BEFORE THE APPELLATE AUTHORITY UNDER THE RTI ACT, 2005 SUPREME COURT OF INDIA, NEW DELHI

WEDNESDAY, 20TH DAY OF JANUARY, 2016
APPEAL NO, 8 OF 2016
IN
DY. NO. 1921/RTI/15-I6 /SCI
Mahesh Pratap Singh
Mohalla-Surekapuram,
Jabalpur Road,
District: Mirzapur,
Uttar Pradesh-231001.
Appellant
Versus
Additional Registrar &
Central Public Information Officer,
Supreme Court of India,
New Delhi Respondent
ORDERS
Aggrieved by the reply, dated 17.12.2015 furnished by the Central Public Information Officer (CPIO), Supreme Court of India, under Dy. No. 1921/RTI/15-16/SCI, the appellant has preferred this appeal under Section 19 (1) of the Right to Information Act, 2005 (for short ‘the Act’).
The factual background in nutshell is that by his application dated 29.11.2015, the appellant craved the indulgence of the CPIO in providing him the following information:
1. Copy of report made available by the staffs of Registrar judicial to him in regard to letter petition dated 20.10.201 5.
2. Copy of the noting in regard to the abovementioned letter petition be provided. . ,.

5-It is submitted before the Hon’ble Sir that how cleverly this point was overlooked by F.A.A.  “Provide the Action taken by the Hon’ble Apex court of India in respect of aforesaid submitted petition dated 20/10/2015 under articles 32 of constitution of India as matter is concerned with grass violation of fundamental rights and wide public interest”. Whether this information was provided by the CPIO i.e. Information sought under point 3 is still awaited by your appellant.  Matter was filed in the court of Registrar judicial and order was passed by Hon’ble Registrar in the matter concerned but your applicant is still deprived from that order. Your appellant wants to draw the attention of accountable public functionaries of judiciary that how arbitrarily in unjustified manner and in cryptic way ,registrar judicial decided the fate of my petition submitted under article 32 of constitution of India . Hon’ble Sir millions of public fund has been siphoned by corrupt public functionaries concerned with Indira Awaas Yojana and in the name of enquiry ,horses are run on paper and no wrongdoers are punished.
6-It is submitted before the Hon’ble Sir that copy of order passed by Registrar judicial in the matter concerned be made to your appellant in regard to provide the sought information to appellant under point 3. Here action taken by Supreme court of India is tantamount to action taken by its staffs whether it may be his lord ships or staffs of registry as your appellant sought action taken on the submitted petition by supreme court of India and action has been taken by registrar judicial on behalf of supreme court of India.

This is humble request of your applicant to you Hon’ble Sir that It can never be justified to overlook  the rights of citizenry by delivering services in arbitrary manner by floating all set up norms. This is sheer mismanagement which is encouraging wrongdoers to reap benefit of loopholes in system and depriving poor citizens from right to justice. Therefore it is need of hour to take concrete steps in order to curb grown anarchy in the system. For this your applicant shall ever pray you Hon’ble Sir.
                                      ‘Yours  sincerely

  1. It is submitted before the Hon'ble Sir that copy of order passed by Registrar judicial in the matter concerned be made to your appellant in regard to provide the sought information to appellant under point 3. Here action taken by Supreme court of India is tantamount to action taken by its staffs whether it may be his lord ships or staffs of registry as your appellant sought action taken on the submitted petition by supreme court of India and action has been taken by registrar judicial on behalf of supreme court of India.

  2. Really true that our public functionaries have elephant teeth. It is submitted before the Hon'ble Sir that on one side of screen ,apex court claim to provide justice to weaker and downtrodden section as judicial activism if informed on only writing on a simple post card but other side of screen even those petitions duly paid court fee are not reaching to benches because their fates are decided by the registry of the apex court.

  3. Think about the gravity of situation that lakhs of public funds were siphoned by concerned public functionaries but fate of writs are decided by the registry of apex court of India. Former chief justice of India issued notification in order to constitute special bench to deal with social interest litigation but still bench could not be constituted.
