Point to be noted that F.A.A. did not entertain the matter as it was solely responded by CPIO/ General Manager L.P.G. Arun Prasad ipso facto obvious from the attached document. Such insolence to the orders passed by the constitutional functionaries tantamount to anarchy which may infuriate such highly privileged responsible public functionary and transparency ombudsman during the hearing of non-compliance.

Non compliance of the order passed by the Hon’ble chief information commissioner of India. Following information was sought from CPIO.

CPIO may provide the information as follows. 

1-Provide progress report in the sequence of the communication dated 09 Aug 2018 addressed to the applicant and attached with RTI Communique 

2-Total number of gas consumers who are deprived of gas subsidy in the state of Uttar Pradesh as in the case of Vindheshwari gas service. 

3-Total number of consumers whose withheld subsidy was refunded to comply with subsequent circular of the ministry concerned.

Order of Hon’ble Chief Information Commissioner-

Keeping in view of the fact of the case and the submissions made by the parties, the commission directed the FAA to re-examine the R.T.I. Application in reference of the circular referred to by appellant and furnish a clear cogent and precise reply to appellant within a period of 30 days from the date of receipt of this order depending upon the condition for containment of Coronavirus Pandemic in the country or through e-mail.

Reply of the F.A.A.-Point to be noted that F.A.A. did not entertain the matter as it was solely responded by CPIO/ General Manager L.P.G. Arun Prasad ipso facto obvious from the attached document.

CPIO aforementioned articulated as-

महोदय अवगत कराना चाहेंगे की दिनांक ३०/०६/२०२० तक उत्तर प्रदेश में इंडेन एल पी जी के कुल 538952 गैस उपभोक्ता एन सी.टी.सी. (नान गैस ट्रान्सफर कम्प्लायंट) है जिनकी गैस सब्सिडी  नही जा रही है | ऐसे उपभोक्ता आधार एवं अन्य आवश्यक दस्तावेज जमा कर सब्सिडी प्राप्त कर सकते है |

Hon’ble chief information commissioner Sir-commission directed the FAA to re-examine the R.T.I. Application in reference of the circular referred to by appellant and furnish a clear cogent and precise reply to appellant. 

Here matter is concerned with the refund of subsidy in compliance with the circular which was withheld by the Indian Oil Corporation Limited but they are only misleading the applicant as well as accountable public functionaries of the government of India since the beginning. 

It is most surprising that public offices in this country flooded with the incompetent staffs who can’t understand the orders passed by the constitutional functionaries. They only understand the language of corruption and furnish parrot reply accepted by the functionaries of impeccable integrity. Once they face honest public functionaries which means they are under deep trouble. 

Sought information is under three points but this information is not consistent with any one of them.   

दिनांक ३०/०६/२०२० तक उत्तर प्रदेश में इंडेन एल पी जी के कुल 538952 गैस उपभोक्ता एन सी.टी.सी. (नान गैस ट्रान्सफर कम्प्लायंट) है जिनकी गैस सब्सिडी  नही जा रही है | 

2-Total number of gas consumers deprived of gas subsidy in the state of Uttar Pradesh as in the case of Vindheshwari gas service.

Here matter concerned with Vindheshwari gas service means according to circular provided to applicant and attached here such gas consumers they can not deprive of gas subsidy as the time to provide Aadhar card, extended by the government so withheld subsidy had to be refunded by the I.O.C.L.

Company staff itself accepted that advice was sought from the higher rank but not made available as sought under point 1.

Sir when time to link Adhar was extended by the government and submitted affidavit before apex court of India, how can I.O.C.L. Uttar Pradesh can withhold subsidy from the grace period?

इस मेरे प्यारे देश को क्या हुआ सोचता होगा||

                     This is a humble request of your applicant to you Hon’ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your applicant shall ever pray for you, Hon’ble Sir.

This is not only but more than corruption you can say that Anarchy is prevailed in the department of Indian Oil Corporation Limited in the Lucknow office because they are not providing information even after the order passed by the the Chief Information Commissioner of India which is the mockery of the law of land and matter remained a topic of discussion in the office of transparency ombudsman but information could not be provided properly because of the deep rooted corruption in the office of IOCL

The matter is concerned with the deep rooted corruption as thousands of the domestic gas connection holders were deprived of their gas subsidies arbitrarily and repeated applications were submitted by the public spirited person under subsection 1 of the section 6 of Right to Information act 2005 and they did not provide the information first appeal was submitted under subsection 1 of section 19 and then second appeal was submitted under subsection 3 of section 19 of Right to Information act 2005 and favourable orders were given by the central information commission but no information was made available.
