made electoral rhetorics during the campaign in earlier elections that they will bring up a hard Lokpal Bill so they cheated the country men such cheaters may not be forgiven by the electorates. How much cunning behaviour you give only 60 months and what is not given by the Congress in 60 years I will do in the 60 months but these 60 months have passed and they did nothing and poverty line is moving much below the expected values. The treatment of prime minister is misleading which cannot be in the interest of this largest democracy in the world. undoubtedly there is manifold increase in the corruption in the government machinery of this country which must be cured at any cost so there must be changed in the regime.
