Whether Non Cognizable Report is lodged as blocker of First Information Report which is constitutional right of aggrieved originate from Right to Justice under article 32and integral part of fundamental rights safeguarded by Apex court of India.

With due respect your applicant wants to draw the kind attention of the Hon’ble Sir to the following submissions as follows.
  1. 1-It is submitted before the Hon’ble Sir that your applicant sought information from public information officer ,S.P. Office Mirzaur concerned with the action taken by the police on the grievances of  aggrieved forwarded by chief minister office to S.P. Mirzapur. Hon’ble Sir may be pleased to take the perusal of attached documents with this representation.
  2. 2-It is submitted before the Hon’ble Sir that no F.I.R. Is lodged by Mirzapur police while it is mandatory duty of police personnel in-charge of police station to do so.
What are consequences if the police refuses to file an FIR?
The person in- charge of a police station cannot refuse to register an FIR. It does not matter whether or not the information given is genuine. It is the statutory duty of a police officer to register an FIR whenever any information pertains to the cognizable offence is reported to him/her.
In case the person in charge of a police station fails or refuses to register the FIR, then the person intends to file FIR can approach superintendent of police who will either himself or through any other officer get the FIR registered.
To inform the Superintendent of such non registration via a written complaint which may be sent to the Superintendent of Police through post. This is an effective method of ensuring that your plea is heard and don’t forget to mention the name of the police officer who refused to file an FIR.
3-It is submitted before the Hon’ble Sir that no interest in providing the sought information is itself reflection of cryptic dealings of police so respective PIO is avoiding disclosure of sought information.
This is humble request of your applicant to you Hon’ble Sir that It can never be justified to overlook  the rights of citizenry by delivering services in arbitrary manner by floating all set up norms. This is sheer mismanagement which is encouraging wrongdoers to reap benefit of loopholes in system and depriving poor citizens from right to justice. Therefore it is need of hour to take concrete steps in order to curb grown anarchy in the system. For this your applicant shall ever pray you Hon’ble Sir.
