Grievance Number: 1769313 PG Docket Number: DOCAF/E/2019/04672 Grievance Reg Date: 2019-12-03 12:18:42 Complainant Name: Preeti Singh Matter is concerned with the mass scale violation of consumer rights but it is unfortunate that concern staff of the Department of Consumer Affairs is overlooking the matter on the flimsy ground in caucus with staff of the concerned company and seller it can never be justified and mockery of the consumer rights which must be curbed at any cost. Whether staff of the Department of Consumer Affairs will tell the applicant that whatever ink is being sold on the platform of Amazon online shopping in the name of whiteboard marker is really a whiteboard marker ink if it is not, then a criminal offence is being committed by the staff of the Amazon online shopping and seller by colluding with each other and such practice must not be allowed in order to safeguard the larger Public Interest in regard to consumer affairs? Madam, how can you close the grievance submitted by the applicant and the public grievance portal and forwarded to you if the sold ink is spurious one? Madam, you have abruptly closed the grievance without thinking about the pros and cons of its decision which means you are interested to allow the sale of spurious ink on the Amazon online shopping can you explain what benefit you are reaping in allowing the spurious ink to be sold on the Amazon online shopping? It is a well-established principle that if any illegal activity is promoted by someone then there are some selfish motives to be achieved and here in the present context it is quite obvious that you are in hurry in closing the grievance of the applicant without adopting a Logistic approach in the matter. Can you tell me how the practice is genuine if the spurious ink is sold in the name of Whiteboard marker ink on the platform of Amazon online shopping I don’t think that this is legal as it will benefit the only coterie of people? In accordance with the applicant, a proper enquiry may be ordered into the matter so that truth may come out and those behind this act must be punished in accordance with the law of land.

Whatever product sold Amazon online shopping in the name white board marker ink is not really a white board marker ink. If such a company exists whose product was sold to applicant in the name of white board marker, then they make available the detail of the company like registration etc. If there is no such company, then Amazon online shopping by colluding with the such fake proprietors of the fake companies only cheating the citizens on the large scale. Which is illegal act and can not be avoided in the name third party sellers as staff of Amazon online shopping is escaping from such serious irregularity in the name of third party seller. Here spurious white board marker ink was sold by the seller by using the platform of the Amazon online shopping so promoter of such cheaters how can Amazon online shopping avoid its responsibility. Here matter is subjected to breach of consumer rights and consumer was cheated by selling spurious white board marker ink and on complaint, Amazon online shopping overlooked the complaint regarding the fake ink and fake company which explicitly implies that fake companies are selling fake items through Amazon online shopping in caucus with the staffs of the Amazon online shopping.

NCH contacted the consumer on 12th December 2019 at 12:41 PM he informed that company has provided him fake product (white board marker ink)and he is not satisfied from the company response.Advised him to move to consumer forum.

We understand that you have had a poor customer experience on account of acts/ omission solely attributable to an independent third party seller. In this regard, we would like to emphatically state that Amazon.in is an e-commerce site and an intermediary as defined under the Information Technology Act, 2000. Basis your complaint, on investigation with the seller, we find that you had placed the order on 25th July, 2019 and had not raised any issue, and have now raised these issues at a belated stage. Accordingly, we are unable to assist you. Further, it is submitted that our role is limited to that of an intermediary and we are not the seller/manufacturer of the products listed on our Website. The products listed on our Website are sold by independent third party sellers. In view of the above, the issue stands closed.

Matter is concerned with not providing Network and services on the mobile number 979 410 3433 by the service provider company Airtel which is mockery of the consumers law in this largest democracy in the world and it is humble request to the accountable public functionaries of this largest democracy to take action against the earring company making the mockery of the consumer law of this country. It is an obligation of the service provider company to refund the internet pack which has been bought by the aggrieved applicant if service provider company is not interested to provide the services which are required in accordance with the Internet pack purchased by the aggrieved applicant. Undoubtedly Airtel company is suffering huge losses but it is not justified that it may recover the losses through the corrupt dealings by exploiting the consumers and it is the obligatory duty of the concerned government functionaries to take appropriate action against the Airtel company which is not providing its services by floating consumer laws. Whether it is not cheating that concerned are charging the money but not providing the services and it is most unfortunate that our accountable public functionaries are not monitoring the activities of such service providers and only mute spectators of the loot of citizenry. Here one positive Ray of hope is still available to the consumer that he may use the option of Port in order to seek justice but he should not have any ray of hope from the government machinery because they will always do the favour of the erring company. Undoubtedly these companies have forgotten Business Ethics only indulge only in a rivalry of cheating the innocent and gullible citizenry which is completely unjustified and the failure of the system. It is bitter truth that such activities of the erring company are providing both mental and physical pain to the aggrieved applicant and providing frustrations which may culminate into mental diseases. Whether it is good governance as claimed by someone trying to be Messiah.

Tried to call the customer on 20 Dec@3.31 PM but there was no response. Tried to call the customer on 21 Dec@10.22 AM but there was no response. Called again on 23 Dec@2.28 PM but there was no response. Customer is not contactable. Request to share an alternate number. Case Closed . “

Think about the gravity of situation that a seller is selling spurious ink in the name of White board marker ink through the Amazon online shopping and concerned staff of government is saying that matter is outdated it means you cannot get the redressal of the grievance because this grievance is time barred. Whether such practices are justified in this largest democracy in the world?
