Company itself does not know whether product inside packing conforming promises written on box

This is a humble request of the applicant that whatever technical specifications are mentioned on the box of purchased must be ensured by the company under trailing email conversation.

According to the claim of the company Random Access Memory of the Tablet is 2-GB but RAM of the Tablet is mostly 500 MB.

There is no 16 GB internal storage to tablet as claimed by the company. Actually few apps download causes the tablet slow.

Battery backup is merely one hour and the system is heated during the charging of the battery.

The processor of the tablet is nominal and claim of the company and dealer were misleading and tantamount to cheating.

If the company can’t provide the item as promised during the purchase of item must refund the money paid by the applicant consumer to redeem the item.

Today in the morning, someone made a call on my mobile number-7379105911 from his mobile number-9958461111 at 10:20 AM lasted 3 minutes 1 second introducing itself as I Kall staff.

He enquired regarding damages of Tablet and applicant ensured that there is no damage as the company provides a warranty if there be no physical damage to the item because of the mishandling of the item. The motive to send this subsequent e-mail representation is to provide proof /evidence that the purchased item is free from any kind of physical damage because of mishandling of the user as user remained extra alert in using the item more than as expected from him.

The matter is concerned with the I Kall WiFi Tablet with Keyboard (7 Inch Display, 2GB Ram, 16GB Internal Storage) – White purchased by the applicant on 30-Jan-2020 and delivered on 04-Feb-2020 quite obvious from the date of order and the date of the invoice attached to the representation. Ipso facto obvious that order was made on 30-Jan-2020 while the invoice was also made and the same date. It is most unfortunate that numerous lines are appearing on the screen of the tablet when it is switched on and one line permanently appears on the screen and such defects came within 3 months of the date of purchase and now Tablet is not completing starting. It is quite obvious from the attached documents that applicant/consumer has paid 2579 rupees to the seller through the Amazon online shopping and tablet became dysfunctional within 3 months from the date of purchase whether it is Justified? Undoubtedly you are not frightening with the public functionaries but at least feel the presence of God who is the greatest judge and witness of every event.

Most revered Sir –Your applicant invites the kind attention of Hon’ble Sir with due respect to the following submissions as follows.

1-It is submitted before the Hon’ble Sir that Undoubtedly company concerned has provided a warranty of one year but how can it be justified that in the name of warranty it may provide the third-grade product to the consumers as being done by the earring company. Quality cannot be compensated through warranty.

2-It is submitted before the Hon’ble Sir that  Here either the erring company may refund the Total Paid amount by the consumer or get exchanged this third-grade product through genuine one. In the name of warranty whether a consumer can be pressed to travel from one Consumer service Center to the other Consumer service Center as being done by the concerned erring company.

3-It is submitted before the Hon’ble Sir that  Weather once the product was sold and Company took its price then its duty is over or before selling it must ensure that it is providing a genuine product to the consumer which will remain stable for a specific period but here within 3 months it became so defective that it doesn’t seem that more than 6 months it will run. Here sold product is not conforming the setup norms, therefore, must be exchanged by a genuine one.

This is a humble request of the applicant to you Hon’ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness, and chaos arbitrarily by making the mockery of law of land? This is the need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your applicant shall ever pray you, Hon’ble Sir.

Undoubtedly because of rampant corruption in the government machinery, consumer rights of citizenry no more safe.Here our public functionaries instead curbing corruption, itself supports promotion of corruption in the public offices. Illegal gratification/ backdoor income / out income other than legitimate income is the core issue and status symbol in this largest democracy in the world so public functionaries give it utmost importance so it is not considered as the bad culture. If queries are made regarding the employment, then it is surely asked that whether there is extra income which is taken more seriously.

Undoubtedly they must refund the paid amount on the moral ground as they misled the consumer but instead of being frightened they are fearlessly sat silently and keeping vigilant eyes to keep itself aloof from the matter. Undoubtedly in this corruption era, there is only corrupt dealing and all kind evils are in practice and our society itself corrupted. People says if our leader is telling lies then what is wrong if I am doing so.

Our motive is betterment of society which can be accessed through good governance but because of corruption, it seems that path is not so easy. There are several opticals in the path of good governance and we have to remove these hurdles. Think about the protection of consumer rights in this country that what ever characteristics are are described of the product on the box nothing found in the product. Here consumers are openly looted by the corrupt dealers and companies by colluding with the corrupt staffs of the government and on the complaints, no action is taken by the accountable public functionaries of the Government of India.
