An appeal under subsection 3 of section 19 of the Right to Information Act 2005 against the denial of sought information by Praveen Kumar Undersecretary and CPIO in the Prime Minister’s Office.

Subject-CPIO through its communication dated 17/05/2018 addressed to appellant, denied the sought information on the flimsy and cryptic grounds and in a mischievous way. He must be subjected to scrutiny under section 20 of the Right to Information Act 2005 of India.

First appellate authority instead of applying own rational mind, only copied the irrational decision of CPIO so disciplinary proceedings may be initiated against him so that such practice of non-providing sought information to information seekers may be curbed.

With due respect and regard to Hon’ble Sir, the appellant invites the kind attention of the Hon’ble Sir to the following submissions as follows.

1-It is to be submitted before the Hon’ble Sir that your appellant sought the following information from the CPIO.

1-CPIO may provide the noting in regard to attached representation dated 11/03/2016 and 17/09/2014 and name and designation of public staffs processed them.
2-Please provide the action taken report on the aforementioned submitted complaints and if forwarded somewhere else, then under subsection 3 of section 6 for information.

2-It is to be submitted before the Hon’ble Sir that CPIO Praveen Kumar through its reply dated-17/05/2018 addressed to appellant denied the sought information on the ground that aforementioned sought information is not clear.

3-It is to be submitted before the Hon’ble Sir that as aforementioned CPIO had sought the resend of the application specifying the information so the appellant submitted following e-mail representation

4-It is to be submitted before the Hon’ble Sir that when the information was not made available by the CPIO then appellant submitted the first appeal before aforementioned first appellate authority and aforementioned e-mail representation as supportive document.

 

5-It is to be submitted before the Hon’ble Sir that First appellate authority instead of applying own rational mind, only copied the irrational decision of CPIO so disciplinary proceedings may be initiated against him so that such practice of non-providing sought information to information seekers may be curbed.

This is a humble request of your applicant to you Hon’ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness and chaos in an arbitrary manner by making the mockery of law of land? This is need of the hour to take harsh steps against the wrongdoer in order to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. Everyone knows the Prime Minister Office adopted lackadaisical approach to the provisions of the Right to Information act 2005. We have seen several posts on this August forum that Prime Minister office of this country did not provide information to the information seekers which is not only mockery of the The Right to Information act 2005 but also reflecting that there is rampant corruption in the public offices of the Government of India and its administrative heads are not interested to curb such corrupt practices in the government offices.

Already there are allegations against the Prime Minister office that they are hatching conspiracy to dilute the provisions of Right to Information act 2005 and such allegations were made broadly by the public expected people on social networking sites as well as on media both electronic and print but it is unfortunate that because of corruption our public functionaries are not interested to pay heed to such allegations as greed is is dominant over them and the corruption originates from this greed.

Even a layman can understand that if prime minister office of this country does not regard the Right to Information Act 2005, then its provisions will be violated time and again by the PMO and its subsidiaries and same thing is taking place in this largest democracy in the world. Now a days Right to Information Act 2005 has been joke for the corrupt public functionaries. This was legislated by the government headed by congress party but it was put into heap of garbage by the Bhartiy Janta Party government.

Here matter is concerned with the management, government can provide huge salary to its staffs but can not provide the battery of Rs,3000 because of which public staffs sit idol for the whole day which is reflection of the complete mismanagement but no actions are taken by the concerned when representation is made before the prime minister office of this country. When information sought regarding the action, then after procrastination, no information is provided. Our today’s miseries because of such mismanagement.

यहां मामला प्रबंधन का है सरकार अपने कर्मचारियों को भारी वेतन दे सकती है लेकिन ₹3000 रुपए की बैटरी नहीं दे सकती जिसके कारण सार्वजनिक कर्मचारी पूरे दिन बेकार बैठते हैं जो पूर्ण रूप से कुप्रबंधन का प्रतिबिंब है|इस देश के प्रधानमंत्री कार्यालय से सूचना मांगा जाता है तो जवाब देने में आनाकानी करते हैं यह इनकी लापरवाही नहीं हैं लेकिन इन्हें किसी का भय नहीं है |
