Daylight
murder of the RTI Activist is the failure of state government so government may
provide support to bereaved family as done in the case of Govt staffs.The
matter is concerned with the daylight murder of the RTI Activist in District
–Mau, published with the broad headings in most of the dailies of the state.
Tragic incidence took place at Badhua Godam Patti in the Mau District at 8 O
clock in the morning. Detail is available in the attached JPG images with this
representation. Subject-Government aid may be provided to the bereaved family
of the deceased. Most revered Sir –Your applicant invites the kind attention of
the Hon’ble Sir with due respect to following submissions as follows. 1-It is
submitted before the Hon’ble Sir that undoubtedly RTI Activist martyred for a
public cause so it is the obligation of governments both at the centre and
state provide all those helps which are provided to a government staff.
Whatever riskey job was undertaken by the revered departed soul was to pursued
by the accountable public functionaries in the state but instead of taking any
positive steps for the betterment of society could not secure the life of the
public spirited individual is the failure of the government machinery in the
state. On one side of screen few public functionaries claim to be honest but on
the other side of screen really honest people in the state are being killed is
not proved contrary. If someone is really honest undoubtedly he will have
sympathy to the people murdered because of pursuing the path of the
anticorruption crusade. 2-It is submitted before the Hon’ble Sir that
undoubtedly murder of the RTI Activist is not a good signal for the government
of the Uttar Pradesh and is reflection of the failure of the law order
mechanism in the state. Here role of the police is itself under cloud as the
matter was under the investigation by the district police and the individual
instituted the complaint was targeted by the offenders against whom charges
were alleged. Whether there is no need to investigate the role of the police
concerned who were carrying out the investigation on the complaint submitted by
the deceased with supporting documents obtained under Right to Information Act
2005?

1-It is submitted before the Hon’ble Sir that undoubtedly
RTI Activist martyred for a public cause

is not a good signal for the government of the Uttar Pradesh and is reflection
of the failure of the law order mechanism in the state. Here role of the police
is itself under cloud as the matter was under the investigation by the district
police and the individual instituted the complaint was targeted by the
offenders against whom charges were alleged. Whether there is no need to
investigate the role of the police concerned who were carrying out the
investigation on the complaint submitted by the deceased with supporting
documents obtained under Right to Information Act 2005?
3-It is submitted before the Hon’ble Sir that after Dr Manmohan Singh and now the regime of Narendra
Modi at the verge of ending but no solid and strong steps taken by the governments
installed at the centre and state in regard to the protection of the R.T.I.
Activists in this largest populous state of the largest democracy in the world.
The direction of D.G.P. doesn’t reach to subordinates in a state of Uttar Pradesh.
In this state police personnel are governed by their own rule as don’t care
what directions their superintendent has issued or what circular has been
circulated from their head office. These surprising facts came when an RTI
Activist Advocate Mr Gaurav Agarval
sought information concerned with the security of RTI Activists in the state. According to state home department, no circular/order has been issued
in concerned with the security of RTI activists.
While the D.G.P. office revealed contrary
facts that directives concerned with the
security of RTI Activists in the state have
been issued to zonal offices and units in the month of June 2011. D.G.P. office
also informed aforesaid advocate that joint
secretary of the home department of central government had issued guidelines in regard to security of RTI
activists in March 2011. It is true fact that law order is state subject and to
safeguard the life and property of people
of the state is the duty of state
government. Why state government is adopting a lackadaisical
approach in regard to compliance of
directives of the central government
concerned with the security of RTI Activists cum whistleblowers? The government
of Uttar Pradesh
is also adopting a lackadaisical approach
in the compliance of orders passed by the
members of transparency panel. Why state functionaries are wreaking vengeance
with public-spirited persons even when
they are supporting the government in fishing out corrupts from the system?
This is a humble request of your
applicant to you Hon’ble Sir that how can it be justified to withhold public
services arbitrarily and promote anarchy, lawlessness and chaos in an arbitrary
manner by making the mockery of law of land? There is need of the hour to take
harsh steps against the wrongdoer in order to win the confidence of citizenry
and strengthen the democratic values for healthy and prosperous democracy. For
this, your applicant shall ever pray you, Hon’ble Sir.

According to state home department, no circular/order has been issued in concerned with the security of RTI activists. While the D.G.P. office revealed contrary facts that directives concerned with the security of RTI Activists in the state have been issued to zonal offices and units in the month of June 2011. D.G.P. office also informed aforesaid advocate that joint secretary of the home department of central government had issued guidelines in regard to security of RTI activists in March 2011.

Government aid may be provided to the bereaved family of the deceased. I don't think that government will fulfill and accept the demand of the public spirited people to provide the public aid to the bereaved family of R.T.I. Activist because their pockets are so huge which is never filled up to level of satisfaction.

If the entire government is not not in favour of Right to Information Act then how a Right to Information activist will be favoured by them. Undoubtedly they have not taken any action in the matter which is quite obvious from The Reluctant approach in the matter. What is going on behind the screen that is holy different from the what is visible to us? Since there was matter concerned with the investigation of police staff so how can anyone blindly believe in the police personnel there is some suspense in the matter and the role of police is under cloud.
