Today customer/consumer as advised by the customer care of the Micromax Company in the attached mail revisited the service centre of the Micromax Company situated at Brahmchaari ka Kuaa, Police Line Road, district-Mirzapur but it seemed that concerned customer care of the Micromax Company undoubtedly had talk but didn’t take in confidence to M/s Mobile Solution (Mirzapur),Bramchari Ka Kuwan, Police Line Road, Mirzapur, Uttar Pradesh-231001,0544-2256072,9305543706 as his behaviour with the consumer was weird. Copy of Mobile handset is attached to the document explicitly showing its L.C.D. is safe and if a Phone call is made on the set, then it rings. Most surprising is that service centre staff without opening the set reached on the conclusion that set is physically damaged.

Your role is like a body without teeth and nail. More accountability will be clear as I will just file R.T.I. in order to seek information from the department of consumer affairs. Government is spending huge fund but instead being consumer friendly your treatment is quite cryptic.

Warranty period didn’t lapse because of flimsy claim of service centre staff and company didn’t abide by its own terms and conditions so price of the product be refunded by company.

Subject-Whether customer care can take the recourse of cryptic word physical damage and escape from the liability of warranty which is a general term. Warranty means free of cost services provided by company concerned during the warranty period.
Undoubtedly matter will be brought up before the consumer forum appropriate in order to seek justice consequently points raised in the grievance be attended by the staffs of the Micromax company with due care and attention.
With due respect your applicant wants to draw the kind attention of the Hon’ble Sir to the following submissions as follows.
1-It is submitted before the Hon’ble Sir that

 customer care staff responded illogically and in very irresponsible manner as follows-

Here this question arises that when aggrieved itself mentioned in the grievance that service centre staff denying services on flimsy ground that mobile hand set is physically damaged, then what was the need to talk  with the staffs of service centre and request the consumer/  customer to revisit the service centre.
2-It is submitted before the Hon’ble Sir that can you tell me how many parts of Mobile hand set is physically damaged? During Telephonic conversation you told me that attached document with the grievance is not opening. So through this communication I am providing those documents again.
3-It is submitted before the Hon’ble Sir that most vulnerable part of a mobile hand set is its L.C.D. which is still safe. Whether you will not provide me services in the name of physically damaged? Undoubtedly you can charge the consumer of those parts which are physically damaged but you must show it to consumer that it is fault of the consumer so it would be charged. I have already informed that handset is still ringing when call is made on the set which implies that there is minor error in the set but because of reluctant approach of service provider centre and incompetence of concerned customer care who later dealt matter controversy took new turn.
                This is a humble request of the applicant to you Hon’ble Sir that it can never be justified to overlook the rights of the citizenry by delivering the services in an arbitrary manner by floating all set up norms. This is the sheer mismanagement which is encouraging wrongdoers to reap the benefit of loopholes in the system and depriving poor citizens of the right to justice. Therefore it is the need of the hour to take concrete steps in order to curb grown anarchy in the system. For this, your applicant shall ever pray you, Hon’ble Sir.
