An application under article 32 of the constitution of India to curb the misinterpretation of provisions of Right to Information Act 2005 by bureaucrats of state of Uttar Pradesh as well as diluting its provisions to safeguard the corrupt activities of corrupt staffs of the various departments.

Claim -There is no rule of law in the government of Uttar Pradesh, we are being governed by sheer anarchy. Apex court could not protect our constitutional rights.

With due respect, the applicant invites the kind attention of the most revered learned Chief

Justice of India to the following submissions as follows.

1-It is submitted before the Hon’ble Sir that following is the message displaying on the Top of the R.T.I. portal of the government of Uttar Pradesh.

Please do not file RTI application/first appeal through this portal for Departments/Public Authorities under Central Government or other State Governments. If filed, the application would be returned without refund of the fee amount.

Moreover, the instructions on the home page of the portal clearly indicate viz. Accordingly, your RTI application, which is the concern of a public authority under any State Government, is returned herewith. You may file the same before the concerned public authority under the State Government.

(ii) the subject matter of which is more closely connected with the functions of another public authority,

the public authority, to which such application is made, shall transfer the application or such part of it as may be appropriate to that other public authority and inform the applicant immediately about such transfer:

Provided that the transfer of an application pursuant to this sub-section shall be made as soon as practicable but in no case later than five days from the date of receipt of the application.

2-It is submitted before the Hon’ble Sir that I have already made the representation in regard to mockery of Right to Information Act 2005 by the state public information officer of the same department and now illegal stand is being upheld by First Appellate Authority.

3-It is submitted before the Hon’ble Sir that think about the gravity of situation that bribes are taken in the name of senior rank officers and matter is brought up before the accountable public functionaries but no action is taken. Whether it is rule of law and government is running according to provisions of the constitution of India?

Audio visual evidence of bribe of Rs.100000.00 taken by A.D.O. panchayat but no action yet ongoing incumbent in the state is honest. Entire Mirzapur knows the fact but intelligence of state government is so weak that they are not apprised with this scandal.

This is a humble request of your applicant to you Hon’ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness and chaos in an arbitrary manner by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer in order to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your applicant shall ever pray you, Hon’ble Sir.

Recently media reported that a family made efforts to commit suicide because police was not supporting the rape victim but they were making efforts to close the case by taking the bribe from the rapists in the Varanasi district which is the constituency of the Prime Minister Mr Narendra Modi sir, whether it is justified in the constituency of the Prime Minister sir where justice is not available to the rape victim but police is colluding with the rapists and taking bribe in order to close the case. Even the applications of the rape victim were not taken which is the reflection of Tyranny on the part of government functionaries.

  3. Application has been submitted and required fee has been submitted and now concerned nodal officer and others instead of providing the information denying the sought information on false and flimsy ground. Whether it is not mockery of the law of land.?
