Matter is concerned with diary number-157566 dated-26/11/2015 addressed to Sommari Devi (Budhiya Dadi),Village-Neebi Gaharwar,Post-Neebi Gaharwar ,District-Mirzapur (U.P.) Pin code-231303. Signed copy of second appeal submitted online was returned  back by the staffs of CIC merely on the ground that why only signed copy of second appeal was submitted and other documents including RTI Communique ,first appeal and supporting evidences were not made available to them.

With due respect your applicant wants to draw the kind attention of the Hon’ble Sir to the following submissions as follows.
1-It is submitted before the Hon’ble Sir that Sommari Devi was provided five Indira Awases but in the month of last August -September her Indira Awas was made by public functionaries and still to be completed. Four houses were siphoned by the concerned. Here this question arises that whether staffs of CIC will not play its role. Dozen of registered letters were sent to Sommari Devi by the concerned department which were well responded by the senior lady and now CIC is depriving her from the sought information ,merely on the ground that illiterate revered old lady did not sign the all concerned documents. Why she had made thumb impression on only second appeal? Please take a glance of attached documents with this representation.
2-It is submitted before the Hon’ble Sir that
C.I.C. May be instrumental in providing sought information to senior citizen who is 80 years old.

Hon’ble Sir may be pleased to take a glance of scanned copy of second appeal with thumb impression of your applicant and receipt of postal department is pasted on it.
2-It is submitted before the Hon’ble Sir that second point information sought
by your appellant is under point 2 seeking following information Please  made available maximum number of unique identities which a beneficiary of Indira
avas can have. Your applicant has five , Shivraj S/O Jagannath has two , Mata Prasad
S/O Kashi Ram has two etc. Hon’ble Sir be pleased to take a glance of letter of B.C. Behera dated 02-July-2015 attached with this representation as PDF document  , director Government of India which states that I.A.Y. Beneficiary must have B.P.L. Card and his name should be included in the I.A.Y. Waiting list. Hon’ble Sir whether this is appropriate and relevant reply if fund concerned with numerous Indira Avases were siphoned by corrupt public functionaries by making multi B.P.L. Cards on the name of single individuals. Whether the reply is not misleading.
3-It is submitted before the Hon’ble Sir that according to letter of director, I.A.Y. Scheme is centre sponsored scheme which is implemented by state government so complaints of public are entertained by staffs of state government. It means all the fund concerned with I.A.Y. May be misappropriated by the wrongdoer staffs of state government and central government may remain mute spectators. Here aggrieved takes shelter of central government when he/she is frustrated with lackadaisical approach of staffs of state government on the matters concerned with the allegations of corruption.

Central Information Commission and State Information Commissions acting in caucus with public authorities exploring various tricks to deprive information seekers from their sought information. Such unhealthy practice merely promoting corruption in the system and incredibility of public institutions is swarming up in the psyche of common man.

Whether this is not corruption that CPIO, High court of judicature at Allahabad took under teeth the direction of central information commission and CIC remained mute spectators of it. What is the need of such teeth less information commissions who are merely burden on public exchequer ?
With due respect your applicant wants to draw the kind attention of the Hon’ble Sir to the following submissions as follows.
1-It is submitted before the Hon’ble Sir that central information commission returned back 15284 second appeal /complaint filed before it on flimsy ground. Whether it is justified way to curb the backlog. Please take a glance of attached documents with this representation.
 2-It is submitted before the Hon’ble Sir that whether violation of subsection 1 of section 7 is curable before first appellate authority if not ,how commissions can overlook the complaints on the ground that first appeal was not made in the matter. First appeal may be instrumental in seeking information but not penalizing the erring PIOs. In most of the cases ,F.A.A. blindly supports the stand of public information officers.
 3-It is submitted before the Hon’ble Sir that in the name of selection of judicial members as information commissioners , Government/ state government articulates that job of information commissioner is merely to be instrumental in providing the sought information to common citizenry but when government appointed information commissioners had to be instrumental in providing sought information , they hatch various tricks to deprive information seekers from seeking information as information seeker bypassed the jurisdiction of first appellate authority.

 This is humble request of your applicant to you Hon’ble Sir that It can never be justified to overlook  the rights of citizenry by delivering services in arbitrary manner by floating all set up norms. This is sheer mismanagement which is encouraging wrongdoers to reap benefit of loopholes in system and depriving poor citizens from right to justice. Therefore it is need of hour to take concrete steps in order to curb grown anarchy in the system. For this your applicant shall ever pray you Hon’ble Sir.
