Misuse of criminal procedure code section 107/16 by the Mirzapur police.

To direct D.G.P. Police to keep its promise in regard to taking action against police personnel who remained failed to curb tragic incidence when the matter of land dispute earlier resolved by them.

In most of the cases Mirzapur police apply Cr. P.C. 107/16 in which members of both the parties are subjected to same penal proceedings i.e. Cumbersome process of magistrate court. Whether it is justified that aggrieved may also be implicated under aforesaid section of criminal procedure code.

Hon’ble Sir -Matter is concerned with village-Pakari ka pura Police station-Padari District-Mirzapur. Matter is concerned with land dispute. Both the parties battled in the evening of Friday and 55 years old Abhimanyu Pandey departed from this mortal word as he was seriously injured and was declared brought dead by Doctors of primary health centre Padari . Most interesting point is on 21 May , Padari police had applied section 107/16 of criminal procedure code on both the parties. Whether one of the parties took shelter of police in order to seek justice or to waste the time in the cumbersome proceedings of S.D.M. Court. Whether the proceedings initiated with aim to provide justice or mere to harass so that their mouth be shut. Whether the S.P. Mirzapur and additional S. P. who reached on the site  of tragic incidence to show the alertness ever showed the alertness to deal such matters when come before them. Most surprising is that matter concerned with Jigana police is sent to Vindyachal police and when aggrieved enquires then representations are sought back in order to send jigana police.
With due respect your applicant wants to draw the kind attention of the Hon’ble Sir to the following submissions as follows.
1-It is submitted before the Hon’ble Sir that Hon’ble D.I.G. Instructed the subordinates to make accountable concerned station officer and Circle Officer for the crime activities if increasing sharply but it seems that it was merely a press release.
Hon’ble Sir-On last Friday , a meeting was convened by Deputy Inspector General of police of Vindhyachal range Mr. Shivsagar Singh in order to control the steep hike in criminal activities in the range. Superintendent of Police of concerned districts participated in the meeting. In the meeting many issues were focussed but one issue attracted your applicant that was concerned with the forfeiture of property of criminals. I am too much glad that police has power to attach the property of criminals but most regretting that a criminal move on the road not only in expensive luxury vehicle but in his convoy such luxury expensive vehicles are numerous and it seems that these vehicles are just purchased. Inspector rank police officers salute them.

After 17 years of registry ,musclemen grabbed the Land and house of Vijay Narayan Singh and Jigana police remained mute spectators and now when son of victim Vijay Narayan Singh i.e. Rajendra Kumar Singh is seeking justice by sending applications to various accountable public functionaries of Government of India ,then he was implicated in 107/16 by Jigana police in order to shut his mouth. Whether this is not violation of Human Rights of aggrieved.

This is humble request of your applicant to you Hon’ble Sir that It can never be justified to overlook  the rights of citizenry by delivering services in arbitrary manner by floating all set up norms. This is sheer mismanagement which is encouraging wrongdoers to reap benefit of loopholes in system and depriving poor citizens from right to justice. Therefore it is need of hour to take concrete steps in order to curb grown anarchy in the system. For this your applicant shall ever pray you Hon’ble Sir.

  3. These public functionaries are drawing huge public fund as salary but greed hold them under its clutches .Because of this greed ,they indulge in wrongdoings. This is the root cause that police never supports truth . Undoubtedly corruption originated from the greed of corrupt public functionaries have made our life hell. Numerous reformists are facing trials as consequence of hatched conspiracy by corrupt public functionaries.. Every public place is contaminated in this democratic republic.

    It depends upon quantum of offence. Either you may appeal to next appellate authority against illegal institution or take shelter of article 226 or 32 of constitution of India.
