Attempt of Akhilesh Government to get reprieve in the C.B.I. inquiry, ordered by High court, failed in S,C.I.


New Delhi: The Supreme Court on Friday gave a green signal for a CBI (Central
Bureau of Investigation) probe into alleged misappropriation of funds under the
Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA) scheme in
seven districts of Uttar Pradesh. According to apex court-There should be no
difficulty to Government of Uttar Pradesh if central agency investigate the
irregularity in MGNREGA as matter is not only concerned with the state. Central
government pass the fund under MGNREGA so there is no any lacuna in order of
High court in regard to carry out C.B.I. inquiry of irregularity in the work
carried out under MGNREGA.
A bench headed by chief justice P. Sathasivam dismissed a batch of petitions including that of Uttar Pradesh
government challenging the Allahabad high court verdict for CBI probe into the
alleged irregularities. Government of Uttar Pradesh tried to justify its stand
that it already had taken up many hard decisions and still it is taking so many
hard decisions so there is no need of inquiry by the central agency but Apex
court didn’t agree with the flimsy ground of state government and upheld the
public spirited judgement of High court at Allahabad.
The Allahabad high court had on 31 January directed CBI to
investigate the alleged abuse and misappropriation of funds under MGNREGA
scheme in Uttar Pradesh’s seven districts
Balrampur, Gonda, Mahoba, Sonbhadra, Sant Kabir Nagar, Mirzapur and
Kushinagar
between 2007 and
2010. The high court order was passed on a PIL.
In the first round of its investigation in Mirzapur Distrct C.B.I.
team only sticked with district head quarter specially MGNREGA cell.
C.B.I. team ,during its first round remained three
days in the district and its focus was to attach the documents concerned with
inquiry carried out by E.O.W. This team neither visited on any block nor
inspected any work site in order to verify the work carried by the concerned.
When it summoned the file concerned with work carried out at development blocks
under MGNREGA through Deputy Commissioner MGNREGA Dr. A. N. Mishra but
concerned secretaries and A.D.O. panchayat of block-Cone didn’t make available
any documents to him. As usual deputy commissioner warned them of stern action.

  1. Akhilesh Yadav Government knocked the door of Supreme court of India against the landmark judgement of Lucknow bench of Allahabad High court in regard to MGNREGA scam . This exposed the real face of Akhilesh Yadav government in public domain in regard to curb growing corruption in the system.
    Billions of rupees was siphoned by concerned public functionaries of Government of Uttar Pradesh provided by central government of India and when central government carried out inquiry ,then state government didn't take any action against wrongdoers on the recommendation of central ministry .Matter was brought up by a public spirited lawyer before the " Lucknow" division bench of Allahabad High court consist of Justice D.P.Singh and Ashok Pal Singh . Hon'ble High court after well consideration ,reached on the conclusion that in seven districts, thorough inquiry may be carried out by the C.B.I. and in the rest of the districts ,a preliminary inquiry may be carried out by apex investigating agency.

Undoubtedly the Akhilesh Yadav Government morally should have supported the public spirited verdict of High court but couldn't do it because of its nature as they play complementary role of Mayawati Government. But Apex court by not supporting government of Uttar Pradesh ,performed its duty well. At least poor and downtrodden will get justice.

  3. Gun culture-Now it has been culture that when a politician comes on the road ,then instead of two shadow ,he is surrounded by several people having rifles called as private shadow of Neta ji. Who created this culture? For this culture ,not only neta ji is not accountable but this corrupt system is also accountable. Here most of the Arms licences are granted to those who are criminals and now they can perpetrate their criminal activity openly while earlier they had to hide its weapons as it were illegal. To take licence ,most requirement is the convience charges at various places. What is the use of these licences when police can protect me. Large number of weapon licence is only showing that our police is incapable to protect us. Whether we have adopted right path.
